RE: DECLARE CERTAIN EQUIPMENT AS SURPLUS PROPERTY, AND AUTHORIZE
SALE OF SAME TO DAVE BECKER
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, State statute and the Weld County Code require that all items disposed of
be declared surplus by the Board of County Commissioners, and
WHEREAS, the County has determined that certain pieces of equipment, described as
two 1,000 Gallon Fuel Storage Tanks, being more fully described in said proposal which is
attached hereto and incorporated herein by reference, are no longer required for County use,
and
WHEREAS, the Board has been presented with a bid for purchase for said equipment
from Dave Becker, 100777 County Road 3, Lyman, Colorado 69352, and
WHEREAS, the Board has been presented with a proposal from Dave Becker to buy
said equipment for and in consideration of the sum of$75.00 each for a total amount of
$150.00, and
WHEREAS, the Board deems it advisable to declare said equipment as surplus and
approve said bid proposal.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the abovementioned equipment be, and hereby is, declared
surplus.
BE IT FURTHER RESOLVED by the Board that the bid for purchase of said equipment
from Dave Becker in the amount of$150.00, be, and hereby is, approved.

Weld County, Colorado will receive proposals for the following:
2 EACH OF 1,000 FUEL STORAGE TANKS
Proposals will be received by the Purchasing Department, 915 - 10th Street, Greeley, Colorado,
until October 2"d, 2001 @ 5:00 P. M .WELD COUNTY PURCHASING TIME CLOCK) at
which time said proposals will be publicly opened. If any questions please call Claud Hanes,
Weld County Comptroller @ 970-356-4000 ext. 4444.
The Board of Weld County Commissioners reserves the right to reject any or all bids, to waive
any informalities in bids, and to accept the bid that, in the opinion of the Board, is in the best
interests of the Board and of the County of Weld, State of Colorado.
The Board of Weld County Commissioners shall give preference to resident Weld County
bidders in all cases where the bids are competitive in price and quality.

The undersigned bidder hereby offers to provide the goods and/or services designated
in the attached proposal at the price in said proposal, in the quantity and quality quoted
in said proposal, and for the term designated in said proposal if said proposal is
accepted by the Weld County Board of Commissioners and the bid is awarded to the
undersigned further understands and agrees that the price quoted for each item of goods
and for services is the total prices to the Weld County government and that all additional
costs, including but not limited to freight, postage, handling, federal, state or local
taxes shall be borne by the undersigned.
The undersigned further agrees to keep this proposal open for a period of 30 days
after the bid opening date Oct. 2n°, 2001. The undersigned bidder further understands
that upon acceptance of the attached proposal by the weld County Board of Commissioners,
the proposal shall become a contract between the bidder and Weld County government and
that said contract shall be enforceable at law; and further that should Weld County need
to enforce such contract by commencing a legal action, Weld County shall be entitled to
reimbursement of its attorney fees.
