RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST VIRGINIA SAND FOR VIOLATION OF THE WELD
COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,Virginia Sand, VI #0000082, is allegedly in violation of the Weld County
Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 10th day of July, 2001, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Virginia Sand, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until September 11, 2001, to allow adequate time for the property
owner to bring the subject property into compliance and for an inspection of the property by the
Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that VI #0000082 be, and hereby is, referred to the Weld County
Attorney's Office for legal action against Virginia Sand to remedy the violation of the Weld
County Code, and any other persons occupying the properties, any persons claiming an
interest in the properties, and any persons acting in active concert with the identified parties,
with an instruction for delay of action upon such referral until September 11, 2001, to allow
adequate time for the property owner to bring the subject property into compliance.

Dear Ms. Sand:
On May 1, 2001, written notification was delivered to you stating your property is in violation of
Sections 23-3-150, 23-3-150.B, and 23-3-150.C of the Weld County Code and notifying you of a
hearing before the Board of County Commissioners on June 12, 2001, at 10:00 a.m. Due to a
scheduling conflict, the Board cannot appear at the date and time specified; however, the violation
still exists. Please consider this letter your official notification that this matter is continued to July
10, 2001, at 10:00 a.m. A hearing on this matter will be held at the time specified above in the
County Commissioners Hearing Room, First Floor, Weld County Centennial Center, 915 10th
Street, Greeley, Colorado. In effect, this allows you another 30 days to remedy the violation before
the matter is heard by the Board of County Commissioners. If you fail to correct this violation by
July 10, 2001, the Department of Planning Services will continue to recommend that the Board of
County Commissioners refer this violation to the County Attorney's office for immediate legal
action.

"Storage of those vehicles,or parts thereof,which are defined in Section 42-12-101 CRS,as amended,and are screened;
and/or the storage of no more than two vehicles which regardless of their condition and/or classification as derelict
vehicles, have been operated at any time during the past one year period in a sanctioned or sponsored race,derby,or
event and are screened."

Dear Ms. Virginia Sand:
The uses on the above described property are being considered as a zoning code violation of Sections of the Weld
County Zoning Ordinance. There is a Noncommercial Junkyard consisting of derelict vehicles, pile of wood,
tires, and other miscellaneous debris on the property, which is a violation of section 32.2.3.6 of the Weld County

for legal action.
