Lincoln Avenue, Suite 460 Loveland, Colorado 80537 Annexation Impact Report -Abrams Farm 2001-0047 ?tbl;c t2ev;eui pet : PL uoA;ea) Pl�� (4 C�/ moo (es') This Annexation Impact Report, prepared by Benchmark Development Group per the request by the Town of Johnstown, is in reference to the proposed Abrams Farm annexation request to the Town of Johnstown. The report has been prepared in accordance to statutory requirements(3I-12-108.5). Legal Description A portion of the SW % Section A2 and SE 'A of Section 2, T.4N., R. 68 W. See "EXHIBIT A", attached hereto for reference. Project Description The proposal is for annexation and zoning to allow for development of a commercial development campus for an assisted care living center, retail and/or office uses. The project will include facilities that meet the current and future needs of its users. The project requires more than developing property. It requires creating an environment that will provide for the specific facility needs and amenities required to support the needs of the businesses and their employees. The project will be highly landscaped with covenant controls for maintaining the quality of the development. This will ensure that the project is a long-term benefit to the community. Benchmark Development Group will provide an inviting and efficient environment for clients with their own high quality standards and skilled labor pool. Existing and Proposed Municipal Boundaries The Town of Johnstown bound the property on three sides. See "EXI11BfT B" attached hereto. Existing and Proposed Streets and Utilities See "EXHIBIT C"attached hereto. Existing and Proposed Land Uses Existing land use for the property is farmland in agricultural use and is zoned "A" — Agricultural in Weld County. The proposed land uses arc commercial, including assisted care living, retail, and/or office uses. The requested zoning designation is Planned Unit Development — Mixed Use (FUD — MU). The approximate land use boundaries are shown on"EXHIBIT D"attached hereto. Pre-Annexation Agreement Has not been drafted at this time. O3 Municipal Services Municipal services will be provided as per the following: Electricity/Gas KN Energy Public Service Company Telephone Qwest ICG Telecommunications Water Town of Johnstown Sanitary Sewer Town ofJohnstown Fire Johnstown Fire Protection District Police Town of Johnstown Street Maintenance Town of Johnstown The water and sanitary sewer major trunk lines that serve the area are existing and run from east to west across the northern portion of the subject property. The balance of the services will be provided as necessary in conjunction with the future development phases. Financing Extension of Municipal Services The existing water and sanitary sewer facilities were constructed with a bond being issued to cover the cost of construction. The development is subject to existing cost sharing agreements for repayment of the debt incurred. The payments will be made over a period of ten years. The balance of the services to be provided by the Town of Johnstown will be financed through collection of increased property sales taxes as the project is developed. Ile cost installation, to Town Specifications, for all on-site utilities and streets will be the responsibility of the developer. The Town of Johnstown will provide maintenance of these improvements, after warranty period and acceptance by the Johnstown Board of Trustees. The cost of these services will be recouped through increased property values and operational costs by tap and use fees for the utilities. We do not contemplate any residential development as a part of this proposal. TOWN OF JOHNSTOWN PUBLIC HEARING NOTICE NOTICE IS HEREBY GIVEN that a petition for Annexation of territories hereinafter described as the Abrams Farm Annexation have been presented to the Town Board of Johnstown, Colorado and found to be in apparent compliance with the applicable provisions of law and the Town Board has adopted a Resolution to set a public hearing to be held at 7:00 p.m. on Wednesday, January 17, 2001 in the Town Hall at 101 Charlotte Street in Johnstown, Colorado to determine if the proposed annexation complies with the applicable requirements of law. The Resolution adopted by the Town Board for such purposes is in words, letters and figures as follows: TOWN OF JOHNSTOWN RESOLUTION NO. 2000-46 FINDING SUBSTANTIAL COMPLIANCE FOR INITIATING ANNEXATION PROCEEDINGS FOR THE ABRAMS FARM ANNEXATION WHEREAS, a written petition, together with five (5) prints of an annexation map, was heretofore filed with the Town Clerk requesting this annexation of certain property to be known as the ABRAMS FARM ANNEXATION, more particularly described as situate in the County of Weld, State of Colorado, to wit: See attached Exhibit A WHEREAS, the Town Board desires to initiate annexation proceedings in accordance with the law. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF JOHNSTOWN, COLORADO: Section 1. That the Town Board hereby accepts said annexation petition, finds and determines that the annexation petition and accompanying map are in substantial compliance with CRS 31-12-107, and desire to initiate annexation proceedings in accordance with law. Section 2. The Town Board shall hold a hearing to determine if the proposed annexation complies with CRS 31-12-104 and 31-12-105, or such parts thereof as may be required to establish eligibility for annexation under the terms of Part 1, Article 12, Title 31, CRS. A hearing shall be held on the 17th day of January, 2001 in the Board meeting room of the Town of Johnstown, 101 Charlotte Street, Johnstown, Colorado, at 7:00 p.m. Section 3. The Town Clerk shall publish notice of such hearing once per week for four (4) successive weeks in the Johnstown Breeze, with the first publication at least thirty (30) days prior to the date of the hearing. The Town Clerk shall also send a copy of this resolution and the petition for annexation to the Clerk to the Board of County Commissioners, the County Attorney and to any special district or school district within the area proposed for annexation.
