RESOLUTION RE: APPROVE COORDINATION AGREEMENT AND MEMORANDUM OF UNDERSTANDING AND AUTHORIZE CHAIR TO SIGN -WELD FOOD BANK WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Coordination Agreement or Memorandum of Understanding between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Social Services, and the Weld Food Bank, commencing upon full execution of said agreement, and ending January 31, 2003, with further terms and conditions being as stated in said agreement, and WHEREAS, after review, the Board deems it advisable to approve said agreement, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, ex-officio Board of Social Services, that the Coordination Agreement or Memorandum of Understanding between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Social Services, and the Weld Food Bank be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said agreement. Masden 2001-0054 Pe 15'5 SS0027 COORDINATION AGREEMENT AND MEMORANDUM OR UNDERSTANDING BETWEEN THE WELD FOOD BANK AND THE WELD COUNTY DEPARTMENT OF SOCIAL SERVICES This Coordination Agreement and Memorandum of Understanding("Coordination Agreement") is by and between the County of Weld, a political subdivision of the State of Colorado, by and through the Board of County Commissioners of the County of Weld, whose address is 915 10ih Street, Greeley, CO 80631, on behalf of the Weld County Department of Social Services, hereinafter referred to as "County' or "Weld County", and the Weld Food Bank, whose address is 104 11th Avenue, Greeley, CO 80631, hereinafter referred to as "Food Bank". Purpose The Food Bank and Weld County have identified a need for outreach services, specifically the Food Stamp Program, to ensure that all residents within Weld County have access to and knowledge of the program. Weld County, having a geographical size of 4000 square miles, has a diverse population in rural and small metropolitan areas. Many services in outlying rural areas are limited often times making it difficult to access available public assistance programs. The County and the Food Bank also recognize the need to coordinate services in order to accommodate working individuals and the elderly and disabled who may also be eligible for supportive service type programs such as the Food Stamps. Access to such programs without having to take time off from work has been determined by Weld County and the Food Bank to be critical to individuals obtaining and maintaining employment. The parties understand that this Coordination Agreement is a non-financial agreement. Responsibilities of the Parties Weld County agrees to: • Provide technical support and training to the Food Bank as necessary in the Food Stamp application process and program eligibility. • Assist the Food Bank in the collection of data needed for project evaluation by tracking the number of food stamp applications processed through the Food Bank that are approved or denied. • Provide communication tools to the Food Bank such as access to the County's local area network, e- mail capabilities, and Internet access, to assist the Food Bank in identifying and educating potential food stamp recipients and in assuring that public assistance recipients have access to Food Bank programs and services. • Identify specific Social Services contact staff who are familiar with the goals and objectives of this agreement to assist with application or program specific questions on a need/demand basis. • Enhance existing cooperative working relationships and agreements between the Food Bank and the Weld County Department of Social Services to assure that quality services and opportunities are provided to public assistance recipients. Already existing is the"Shared Employment Project" between the Food Bank and the Weld County Department of Social Services to offer employment skills/training to TANF recipients who have significant barriers to employment. (Agreement is attached as Exhibit A). • Continue to be responsible for payment for emergency food boxes provided by the Weld Food Bank to households in emergency situations referred by the Department of Social Services and as outlined in a cooperative agreement between the two agencies (agreement is attached as Exhibit A). The Food Bank Agrees to: • Provide copies of reports to the Department of Social Services that are required by the project and deliverable to Food and Nutrition Services. • Educate the public, especially working individuals and the elderly and disabled on how to access the food stamp program and assist in the application and appointment process. • Assist applicants in filling out the food stamp application form. • Identify barriers to food stamp program participation and in conjunction with the Department of Social Services develop strategies for overcoming those barriers. • Submit all project deliverables as required by the grant application package to Food and Nutrition Services. Term of the Coordination Agreement The term of this Coordination Agreement shall commence the day the Agreement is fully executed and will end on January 31, 2003. Modifications This Coordination Agreement may be modified in whole or in part upon approval of the signers. Termination This Coordination Agreement may be terminated by any of the signers upon thirty(30) days written notice. Entire Agreement/No Third Party Beneficiary This Coordination Agreement contains the entire agreement and understanding between the parties to this Coordination Agreement and supersedes any other agreements concerning the subject matter of this transaction, whether oral or written. It is the express intention of the parties that any entity other than the undersigned parties receiving services or benefits under this Coordination Agreement shall be deemed an incidental beneficiary only. No Waiver of Immunity No portion of this Coordination Agreement shall be deemed to constitute a waiver of any immunities the parties or their officers or employees may possess, nor shall any portion of this Cooperative Agreement be deemed to have created a duty of care that did not previously exist with respect to any person not a party to this Cooperative Agreement. Severability If any provision of this Coordination Agreement should be held to be invalid, illegal, or unenforceable for any reason, the validity, legality, and enforceability of the remaining provisions shall not in any way be affected or impaired thereby. The major provisions Agreement are as follows: 1. The term of the Agreement begins when Weld Food Bank receives notification of Federal funding and ends January 31, 2003. Weld Food Bank is applying for a two-year grant of approximately $100,000. The purpose of the Federal grant is to help communities outreach to clients who need the services of the Food Stamp Program and services offered by Weld Food Bank. 2. The Agreement is non-financial. 3. Contingent on Federal funding, Weld Food Bank will employ outreach workers whose primary responsibility is to outreach, recruit and support clients who need Food Stamp Program services in coordination with Social Services. 4. Social Services agrees to provide the necessary technical assistance and support for Weld Food Bank's outreach workers to ensure that clients for the Food Stamp Program meet the guidelines of the program.
