HomeMy WebLinkAbout20012858.tiff RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST THOMAS AND MARIA ESPARZA FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Thomas and Maria Esparza, VI #0100213, are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 9th day of October, 2001, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Thomas Esparza, property owner, was present at said hearing, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until January 8, 2002, to allow adequate time for the property owners to bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff. September 24, 2001 Mr. & Mrs. Thomas Esparza came into the office to speak to an "On-Call Planner" to figure out the necessary paperwork. Currently, there is a violation of Chapter 23, Article III (3) , Division 1, Sections 23-3-20, 23-3-20.P, 23-3-30 and 23-3-30 .I and Article IV(4) , Division 3 and Chapter 29, Article VII (7) of Section 29-7-10 of the Weld County Code. To bring the property into compliance the property owner shall remove or completely screen the Noncommercial Junkyard from all adjacent properties and public right- of-way. Additionally, a building permit shall be obtained in order to combine the 2°d mobile home to the existing mobile home. I informed him that he would need to obtain a building permit and that would bring that aspect into compliance. I told him that I would send a building permit application through the mail with a 30 day letter. I told him that as long as I could continue to see progress being made regarding the property, I would be open to granting extensions. I also told him that he needed to make sure that he kept in touch with me to avoid the scheduling of a violation hearing. He said that he would keep in touch. They spoke to the on-call planner(at first). Then Lauren Light (the on-call planner) came and got Wendi and I. Wendi explained to Mr. Esparza that he did not need a ZPMH because they had an existing MHP for a Principal Dwelling Unit. We explained that he would still need a building permit; however, they would not issue a permit until the NCJY was removed or totally screened. He stated that he has a heart condition. I explained that if they would think really hard about how much time they would need "exactly", that we might be able to support it during the violation hearing. I also explained that they needed to say the smallest amount of time without being impossible. I explained what we required for screening. If going with a standard wooden privacy fence, we did not need a screening plan; however, if proposing anything other than a standard wooden privacy fence, we would need to receive a proposal with what they intend to do. I explained that we have people who have tried to use everything from tires to mobile homes, etc... He explained that his intention was to put up a chain link fence and use slats for it. I told him that the fence needs to be totally opaque (can't see through). He said that he built fences for a living and you had to leave room in between so there was room to grow and shrink. Again, I told him that the fence would need to be totally opaque.
