Re: Request for Board Hearing, Ft. Lupton Construction Yard, USR-1324
On behalf of Asphalt Specialties Company, Inc., this letter and the enclosed materials are
being sent to you for the purpose of requesting a hearing before the Weld County Board
of County Commissioners in case number USR-1324.
By resolution of the Weld County Planning Commission on April 17, 2001, this Use by
Special Review is being forwarded to the County Board with a recommendation of
approval. The Planning Commission resolution also directed that the Applicant resolve
water supply issues in the period prior to hearing before the County Board. We have
been working with you on this issue, and our past correspondence details the fact that
what was originally contemplated as a Change in Use for an existing well at the site has
become a drilling permit for a new commercial well.
Enclosed are copies of the materials received by the Office of the State Engineer,
Division of Water Resources, applying for a new commercial well at the Ft. Lupton
Construction Yard site. In accordance with Division of Water Resources rules, following a
notification period regarding Laurance Hause's ownership of the site of a new proposed
well Asphalt Specialties submitted the (enclosed) application for a new well on May 14,
2001. Please note that, at the time of submittal, the Division of Water Resources verified
its receipt of the application and invoiced the permit fee, as established by the last two
pages of the enclosed packet of materials.
Due to the current backlog of permit applications at the Division of Water Resources, we
cannot predict when an approved permit for the new well will issue. It is, however, very
probable that a permit will be in place within the next month, by the end of June, if not
before. In any case, Asphalt Specialties is working diligently to resolve the water supply
issue and believes it will be adequately prepared to address any concerns regarding
USR-1324 from the Weld County Board of County Commissioners.
Banks and Gesso, LLC, as representative for Asphalt Specialties, will promptly forward
any permit or further documentation received from the Division of Water Resources to
both the Clerk to the Board and to yourself.
With the understanding that we will continue to work with you to address all requirements
of the Use by Special Review, Asphalt Specialties Company, Inc. respectfully requests
that its case be scheduled for a hearing before the Weld County Board of County
Commissioners on the next available agenda. Please forward this request to the Clerk to
the Board, as appropriate. We greatly appreciate your assistance in this matter.

RE: New Well Permit Application, Asphalt Specialties Company
Dear Division of Water Resources:
On behalf of our client, Asphalt Specialties Company, we are submitting the following
Permit Application to construct a new well. The proposed well will be located in the
southwest quarter of Section 20, Township 1 North, Range 66 West, in the Sixth
Principal Meridian, Weld County, Colorado, (see Vicinity Map).
The property is currently owned by Laurence Hause with a contract agreement for
Asphalt Specialties to purchase the said property once approvals from regulating
agencies are received. Please refer to the attached deed and agreement for a legal
description and proof of ownership.
The proposed well will be drilled into the Laramie-Fox Hills formation with an estimated
pumping rate of twelve gallons per minute. The well will be used for industrial and
commercial uses, 250 days per year. The analysis below determines the total
allowable water available for a well in the nontributary portion of the Laramie-Fox Hills
aquifer underlying this 80-acre parcel.
Total water available:
Max. available = (80.0 acres) * (158.6 feet sat. thick.) * (15% specific yield)
= 1903 ac*ft/y
Total allowable water available is equal to 1.0 % of the max. available
= 19.0 ac*ft/y
We have previously submitted signed originals of forms GWS-1 and 43, on behalf of
Laurence Hause, pertaining to Nontributary Landownership in the Laramie-Fox Hills
formation.

Laurence G. Hause,to proceed with a Weld County Use by Special Review and other
land use approvals needed for a proposed processing facility and continued residential
and agricultural use of the property located at 2292 Weld County Road 27, Ft. Lupton,
Colorado. This application for Use by Special Review is being made with my knowledge
and consent.
I have entered into this Agreement as current owner of the property. Once approvals
have been obtained, the Asphalt Specialties Company, Inc., will obtain an interest in the
property under consideration through the exercise of a current contract to purchase the
land.
