HomeMy WebLinkAbout20013055 HEARING CERTIFICATION DOCKET NO. 2001-74 RE: CHANGE OF ZONE#562 FROM THE A(AGRICULTURAL) ZONE DISTRICT TO THE 1-3 (INDUSTRIAL) ZONE DISTRICT - MARGARET RUHGE A public hearing was conducted on October 24, 2001, at 10:00 a.m., with the following present: Commissioner M. J. Geile, Chair Commissioner Glenn Vaad, Pro-Tern Commissioner William Jerke Commissioner David Long Commissioner Robert Masden Also present: Acting Clerk to the Board, Esther Gesick County Attorney, Bruce Barker Planning Department representative, Robert Anderson Health Department representative, Pam Smith Public Works representative, Don Carroll Public Works representative, Drew Scheltinga The following business was transacted: I hereby certify that pursuant to a notice dated October 5, 2001, and duly published October 10, 2001, in the Tri-Town Farmer and Miner, a public hearing was conducted to consider the request of Margaret Ruhge for Change of Zone #562 from the A (Agricultural) Zone District to the 1-3(Industrial)Zone District. Bruce Barker, County Attorney, made this a matter of record. Robert Anderson, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Mr. Anderson gave a brief description of the location of the site and surrounding uses. He stated nine referral agencies responded with proposed conditions of approval, and two indicated no conflicts with their interests. Mr. Anderson stated the site is not within an Urban Growth Boundary area or Intergovernmental Agreement area, and he reviewed the reasons of approval as recommended by the Planning Commission. In response to Commissioner Vaad and Chair Geile, Mr. Anderson deferred to the applicant to address the mineral issue on the property,and stated the applicant has not indicated any specific plans for the future use of the property; however, the new zoning will be more compatible with the surrounding area. Bill Warren represented the applicant. He commended the staff for their work on this project and stated he and the applicant have reviewed and agree with the Conditions of Approval and Development Standards. In response to Commissioner Vaad, Mr.Warren stated the Weld County Assessor's records indicate there were no mineral rights recorded with the property. In response to Chair Geile, Mr. Warren stated this application will allow the applicant to develop the site to be more consistent with the surrounding uses. No public testimony was offered concerning this matter. 2001-3055 �� ��/ AlL � � PL1563 HEARING CERTIFICATION - MARGARET RUHGE (COZ#562) PAGE 2 In response to Commissioner Jerke, Mr. Scheltinga stated Weld County Roads 2, 4, and 6 are in the work plan; however, Weld County Road 2.5 is not. He stated in the future Weld County Road 2.5 will be restricted with a median allowing a right turn in/turn out only. He stated they will conduct traffic and drainage studies at the site plan stage when the future use has been determined. Commissioner Vaad moved to approve the request of Margaret Ruhge for Change of Zone #562 from the A (Agricultural) Zone District to the 1-3 (Industrial) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval as entered into the record. The motion was seconded by Commissioner Jerke, and it carried unanimously. There being no further discussion, the hearing was completed at 10:25 a.m. This Certification was approved on the 29th day of October 2001.
