RE: SITE SPECIFIC DEVELOPMENT PLAN AND THIRD AMENDED USE BY SPECIAL
REVIEW PERMIT #655 FOR AN AGRICULTURAL SERVICE ESTABLISHMENT AND
LIVESTOCK CONFINEMENT OPERATION (EGG PRODUCTION FACILITY HOUSING A
MAXIMUM OF 1,620,000 LAYERS) IN THE A (AGRICULTURAL) ZONE DISTRICT -
SPARBOE HORIZON CORPORATION
A public hearing was conducted on June 6, 2001, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated May 18, 2001, and duly published May 23, 2001,
in the Tri-Town Farmer and Miner, a public hearing was conducted to consider the requests of
Sparboe Horizon Corporation for a Site Specific Development Plan and Use by Special Review
Permit#1322 for a Livestock Confinement Operation (pullet replacement farm for 260,100 pullets)
in the A (Agricultural) Zone District, as well as a Site Specific Development Plan and Third
Amended Use by Special Review Permit #655 for an Agricultural Service Establishment and
Livestock Confinement Operation(egg production facility housing a maximum of 1,620,000 layers)
in the A(Agricultural)Zone District. Lee Morrison, Assistant County Attorney, made this a matter
of record and called up both cases. Lauren Light, Department of Planning Services, presented a
brief summary of the proposal for Use by Special Review Permit#1322, and entered the favorable
recommendation of the Planning Commission into the record as written. Ms. Light gave a brief
description of the location of the site, which is 158 acres. She stated once the pullets are old
enough, they will be transferred to the property under consideration for Amended Use by Special
Review Permit#655. She reviewed the proposed improvements to the site,gave a brief description
of the surrounding uses, and stated five referral agencies responded with comments, five
expressed no concerns, and two did not respond. Ms. Light further stated the Platte Valley Airport
submitted a letter, marked Exhibit 18, expressing concern; however, Development Standard #16
should adequately address those concerns. She stated no land will be removed from agricultural
production, the site is not located in an overlay district, and the proposed use will be compatible
with the surrounding uses. Ms. Light requested the Board amend Condition of Approval #1 to
change "30" to "180", and add Condition of Approval #2.G to state, "The applicant shall submit a

written request for the vacation of REC#0004." Don Carroll, Department of Public Works, stated
Weld County Road 16 is designated as a local gravel road, which dead ends just past the facility
entrance, so there are no traffic counts. He stated Condition of Approval #2.A.3 indicates the
access lane shall be a minimum of 20 feet; however, the gate is only 16 feet wide. He requested
the applicant provide verification from the Fire Protection District as to whether or not they will
accept the 16-foot gate.
Julie Chester, Department of Planning Services, gave a brief description of the location of the site
for Third Amended Use by Special Review Permit#655, stated ten referral agencies responded
favorably or proposed conditions,and she reviewed the reasons for approval as recommended by
the Planning Commission. Mr. Carroll stated Weld County Road 47 is paved and maintained by
Weld County,with a traffic count indicating 98 to 328 vehicles during a 24-hour period. He stated
the traffic count beyond the facility entrance drops to approximately 35 vehicles. Mr. Carroll stated
in 1987, the property owner entered into an Improvements Agreement to upgrade and pave Weld
County Road 47, which is currently maintained by the County and in good condition. In response
to Chair Geile, Trevor Jiricek, Department of Public Health and Environment, stated the ponds
allow for evaporation of the waste water used for washing the eggs and interiors of the barns. Mr.
Carroll added the Improvements Agreement was for the sole purpose of constructing the road to
accommodate the facility, so it does not need to be transferred to the new owner. In response to
Commissioner Vaad, Mr. Jiricek stated the Confined Animal Feeding Operations (CAFO) Control
Regulations refer to the seepage from waste water retention structures, and their ability to contain
a 25-year, 24-hour storm event. Responding to Commissioner Masden, Mr. Jiricek stated he has
not received an odor complaint for this facility, so he is not sure if the ponds are treated.
Thomas Haren,AgPro Environmental Services, LLC, represented the applicant for both cases and
in response to Commissioner Vaad, he stated the ponds will not use a bubbling aerator. He
explained the existing pond does have monitoring wells, and samples taken indicate the water in
the ponds is better quality than the well water. Mr. Haren stated the shallow ponds are designed
to help evaporation rates. In response to Chair Geile, Mr. Haren stated they sent a letter to HS
Resources regarding the gas line, and explained the buildings are constructed above ground with
a breeze way, so the gas line can be easily accessed. He further stated the issue is also
addressed by Condition of Approval#2.F for Third Amended Use by Special Review Permit#655.
In response to Chair Geile, Mr. Haren stated he and the applicant have reviewed and agree with
the Conditions of Approval and Development Standards for both cases, as well as the
recommended changes from staff.
No public testimony was offered concerning this matter. Ms. Chester thanked the site manager
for giving staff a tour of the facility and explaining the production process.
Commissioner Masden moved to approve the request of Sparboe Horizon Corporation for a Site
Specific Development Plan and Third Amended Use by Special Review Permit #655 for an
Agricultural Service Establishment and Livestock Confinement Operation (egg production facility
housing a maximum of 1,620,000 layers) in the A (Agricultural) Zone District, based on the
recommendations of the Planning staff and the Planning Commission, with the Conditions of
Approval and Development Standards as entered into the record. The motion was seconded by
Commissioner Vaad,and it carried unanimously. (Clerk's Note:See Hearing Certification#2001-34
