HomeMy WebLinkAbout20010374 RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION #2981 - RAYMOND ALM WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101(10)(d), C.R.S., did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption #2981, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land," and WHEREAS, the request for Recorded Exemption #2981 was submitted by Raymond Alm, 22459 Weld County Road 70, Eaton, Colorado 80615, for property which is located in part on the following described real estate, to-wit: Lot B of Recorded Exemption #1712; being a part of the SW1/4 of Section 11, Township 6 North, Range 65 West of the 6th P.M., Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit"A," said plat to be recorded, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 151 acres and 5 acres. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land." BE IT FURTHER RESOLVED by the Board that Recorded Exemption #2981 by Raymond Alm is, approved conditional upon the following: 1. A Weld County septic permit is required for any proposed home. The septic system shall be installed according to the Weld County Individual Sewage Disposal System (I.S.D.S.) Regulations. 2. Prior to recording the plat: A. Due to the pivot irrigation system on Lot B, the applicant shall submit a proposed building envelope to the Department of Planning Services for review. Upon approval by the Department of Planning Services, the building envelope shall be delineated on the plat. The plat shall be titled: Recorded Exemption No. 0803-11-3 RE-2981. C. Lot B shall use the existing agricultural/oil and gas/ditch road accesses necessary for agricultural operations as no additional accesses shall be granted. D. A 30-foot wide joint easement extending across Lot B from Weld County Road 45, for the benefit of Lots A and B, shall be clearly shown on the plat. The joint access easement shall be dedicated for the use as shown using the language set forth in the Weld County Code, Appendix 24-F.E. The easement shall be graded and drained to provide all-weather access. E. All approved accesses shall be clearly shown on the plat.. F. Weld County Roads 45 and 70 are designated on the Weld County Transportation Plan Map as local gravel roads, which require 60 feet of right-of-way at full build out. There is presently 60 feet of right-of-way. A total of 30 feet from the centerline of Weld County Roads 45 and 70 shall be delineated right-of-way on the plat. These roads are maintained by Weld County. G. The applicant shall provide the Weld County Department of Planning Services with a certificate from the Weld County Treasurer showing no delinquent taxes exist for the original parcel. H. The following notes shall be placed on the plat: 1) All proposed or existing structures will meet the minimum setback and offset requirements for the Zone District in which the property is located. Pursuant to the definition of setback in the Weld County Code, the required setback is measured from the future right-of-way line. No building or structure as defined and limited to those occupancies listed as Groups A, B, E, H, I, M, and R in Table 3-A of the 1997 Uniform Building Code, shall be constructed within a 200-foot radius of any tank battery, or within a 150-foot radius of any wellhead. Any construction within a 200-foot radius of any tank battery, or 150-foot radius of any wellhead, shall require a variance from the terms of Section 23-6- 10, Weld County Code. 2) Any future structures or uses on site must obtain the appropriate zoning and building permits. 3) Prior to the release of building permits, the applicant shall submit a recorded deed describing the Lot upon which the building permit is requested with the building permit applications. The legal description on such deed shall include the Lot designation and Recorded Exemption number. 2001-0374 RE2981 RE #2981 - RAYMOND ALM PAGE 3 4) Prior to the release of building permits, the applicant shall submit evidence to the Department of Planning Services that Lots A and B have an adequate water supply of sufficient quality, quantity and dependability. 5) Should noxious weeds exist on the property, or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Section 15-1-10, Weld County Code. 6) Weld County's Right To Farm statement, as it appears in the Weld County Code, Appendix 22-E, shall be placed on the Plat. 3. The applicant shall submit a mylar plat to the Weld County Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 24-8-70, Weld County Code. The plat shall be submitted within sixty (60) days from the date of approval by the Weld County Board of County Commissioners. It is the opinion of the Department of Planning Services' staff that the applicant has not shown compliance with Section 24-8-40.6.1 through 24-8-40.B.6 of the Weld County Code, as follows: a. Section 24-8-40.8.4 - Consistency with the purpose of efficient and orderly development as expressed in Section 24-1-30 of the Weld County Code. 1) Section 24-1-30.A -Assisting orderly and integrated development. Lot A of this Recorded Exemption will be an island lot configuration. Section 24-7-50.J of the Weld County Code states "A flag lot configuration shall be avoided when possible."The creation of an"island lot"is even less desirable than the flag lot configuration. 2) Section 24-1-30.G-Safeguarding the interests of the public, the homeowner, and the subdivider.This application does not take into account the interests of the future owners who will be required to access their lot across the adjacent owners parcel, along an easement that is sprinkled by the existing pivot irrigation system. 3) Section 24-1-30.H - Securing equitable handling of all subdivision plans by providing uniform procedures and standards. Planning Staff has consistently avoided flag lot configurations where other good alternatives are available. 4) Section 24-1-30.J - Preserving agricultural land and promoting its most productive agrarian use. According to the applicant,the existing pivot sprinkler on Lot B currently irrigates one hundred fifty feet of Lot A. Should Lot A be sold outside of the family, the pivot sprinkler would need to be shortened, taking the associated land out of production. b. Section 24-8-40.8.5 -Compliance with the recorded exemption standards set forth in Section 24-8-80 of the Weld County Code. 2001-0374 1) Section 24-8-80.t..,-An adequate legal access exists for all proposed lots to a public road. All accesses shall be in accordance with Chapter 8,Article ll of the Weld County Code.As proposed Lot A will have an easement access across Lot B. Planning Staff has determined it is not adequate.The applicant has indicated that the existing pivot irrigation system waters the proposed access to Lot A. Further, the configuration of the access road is designed to circle the existing irrigation pond located on Lot B. 2) Section 24-8-80.J-The proposed recorded exemption does not evade the statement of purpose as set forth in Section 24-1-30 of the Weld County Code. The location and access to Lot A cannot be considered orderly and integrated development. The southwest corner of the property is an excellent alternative for the placement of Lot A. c. Section 24-8-40.8.6-Adequate provision for the protection of the health,safety, and welfare of the inhabitants of the neighborhood and the County. Should the Board of County Commissioners approve this request, the Department of Planning Services' staff recommends the following conditions be attached:. 1. The rural areas of Weld County may be open and spacious, but they are intensively used for agriculture. Persons moving into a rural area must recognize and accept there are drawbacks, including conflicts with longstanding agricultural practices and a lower level of services than in town. Along with the drawbacks come the incentives which attract urban dwellers to relocate to rural area: open views, spaciousness, wildlife, lack of city noise and congestion, and the rural atmosphere and way of life. Without neighboring farms, those features which attract urban dwellers to rural Weld County would quickly be gone forever. Agricultural users of the land should not be expected to change their long-established agricultural practices to accommodate the intrusions of urban users into a rural area. Well run agricultural activities will generate off-site impacts,including noise from tractors and equipment;slow-moving farm vehicles on rural roads;dust from animal pens,field work,harvest,and gravel roads;odor from animal confinement, silage, and manure; smoke from ditch burning; flies and mosquitoes; and the use of pesticides and fertilizers in the fields, including the use of aerial spraying. Ditches and reservoirs cannot simply be moved out of the way of residential development without threatening the efficient delivery of irrigation to fields which is essential to farm production. Section 35-3.5-102, C. R. S., provides that an agricultural operation shall not be found to be a public or private nuisance if the agricultural operation alleged to be a nuisance employs methods or practices that are commonly or reasonably associated with agricultural production. Weld County covers a land area of over 4,000 square miles in size(twice the State of Delaware)with more than 3,700 miles of state and county roads outside of municipalities. The sheer magnitude of the area to be served stretches available resources. Law enforcement is based on responses to complaints more than on patrols of the county and the distances which must be traveled may delay all emergency responses, including law enforcement, ambulance, and fire. Fire protection is usually provided by volunteers who must leave their jobs and families to respond to emergencies. County gravel roads, no matter how often they are bladed,will not provide the same kind of surface expected from a paved road. Snow removal priorities mean that roads from subdivisions to arterials may not be cleared for several days after a major snowstorm. Snow removal for roads within subdivisions are of the lowest priority for public works or may be the private responsibility of the homeowners. Services in rural areas, in many cases,will not be equivalent to municipal services. Rural dwellers must, by necessity, be more self-sufficient that urban dwellers. Children are exposed to different hazards in the county than in an urban or suburban setting. Farm equipment and oil field equipment,ponds and irrigation ditches,electrical power for pumps and center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs, and livestock present real threats to children. Controlling children's activities is important, not only for their safety, but also for the protection of the farmer's livelihood. Parents are responsible for their children. The 156 acre parcel is north of and adjacent to Weld County Road 70 and east of and adjacent to Weld County Road 45, 3 miles southeast of the Town of Eaton. My wife and I live on the same farm approximately 'A mile away. We are an integral part of our grandchildren's lives, and help with childcare and assist where we can in 4-H projects and other goals. As we grow older we look forward to our daughter and her husband assisting us with the farming operation, livestock, and keeping the family farm thriving, as well assisting us in remaining in our home on the farm. 7. The conditions and the information on this information sheet must be complied with in order for the permit to remain valid. THE PERMIT EXPIRATION DATE IS TWO YEARS FROM THE DATE ISSUED. The well must be constructed and evidence of it's construction must be received by this office in the form of a Well Construction and Test report from the well construction contractor confirming that the well was constructed prior to expiration of the well permit. The well permit number is located in the upper right hand corner of the permit, and the expiration date is located in the lower right hand corner. The expiration date of the permit may be extended one year at a time at the discretion of the State Engineer for good cause shown. If an extension of time is necessary to construct the well, a written request for the extension of time must be received by this office prior to the expiration date of the well permit. In the request, you must provide the well permit number, your name and mailing address and the reasons why the well has not been constructed and when it will be constructed. No fee is required for this type of permit extension. Water well construction and pump installation contractors are specifically licensed in Colorado to perform these specialized tasks. It is illegal for contractors who do not hold these licenses to construct wells and/or install pumping equipment in or on wells. The well must be constructed and the pump installed by contractors with current license(s) issued by the State of Colorado unless exempted as described on the reverse side. It is your responsibility to complete and submit the Weil Construction and Test Report, Form Number GWS-31 and/or the Pump Installation and Test Report, Form Number GWS-32. These forms are available from our offices. The well must be constructed and the pump installed in accordance with the well construction standards of the State Board of Examiners of Water Well Construction and Pump Installation Contractors. The Water Well Construction Rules are available from Division of Water Resources offices for a fee of $3.00. The Rules cover the minimum requirements for well construction, pump installation, disinfection, plugging and sealing and include contractor licensing regulations. If you are constructing your own well or installing pumping equipment, it is recommended that you obtain a copy of these Rules for reference. RULE 14 WELL TESTING 14.1 General - The provisions of this rule establish minimum standards for the testing of water wells. Every well constructed for the purpose of producing ground water shall be tested to determine: a. a yield test for the well; and b. the production rate of the equipment installed when the well is placed into service. 14.2 Well Yield Test - The yield of a well shall be determined as a stabilized production rate where the withdrawal rate and the drawdown do not change by more than 10 % during the last hour of the test. The test shall demonstrate that either: a. the well is capable of producing the permitted pumping rate for the well; or b. that the maximum yield of the well is less than the permitted production rate. 14.3 Responsibility for Weil Yield Test - Well construction contractors are responsible for performing the well yield test and submitting the test data to the State Engineer. If the construction contractor also installs the production equipment, the well yield test may be combined with the production equipment test, provided that the test meets the requirements of Ruie 14.2. The construction contractor may forgo the well yield test if he can show that a licensed pump installer will perform the well yield test with the permanent production equipment within 60 days of his drilling of the well. 14.4 Production Equipment Test - The production equipment installed in wells shall be tested to make sure it is functioning as designed. The test shall demonstrate the production capacity of the equipment as actually installed in the well or that the production from the well complies with the conditions of the permit, whichever is less. 14.5 Responsibility for Production Equipment Test - Pump installation contractors are responsible for testing the production equipment installed in a well upon completion of their work. if the well construction contractor determined the well yield and submitted a report, the pump installer need not perform another well yield test. If the pump installer does not perform a well yield test with the permanent production equipment, he shall per-form a production equipment test and report the data (results) to the State Engineer. Wells to be plugged and sealed must be plugged in accordance with of the Water Well Construction Rules. A Well Abandonment Report, form number GWS-9 must be submitted to confirm plugging and sealing of the well. This form is available from our offices. The general Rule for plugging and sealing wells is printed below. The specific rules are found on the reverse side of the Well Abandonment Report form. RULE 15 STANDARDS FOR PLUGGING AND SEALING WELLS AND WELL EXCAVATIONS 15.1 General - The plugging and sealing of all wells, monitoring and observation wells, monitoring and observation holes, and test holes, which are no longer intended to be used, is necessary to prevent contamination of ground water and the migration of water through the unused borehole. It is the ultimate responsibility of the well owner to have a well properly plugged and sealed. The well construction contractor or authorized individual is responsible for notifying the well owner of these plugging requirements. Persons authorized to install pumping equipment may plug and seal wells which do not require the removal of casing from more than one aquifer or the ripping or perforating of casing opposite confining layers. All materials used for backfilling shall be clean and free from contaminants. The well casing may be cut off below land surface so that it will not interfere with the anticipated use of the land. If the casing is cut off below land surface, a watertight cover shall be permanently attached to the remaining casing and the excavation shall be filled with materials _which are not more permeable than the surrounding soils.
