RE: APPROVE CANCELLATION AND RELEASE OF COLLATERAL FOR REMINGTON
PLACE MINOR SUBDIVISION, S #505 - LESLIE AND JEANNE GELVIN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated February 2, 2000, the Board did approve an
Improvements Agreement According to Policy Regarding Collateral for Improvements (Private
Road Maintenance) with Leslie and Jeanne Gelvin, concerning property described as Lot A of
Recorded Exemption #1723; located in the NE1/4 of Section 7, Township 7 North, Range 67
West of the 6th P.M., Weld County, Colorado, and
WHEREAS, on August 7, 2000, the Board of County Commissioner of Weld County,
Colorado, did accept Letter of Credit#188, in the amount of $500.00, from Leslie and Jeanne
Gelvin to be retained for a one-year period, and
WHEREAS, staff from the Weld County Departments of Planning Services and Public
Works have conducted a visual inspection of the project and recommend cancellation and
release of said collateral, and
WHEREAS, it has been determined by the Board that the collateral being held by Weld
County is no longer necessary to secure said Improvements Agreement According to Policy
Regarding Collateral for Improvements (Private Road Maintenance) for Remington Place Minor
Subdivision, S #505, and
WHEREAS, upon recommendation of staff, the Board deems it advisable to release said
collateral.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Letter of Credit, drawn on the First Pioneer National Bank,
P.O. Box 96, Wray, Colorado 80758, in the amount of$500.00, be, and hereby is, canceled and
released.
BE IT FURTHER RESOLVED by the Board that the Clerk to the Board be, and hereby
is, directed to return said collateral to the appropriate issuing party.

We hereby agree with you that all drafts drawn under and in compliance with the terms of this
credit will be duly honored and presented for payment to our main office, FIRST PIONEER
NATIONAL BANK, P.O. Box 96, Wray, CO 80758. This letter of credit will expire on July
27, 2001, at 5:00 P.M.

This letter of credit is automatically extended without amendment, for additional one year
periods from the current expiration or any future expiration date unless 60 days prior to such
current expiration date FIRST PIONEER NATIONAL BANK notifies beneficiary in writing that
the letter of credit will not be renewed. In the case you receive such a notification, you may draw
by presentation of the following: (a) a draft at sight on FIRST PIONEER NATIONAL BANK;
(b) a statement purportedly signed by an official of the Board of County Commissioners of Weld
County, Colorado stating that we have received notice from FIRST PIONEER NATIONAL
BANK that Letter of Credit No. 188 will not be renewed and that Leslie R. and Jeanne Gelvin
have failed to provide proof of adequate collateral and substitution of this Letter of Credit No.
188; (c) copy of letter from FIRST PIONEER NATIONAL BANK stating non-renewal of
Letter of Credit No. 188 and the original letter of credit.

SUBJECT: S-505, Remington Place
The Department of Planning Services received a letter from Les and Jeanne Gelvin dated
September 26, 2001 requesting the release of remaining collateral for improvements to the
Remington Place minor subdivision.
Don Carroll, Weld County Department of Public Works performed a final site investigation for
Remington Place to verify that there is no distress or repairs needed to the asphalt. Given that
there are none, the Department of Public Works recommends the release of the five hundred and
no/100s (500) dollars collateral.
The Department of Planning Services concurs with this request.

Request for release of collateral
The applicant has provided a letter requesting release of collateral.
The Weld County Public works Department recommends release of collateral for street grading, street base,
bridge, street name/stop signs, and road culvert.
In the Improvements Agreement, Item Nos. 8.1.5 and 8.1.6, it states that 15% shall be retained for a period of one
year. At the end of one year if no distress or repairs are needed to the asphalt, the 15% collateral ($500) shall
be released.
All other non-transportation items shall be verified by Planning Services prior to release.
