We are currently in the process of drafting agreements with both of the ditch companies through their legal staff. Due to the amount of time it takes to draft agreements we would request a condition prior to recording the change of zone plat that requires the agreements to be completed. Both ditch companies have been aware of the proposed development since the sketch plan phase and have verbally -- committed to the proposed design. Regarding your concerns over pasturing horses, animal units will not exceed one per acre, which is a use-by-right in the Estate zone district. Although the subdivision is a PUD we will adhere to the Estate zone district requirements regarding animal units. The common open space uses as well as maintenance responsibilities, which includes weed control, will be called out in the covenants as stipulated under Component Five of the Site Specific Development Guide. The two outlots will be owned and maintained by the developer. Kim asked me to address these questions with you since it seems to be a gray area. We have a parcel of land which is approximately 121 acres, which was recently split into two parcels, Lot A — 23 acres and Lot B — 98 acres. Lot A is part of a new application for a 9 lot PUD. Both parcels are still under one ownership. See enclosed map for reference to the next questions. We have recently deepened a ponding area (Coyote Pond, with permission of the Army Corps.) on the Northern part of Lot B. Material from this excavation was used to fill a couple of low areas on Lot B and the gravel from the bottom was put in a stock pile on Lot B to use for future roads, fill, etc. Can we use this material to build roads for the subdivision on Lot A? We have recently signed an agreement with Cat Construction to sell them the minerals from a future reservoir for their use on 1-25 under a 111 permit. Weld County Public Works is planning to tear up County Road 3 1/a and during that construction, access to 3 Ya may be hampered. If we need to build a secondary road on Lot A and Lot B to bypass said construction, can we use gravel from that stock pile listed above to build said road? In performing soil analysis for the excavation of the future reservoir on Lot B, it was noted that the material underlying the topsoil met the specifications for use on 1-25. This material is approximately 6' to 8' deep. Then there is a layer of clay approximately 4' thick and then the vein of gravel with shale at the bottom. Cat Construction has some material off of the 1-25 job that cannot be reused on that highway. They are planning to give that material to us to build a berm along Hwy. 52 to block out sound. If they do not have enough material from 1-25, can we use some of the clay from this reservoir for the berm on Lot A? With reference to the pile of gravel from the ponding area on Lot B. This gravel has a substantial amount of larger rock in it. Since we are planning to use all of this material on site on either Lot A or Lot B, and this gravel did not come from either the 110 or 111 permit area, can we screen the larger rock out of the rest of the gravel to use for landscaping and the smaller gravel for roads? With reference to the topsoil pile covered under our own 110 permit. With the current drought situation we decided to build a reservoir. We wanted to make sure the topsoil did not go to waste so we removed it this past winter in anticipation of finding a gravel company to excavate the lake for us. Our original plan was to use all of this material on site. We had a visit from the division of minerals, they said if we ever needed to use any of that material on another location, or if anybody else ever wanted to use some of that material, we would have to have a mining permit. For that reason, we applied for a 110 permit since the amount of material we anticipate removing each year will be small. The Engineer hired to apply for this permit has said, if we decide to sell some of this material we are allowed to remove a maximum of 5,000 yards per year under the 110 permit (it is a 6 year permit) or we will need to apply for a 112 permit and a Use by special review application. The concerns of the Colorado Geological Survey will be addressed at the time of building permit application when a lot specific geotechnical engineering investigation as well as an ISDS investigation will be completed for each lot. Mineral owners and lessors have been notified via certified mail. (see attached) Although the sketch plan was recommended for denial the developer is electing to proceed with the change of zone. It appears from staff comments that the main reason for denial of the sketch plan was the creation of a recorded exemption lot which, when considered as part of this development, would create 10 lots. However, the recorded exemption lot is not part of this subdivision and is a separate legal, buildable parcel. The Weld County Code does not restrict the future development of a recorded exemption parcel nor does it require the inclusion of adjacent recorded exemption parcels into a proposed subdivision. Therefore this proposal does meet the definition of non-urban development and the sketch plan should not have been recommended for denial as this proposal is not urban development. Noise and Vibration— Filly Ridge is a residential development and as such there will be no adverse impacts from noise or vibration. 2. Smoke, dust and odors—As this is a residential development there will not be any impact to the environment from smoke, dust or odors. 3. Heat, light and glare— Lighting will be typical for a residential development. There will not be an adverse impact from heat, light or glare. 4. Visual/aesthetic impacts— Lots and houses will be oriented to take advantage of the views to the west. 5. Electrical interference—There will not be any equipment which will cause undue electrical interference. 6. Water pollution—There will be no activities which will cause water pollution. 7. Wastewater disposal —Individual septic systems will be utilized for wastewater disposal. 8. Wetland removal—There are no jurisdictional wetlands located onsite. 9. Erosion and sedimentation—Construction activities will be conducted in a manner as to reduce potential erosion concerns. 10. Excavation, filling and grading—Construction of foundations and roads will be closely monitored and all regulations will be adhered to. 1 I. Drilling, ditching and dredging—Will not occur onsite. 12. Air pollution— Is not an issue in a residential development. 13. Solid waste—Individual homeowners will be responsible to remove household trash. 14. Wildlife removal —There are no existing colonies of wildlife that will be disturbed. 15. Natural vegetation removal —Homeowners will be encouraged to leave as much natural vegetation as possible on their lots. 16. Radiation/radioactive material —None. 17. Drinking water source—Left Hand Water District. 18. Traffic impacts—As the development is for only nine lots, impacts to traffic will be minimal. COMPONENT TWO— SERVICE PROVISION IMPACTS 1. Schools—There will be an impact of 6 additional students. The school district has indicated that cash-in-lieu will need to be paid. The District has approved the location of the school bus stop. 2. Law enforcement—The sheriff's office recommendations have been taken into account and will be adhered to when applicable. 3. Fire protection—Mountain View Fire Protection District will provide service and this development will adhere to their rules and regulations when applicable. 4. Ambulance—Emergency service will be available through the fire district and Weld County. 5. Transportation—The interior roadway will be constructed to county standards and will be collateralized in an improvements agreement as necessary. 6. Traffic impact analysis—Not required by Weld County Department of Public Works. 7. Storm drainage—A final drainage report will be submitted with the final plat application and will adhere to Weld County regulations. 8. Utility provisions—All utility providers have been contacted and utilities are available to the site. Documentation is provided in the sketch plan application. 9. Water provisions—Left Hand Water District will provide water to the site. 10. Sewage disposal system—Individual sewage disposal systems will be designed and constructed to Weld County standards. 11. Structural Road Improvements Plan—Roads will be constructed to Weld County specifications. COMPONENT THREE -LANDSCAPING ELEMENTS 1. A landscape plan has been submitted as a separate document. The homeowners association will be responsible for maintenance of landscaping. The improvements agreement will identify landscaping as needed. Irrigation water will be provided with ditch water rights that are owned by the developer. COMPONENT FOUR— SITE DESIGN 1. There are two irrigation ditches which border the property. Locations are noted on the change of zone plat. Both ditch companies have been contacted and are aware of the development. 2. Section 22-2-60.C (A.Goal.3) "Provide mechanisms for the division of land which is agriculturally zoned. Options for division shall be provided to ensure the continuation of agricultural production and accommodate low intensity development." A nine-lot subdivision is a low intensity development. The Right- to-Farm note will be included on the change of zone as well as final plat documentation in order to notify potential purchasers that agricultural uses can occur on adjacent properties. The plat notes will ensure the continuation of agricultural production on adjacent properties. Section 22-2-60.D (A.Goal.4) "Conversion of agricultural land to nonurban residential use will be accommodated when the subject site is in an area that can support such development." The proposed PUD is for a nine-lot subdivision that is defined as nonurban in the Weld County Code. Services are currently available or reasonably obtainable for this site. Section 22-2-60.C (A.Policy.3.1) "Options for the division of agriculturally zoned land are available in Chapters 24 and 27 of this Code" Chapter 27 allows for a PUD process to divide agriculturally zoned properties. 3. As this is a residential development, there will not be any conflicting uses. 4. The Right-to-Farm statement will be provided on plats to insure compatibility with adjacent farm ground. The development is located in an area which is conducive to residential uses. 5. The development is located in the geological hazard overlay district. However, the area is designated as "low potential" so a geological hazard permit is not required. Individual site assessments will be conducted at the time of building permit application. COMPONENT FIVE-COMMON OPEN SPACE USAGE Common open space of 3.68 (15% +) acres will be provided. The open space will be owned and maintained by the Homeowners Association. The covenants for Filly Ridge will address all aspects of the open space such as maintenance, taxes and use restrictions. Homeowners will be required to join the homeowners association and the covenants will be established prior to the sale of lots. COMPONENT SIX- SIGNAGE Individual signs will adhere to the requirements of the Estate Zone District. A subdivision sign will be constructed and located near the entrance but not in an area which restricts visibility to either incoming or outgoing traffic. The location will be noted on the plat. COMPONENT SEVEN —MUD IMPACT This component is not applicable as the subdivision is not located in the MUD. COMPONENT EIGHT- INTERGOVERNMENTAL AGREEMENT IMPACTS This component is not applicable as the subdivision is not located in any IGA area. FILLY RIDGE ADDENDUM Outlots 1 and 2 will be agricultural outlots. The outlots will be owned and maintained by the homeowners association but will not be considered open space. The ownership will be transferred by deed to the HOA and maintenance will be addressed in the covenants. Outlot 2 will be utilized for crop production, such as alfalfa and native grasses. Irrigation water will be provided by the developers share of ditch water. An agreement with the ditch company for the purchase of ditch shares is included.
