HomeMy WebLinkAbout20030219.tiff RESOLUTION RE: GRANT MOBILE HOME PERMIT, ZPMH #2336 - DONALD WROBLEWSKI WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, on the 20th day of January, 2003, considered the request of Donald Wroblewski, 19457 Weld County Road 8, Hudson, Colorado 80642, for a mobile home to be used as a temporary use during a medical hardship, and WHEREAS, said mobile home is to be occupied in an A (Agricultural) Zone District on a parcel of land being more particularly described as follows: Lots 13 and 14, Vantage Acres; located in Section 17, Township 1 North, Range 65 West of the 6th P.M., Weld County, Colorado WHEREAS, the Board of County Commissioners, having heard all of the testimony, finds that said request should be granted subject to the following conditions: 1. The applicant shall apply for a building permit for the mobile home prior to locating the mobile home on the property. 2. Prior to the occupancy of the mobile home, the mobile home shall be connected to an approved septic system and a legal water supply. 3. The mobile home shall not be occupied until such time that the applicant has complied with Conditions #1 and #2 stated above. 4. All zoning permits for mobile homes during a medical hardship are temporary. Such permits shall be subject to review annually on the anniversary of the original permit's issuance. Such permits shall be extended only if the use continues to be in conformance with the criteria set out in Section 23-4-180. Any permit for a medical hardship use shall automatically expire, and the mobile home shall be removed upon cessation of the medical hardship or at any such time as the mobile home is used for other than the permitted use. 5. The applicant shall submit documentation to the Department of Planning Services by February 1st of each year describing the status of the medical hardship. This permit is temporary and shall terminate once the medical hardship ceases to exist, at which time the applicant shall have thirty (30) days to remove the mobile home from the property. 6. The property is in violation of Chapter 23 of the Weld County Code (Violation #000330). The applicant shall schedule a final inspection with the Weld County Zoning Compliance Officer and submit a copy of the closure letter indicating compliance with Chapter 23 of the Weld County Code. 8. All proposed or existing structures will meet the minimum setback and offset requirements for the Zone District in which the property is located. Pursuant to the definition of setback in the Weld County Code, the required setback is measured from the future right-of-way line. 9. All derelict vehicles located on the property must be operational with current license plates, be screened from all adjacent properties and public rights-of-way, or be removed from the property. All other items considered to be part of a noncommercial junkyard must also be removed from the property or screened from adjacent properties and public rights-of-way. 10. Any future structures or uses on site must obtain the appropriate zoning and building permits. 11. A Weld County septic permit is required for any proposed home. The septic system shall be installed according to the Weld County Individual Sewage Disposal System (I.S.D.S.) Regulations. 12. Weld County Road 8 is designated on the Weld County Transportation Plan Map as a collector status road, which requires 80 feet of right-of-way at full build out. There is presently 60 feet of right-of-way. This road is maintained by Weld County for one-half only, west of WCR 27. 13. Should noxious weeds exist on the property, or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds pursuant to Section 15-1-10 of the Weld County Code. 14. The applicant shall maintain compliance with Section 23-4-180 of the Weld County Code at all times. It is the opinion of the Department of Planning Services' staff that the applicant has not shown compliance with Section 23-1-90 of the Weld County Code, as follows: A camper trailer does not meet the definition of a mobile home and is considered to be a recreational vehicle, which is not a use allowed for a medical hardship. 2003-0219 Should the Board of County Commissioners approve this request, the Department of Planning Services' staff recommends the following conditions apply: 1. The existing septic system is currently used for a 3 bedroom home and you are proposing to add a 1 bedroom mobile home for the medical hardship. The septic system is permitted under permit number SE-0200072 for the home. The septic system is adequate for a residence occupancy of 5 people, even though there will be a total of 4 bedrooms connected to the system. You state in your letter dated August 7, 2002 that there will never be more than 3 people occupying both homes at any given. A medical hardship for this situation would be allowable based on the permit information. I realize that this evaluation may sound confusing, but in medical hardship situations leniency is granted because it is a temporary situation. Our comments and requirements are as follows: COMMENTS: WCR 8 is designated on the Transportation Plan Map as a collector status road, which requires an 80-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County for one-half only west of WCR 27. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the required setback is measured from the future right-of-way line. REQUIREMENTS: The Weld County Public Works Department recommends approval of this application. The applicant shall utilize the existing residential access to this parcel, and no additional accesses shall be granted to WCR 8.
