RESOLUTION
RE: APPROVE VACATION OF USE BY SPECIAL REVIEW PERMIT#746 - SEKICH
FARMS
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated August 13, 1986, the Board approved Use by Special
Review Permit#746 for an Agricultural Service Facility for Sugar Beet Storage for Sekich
Farms on the following described real estate, to-wit:
Part of the S1/2 of Section 19, Township 3 North,
Range 67 West of the 6th P.M., Weld County,
Colorado
WHEREAS, the Board has received a request from Nick Sekich, current property owner,
to vacate said Use by Special Review Permit#746 in accordance with Condition of
Approval #3.H of Recorded Exemption #3328 for Donna, Nick and Karen Sekich, conditionally
approved by the Board on December 9, 2002, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendations of
the Department of Planning Services staff and all of the exhibits and evidence presented in this
matter and, having been fully informed, deems it advisable to approve said vacation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that Use by Special Review Permit#746 be, and hereby is, vacated.

SUBJECT: Vacation of USR-746
The Department of Planning Services has received the attached letter dated January 6, 2003
from Mr. Nick Sekich. Mr. Sekich is requesting that USR-746 be vacated since the use is no
longer being performed on the property.
Background information:
Legal Description: Pt. S2 Section 19, T3N, R67W of the 6th P.M., Weld County, CO.
Location: North of and adjacent to State Highway 66;1/2 mile east of Weld County
Road 13.
USR-746: USR-746 was for sugar beet storage.
Mr. Sekich recently applied for Recorded Exemption 3328. Because the Use by Special Review
Permit is no longer active, the Department of Planning Services required the vacation of USR-
3328 as a condition of approval. This request for vacation of USR-746 is to satisfy the
Department of Planning Services' condition.

The Weld County Board of County Commissioners approved the above Recorded
Exemption on December 9, 2002. As a Condition of Approval (H), I am submitted a
letter requesting the vacation of Use by Special Review Permit#746 for sugar beet
storage.
