COUNTY CHAMBERS TRACTS SUBDIVISION WATER AND SEWER LOCAL
IMPROVEMENT DISTRICT NO. 2003-1
A public hearing was conducted on February 19, 2003, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that a notice dated January 10, 2003,was duly published January 15, 2003, in the
Tri-Town Farmer and Miner; that said notice was corrected as to date and time and was duly
posted on the main door of the First Floor Hearing Room of the Weld County Centennial Center,
located at 915 10th Street,Greeley,Colorado,on February 14,2003;and that said corrected notice
was mailed to all property owners within the boundaries of the proposed district on February 6,
2003. Pursuant to said notice, a public hearing was conducted to consider the creation of a local
improvement district in Weld County, Colorado, to be known as Weld County Chambers Tracts
Subdivision Water and Sewer Local Improvement District No. 2003-1, for the purpose of
constructing and installing water and sewer lines and sewer lift station connected to the main water
and sewer systems of the City of Brighton, Colorado,together with any necessary incidentals. Lee
Morrison, Assistant County Attorney, made this a matter of record, and advised the Chair that the
assessment hearing should also be called up, since any testimony given would pertain to both
hearings. With no objections from Board members, the Chair also called up the hearing for
ascertainment of costs of improvements for Weld County Chambers Tracts Subdivision Water and
Sewer Local Improvement District No. 2003-1; statement of cost;and portion to be assessed upon
each lot for which a notice dated January 24, 2003, was duly published January 29, 2003, in the
Tri-Town Farmer and Miner.
Mr. Morrison explained the corrected notice and stated the creation portion of the hearing is to
establish the assessment entity and to provide for the work to be performed. Then the assessment
process ordinarily follows work; however, because we have a cap on the amount to be assessed
to individual property owners, as well as the status of the properties will be changing upon
anticipated annexation to Brighton, the assessment process was expedited.

Donald Warden, Director of Finance and Administration, stated the County has been working with
the State of Colorado to receive Energy Impact Assistance funding, with $100,000 being loaned
to finance this district. He stated Community Development Block Grant funding was received to
complete the water and sewer line improvements, as well as to pay the tap fees associated with
this. He stated the portion of the project that is part of the improvement district includes 100 feet
of 8-inch water line, $20,000; 8-inch sewer line, $20,000; four manholes, $5,600; gravel to fill
around the piping, etc., $8,000; engineering and permits, $4,000, and mobilization, $1,5000. In
addition, he stated, there is another 610 linear feet of 8-inch water line, $12,200; two fire hydrants
installed, $5,400; and various valves and valve boxes, $400; and tees and bends, $2,100; 300
additional feet for the sewer, $6,000; and one additional manhole, $1,400. Mr. Warden stated the
other costs,due to the topography of the subdivision, required a dual-lift station which was installed
for$22,000; with additional costs of$2,500 for gravel and mobilization; and other costs of$6,340,
for a grand total of $118,840. Mr. Warden stated $100,000 would be assessed to the property
owners, and the excess costs of$18,840 would be paid by the Energy Impact Assistance Grant.
There are 18 property owners to be assessed $5,555.55 each, at a five-percent interest rate over
a 20-year period, collected annually with property taxes, and there will be a lien against the
properties.
Responding to Commissioner Geile, Mr. Warden stated the difference in costs shown in the bid is
that the $118,840 in the Local Improvement District does not include connecting the homes to
water and sewer lines or the demolition of the septic tanks. He stated it will cost $25,500 to
connect the water main to the homes and the meter pit that goes with it, $20,400 to connect the
sewer from the main to the homes,and$13,600 to fill in the septic tanks. Those costs become the
responsibility of the property owners, although most of them will be paid for through a Community
Development Block Grant.
No public testimony was offered concerning this matter.
Mr. Morrison stated the statute provides the opportunity for someone to object to the fairness of
the assessment either in writing or orally at this hearing; however, the record shows no objection
on that basis was received. He also stated staff has prepared draft resolutions for both the creation
and assessment portions for approval by the Board.
There being no further discussion, Commissioner Vaad moved to approve the draft resolution to
create a local improvement district in Weld County, Colorado, to be known as Weld County
Chambers Tracts Subdivision Water and Sewer Local Improvement District No. 2003-1, for the
purpose of constructing and installing water and sewer lines and sewer lift station connected to the
main water and sewer systems of the City of Brighton, Colorado, together with any necessary
incidentals. Seconded by Commissioner Masden, the motion carried unanimously.
Commissioner Masden moved to approve the draft resolution for ascertainment of the cost of
improvements,as presented by Mr.Warden,for Weld County Chambers Tracts Subdivision Water
and Sewer Local Improvement District No. 2003-1; and the assessment of $5,555,55 to be
assessed upon each of the 18 lots, at five-percent interest,for a term of 20 years. The motion was
seconded by Commissioner Vaad, and carried unanimously. There being no further discussion,
the hearing was completed at 10:15 a.m.
