To: Board of County Commissioners COLORADO From: Monica Daniels-Mika, Planning Director Subject: Staff Recommendation Date: October 14, 1003 Chronology for Appeal: On April 23, 2003, the Board of County Commissioners approved a paint ball facility for Mr. Anthony Navarro. The proposed traffic generated from the facility is 61.56 trip ends. On July 28, 2003, Mr. Navarro applied for a building permit, BCN-030333, for the construction of a 45,240 square foot paint ball recreational facility. On August 5, 2003, Wendi Inloes, Planning Technician, assessed the transportation impact fee of $21,168.00. This fee was based upon compliance with Table 20.1 of the Weld County Code and information provided by the applicant on the use of the building. On August 18, 2003, Mr. Navarro submitted a transportation impact fee appeal to the Department of Planning Services with a corresponding $500.00 fee. On September 10, 2003, Mr. Navarro's consultant, Diane Houghtaling, submitted additional information suggesting a revised fee calculation of$4,665.67. On September 24, 2003, Peter Schei, Weld County Department of Public Works, determined that the proposed transportation study was complete and provided an alternative fee calculation for the proposed fee of$11,415.54. On October 7, 2003, Wendi Inloes sent letter asking for direction from applicant, reiterating the $11,415.54 fee, asking if appealing. ACTION: The Department of Planning Services is forwarding this case to the Board of County Commissioners for your review and determination as found in Section 20-1-340 of the County Code. In subsection B of this Section, the Board of County Commissioners, after hearing, shall have the power to affirm or reverse the decision of the Director. In making its decision, the Board of County Commissioner shall make written findings of fact and conclusions of law, and apply the standards in Section 20-1-330 above. If the Board of county Commissioner reverses the decision of the Director, it shall instruct the Director to recalculate the fee in accordance with its findings. p 2003-2906 57/1 SERVICE,TEAMWORK,INTEGRITY,QUALITY 1 r I` RECOMMENDATION: The Department of Planning Services has determined that the applicant has failed to satisfy the requirement of Section 20-1-330 of the Weld County Code for the following reasons: 1. The applicant has failed to rely upon general principles of impact analysis, and 2. The data, information and assumptions used by the applicant to calculate the Independent Fee Calculations study are not consistent with the impacts proposed by the use, More specifically, Weld County Public Works has determined the variables have been misinterpreted in the formula for calculating road impact fees. The applicant relied upon modified criteria for number of employees which are not consistent with application materials. The Department of Planning Servicing is recommending that the Board of County Commissioners direct staff to accept the methodology and findings developed by Weld County Department of Public Works Department and the County's retained transportation expert, Chris Fasching, P.E., with Felsburg, Holt and Ullevig for this Independent Fee Calculation study. An Independent Fee Calculation Study. A Site Traffic Impact Study will not serve as a Independent Fee Calculation Study. The Inc=.pendent Fee Calculation study shall consist of: an estimate of the number of trips generated by the development,an estimate of the routes employees and customers will take to the site, a description of any mitigation provided as part of the design process, and an estimate of the fee. 2 Formula When an applicant elects to undertake an independent fee calculation,the following formula shall be used: 1. For example, a gas station will have very few new trips, most customers simply stop by on the way somewhere else. LENGTH Average length of a trip on major road system. Based on where the customers and employees come from. If the employees and customers come from several directions, a weighted average, based on an estimate of how many from each source, will be accepted and NET COSTNMT = COST/VMT - CREDITNMT 2. The fee calculation shall be based on data, information or assumptions contained in this Article or independent sources, provided that one of the following applies. a. The independent source is an accepted standard source of transportation engineering or planning data. b. The independent source is a local study on trip characteristics carried out by a qualified traffic planner or engineer pursuant to an accepted methodology of transportation planning or engineering. c. The percent new trips factor used in the Independent Fee Calculation Study is based on actual surveys prepared in Weld County. *The methodology used shall be clearly explained as a part of the fee study. 3 Procedure 1. An Independent Fee Calculation Study shall be undertaken throug ithe submission of an application for an independent fee calculation. A potential fee payer may :submit such an application. When the Director determines that the application is complete,the application shall be reviewed by the Director with the assistance of the Weld County Departmen of Public Works staff, and the Director shall render a written decision in forty-five(45)days on wf a;ther the'ee should be modified and, if so, what the amount should be, based on the standards in Section 20-1-330 below. Standards If, on the basis of generally recognized principles of impact analys s, it is determined that the data, information and assumptions used by the applicant to calculate the ndependerit Fee Calculation Study satisfy the requirements of this Section,the fee determined in the Independent Fee Calculation Study shall be deemed the fee due and owing for the proposed traffic-generating developme nt. The adjustment shall be set forth in a Fee Agreement. Appeal of Independent Fee Calculation Study Decision. 1. A fee payer affected by the administrative decision of the Director or an Independent Fee Calculation Study may appeal such decision to the Board of County Commissioners, by filing with the Director within ten (10) days of the date of the written decision a written notice stating and specifying briefly the grounds of the appeal. 2. The Board of County Commissioners, after hearing, shall have the power to affirm or reverse the decision of the Director. We would like to proceed with a variance to discuss our unique situation and why the fee of $21,000.00 is excessive and an undo hardship on our small business. That total is half of what we have saved for the down payment to the bank for a loan to even get the project started. The calculations used to come to the $21,000.00 fee assumes that the facility will operate much like a Wal-Mart or Kmart. The numbers predicted that we would be at a certain capacity every day of the week. Traffic to our business will be concentrated on weekends and occasional Fridays. Therefore, our calculations should reflect the road impact fee of$21,000.00 is 66%higher than needed and unreasonable. When I spoke with Monica, I received a verbal agreement stating we could proceed with the building permits while the revised road impact fee was being calculated so that the forward plans of building the project would not be restricted. We also discussed that we are proceeding at our own risk and that any road impact revised fees, once they are agreed upon by stag will have to be paid inunediately upon our notification. I appreciate being allowed to proceed with the building permits while this is being worked out, as well as having the opportunity to have the case heard through the variance process. When we did the USR I think there was some confusion on our part on how to classify an employee. We consider an employee full time if they are able to work the entire weekend and part time if they can cover one of the two days on a weekend. Each employee averages about 20-23 hours per week and about 20-46 hours in a 2-week pay period. I apologize for this error. It is easy for us to get used to our own way of doing things and forget that technically full time employees are classified that way if they make 36-40 hrs per week. I can provide you with the last month's log for employee hours and tax records if we need to verify this information. We are seeking an amendment to more accurately claim 1 full time employee (myself) and 2 part-time employees. Our Road Impact Fee process would benefit from this updated information. We agree with the applicant's suggested ITE land use category of a Golf Course (430). The road impact fee looks at the proposed use of the land identified in the application to the County. In this case there is no relation to an existing facility on another parcel of land. The proposed facility will add trips to the adjacent roadway systems all of which will be new to those roadways. "% new" is "percent of trips that are primary trips, as opposed to pass-by or diverted-link trips". In this case for the paintball-sporting club all the trips (100%) would be primary trips. Therefore, every trip must be used in accounting for the road impact fee (County Code - Chapter 20: Road Impact Fees). The road impact fee assessed Mr. Navarro of Action Pursuit Paintball by the Planning Department was for a commercial / industrial site, the lowest fee in that category($490 per unit of 1,000 sq. ft.). A square footage of 43,200 was used to calculate a fee of$21,168 (43,200 sq. ft. x $490/ 1,000 sq. ft = $21,168). Weld County Ordinance 2002-11, Table 20.1 - Road Impact Fee Schedule. The proposed facility states that it will concentrate business on weekends and occasional Fridays. The request goes on to further state that a $21,000 fee would be 66% "higher than needed". Public Works finds this application INCOMPLETE, and cannot continue or complete a review of the requested study. 1) Public Works will need the applicant(Mr. Navarro)to explain how the 66% figure was obtained. Public Works finds no rationale to this figure. He states that his facility will operate on weekends (Saturday& Sunday) and occasional Fridays. Using 7 -2 = 5 days.... 5/7 = 71.4%.... does not equal 66% Using 7- 3 =4 days.... 4/7 = 57.1%.... does not equal 66% Ok, and 0.66 x 7 =4.62 days per week? a) The applicant shall fully document the re-submitted computations and assessments. Specifically the applicant must detail any assumptions and show all calculations to verify the impact fee proposed. A proposed fee must be submitted for consideration. b) Mr. Navarro's traffic calculations must include weekday traffic, since in the Special Review Questionnaire he states, "Weekday afternoons will see anywhere between 10-25 players on scheduled days only." At a later time, the applicant asks the maximum number of players to be increased from 30 to 80 daily. There is a more than double increase in the number of daily players for which the impact fee shall incorporate. c) Furthermore, tournaments and special events are proposed to accommodate 250 participants/ players of which vehicle traffic shall be computed. These special events, occurring up to eight times per year(almost monthly), will have sizeable impact to the road system with-respect-to this facility's vehicle traffic. A weighted factor should be considered. d) Support staff and observers should be accounted for with-respect-to ant additional vehicular traffic. e) The estimated hours of operation must be given. 2) A letter in the application from Diane Houghtaling regarding traffic states that the facility will not increase in size. The applicant must confirm this, since the future traffic estimate was based upon 2002 data from the existing facility. Mr. Navarro has asked that proposed daily weekend players be increased from 30 to 80. Public Works assumes that the 80-player limit will include weekdays. The Houghtaling traffic estimate must be revised with-respect-to the assumption and incorporated into the formula provided in the Request For Review Of Transportation Road Impact Fee Calculations Study And Setting Of rWENDI Inloes Trans2ortation Road Imp , Fee Action Pursuit Paintball Page 2 According Fees. a) The Houghtaling letter states a highest arriving/departing peak hour volume of 34 vehicles based on 2002 data, and an average of 19 vehicles. The traffic estimates must be updated with the proposed increased number of participants for the new facility. b) Public Works suggests a weighting factor to be included in the number of trips generated, since the ITE Trip Generation Manual is based on a weighted average of the number of trip ends. c) Public Works asks Ms. Houghtaling to explain the traffic equivalence of 40 single-family homes on a Saturday for this facility. d) "The preparation of the Independent Fee Calculation Study shall be the sole responsibility and expenses of the fee payer." Mr. Navarro has not provided the calculations warranted for the study. i) An estimate of the number of trips generated by the development must be submitted. H) An estimate of the routes employees and customers will take to the site must be submitted. Hi) A description of any mitigation provided as part of the design process shall be submitted. iv) An estimate of the fee (in dollars) shall be submitted. v) The"Formula" provided in the study shall be used to calculate the fee. 3) The County retains a consulting expert in the field of transportation engineering to assist the Public Works Department in analyzing complex or non-conventional traffic impacts. The most significant changes in operations will be adding weekday hours and additional festivals, As this type of facility is not included in the 1TE,Trip Generation,an estimate of the future traffic was made using the June 2002 through September 2002 sign-in sheets from the existing facility. As a worst case,each participate was assumed to travel separately. The highest an iving/depatting peak hour volume was 34 vehicles. The average was 19 vehicles. This amount of traffic would be equivalent to the Saturday traffic of 40 single-family homes. The festivals will average 90 participates(with a maximum of 150 participates). Even assuming everyone brings their own car the infrequency of the festivals only increases the average peak hour to 22 vehicles. This volume will require a left turn deceleration lane and h right turn acceleration lane on US 34. A review of the site has shown that there is a continuous kit turn lane along this section of US 34. Unfortunately, there is insufficient distance between US 34 Business and the facility entrance for the required left turn deceleration(822 feet)and right turn acceleration lanes(1182 feet), Frequently in these cases the Colorado Department of Transportation has granted a waiver on the full deceleration/acceleration lengths. There is sufficient storage length available for the festival traffic(200 feet).
