A Site Specific Development Plan and Special Review Permit for a single family dwelling unit
(other than those permitted under Section 23-3-20.A) in the A (Agricultural) Zone District.

There are no active or historical permits on record for this parcel.
1. Building permits shall be obtained prior to the construction or installation of any building or
structure except for buildings that meet the definition of an Ag Exempt building in Section 29-3-
20 B 13 of the Weld County Code.
2. A plan review is required for each building for which a permit is required. Plans shall bear
the wet stamp of a Colorado registered architect or engineer. Two complete sets of plans are
required when applying for each permit.
3. Any manufactured home shall be installed in accordance with the Colorado Division of
Housing Manufactured Home Installation Program, the 2002 National Electrical Code and
Chapter 29 of the Weld County Code. The manufactured home shall be installed according to
the manufacture's installation instructions. Buildings other than manufactured homes shall
conform to the requirements of the codes adopted by Weld County at the time of permit
application. Current adopted codes include the 1997 Uniform Building Code, 1998 International
Mechanical Code, 1997 International Plumbing Code, 2002 National Electrical Code and
Chapter 29 of the Weld County Code.
4. Building height shall be limited to the maximum height allowed per UBC Table 5-B. Wall and
opening protection and limitations shall be in accordance with UBC Table 5-A. Separation of
buildings of mixed occupancy classifications shall be in accordance with UBC Table 3-B and
Chapter 3. Setback and offset distances shall be determined by the Zoning Ordinance.
5. Building height shall be measured in accordance with the 1997 Uniform Building Code to
determine compliance with the Bulk Requirements from Chapter 27 of the Weld County Code.
Building height shall be measured in accordance with Chapter 23 of the Weld County Code in
order to determine compliance with offset and setback requirements. Offset and setback
requirements are measured to the farthest projection from the building.

6. A Flood Hazard Development Permit shall be submitted for buildings constructed within the
100-year flood plain.

Dear Ms. Inloes:
I have reviewed the submitted material pertaining to the Site Specific Development Plan and
Special Review Permit for a single family dwelling at 14502 Weld County Road 3 (Case
Number: USR-1421). The Fire District does not object to the request, but does have the
following comments and requirements regarding the construction of a residence or the installation
of a modular home on the parcel:
• All construction shall be in accordance with the provisions of the Uniform Fire Code, as
ratified by the Weld County Commissioners, and all other codes and ordinances, as enforced
by Weld County.
• Water supply for fire protection may be required for a new residence. In instances when a
request is for the construction of a single-family residence, water supply for fire protection is
not required for a single family residence that is not larger than 3,600 gross square feet and is
placed on at least a 2.5 acre site. If a residence exceeds 3,600 gross square feet, or is placed
on less than 2.5 acres, water supply for fire protection may apply. All other structures may
require water supply for fire protection depending on the use of the new structure.

The Weld County Public Works Department has reviewed this proposal; this project falls primarily under the
purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section
23. Our comments and requirements are as follows:
COMMENTS:
WCR 3 is designated on the Transportation Plan Map as a local gravel road, which requires a 60-foot right-of-
way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County.
Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the
required setback is measured from the future right-of-way line.
Assessors Map: In reviewing the Assessors aerial map, this property is shown as two individual parcels.
Our most current ADT count reflects 173 vehicles taken on 2/17/1999 on WCR 3 between WCR 30 and WCR
32.
REQUIREMENTS:
The applicant shall utilize the existing residential access to the parcel, and no additional accesses shall be
granted.
If, in deed, these are two legal parcels, would a flag pole configuration be appropriate? If so, we would require
a minimum width of 30 feet to access the rear lot for the flag pole configuration. The right-of-way or easement
to both lots shall be graded and drained to prevent drainage problems and provide all-weather access to the
properties.
Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or
become established as a result of the proposed development, the applicant/landowner shall be responsible for
controlling the noxious weeds.

Environmental Health Services has reviewed this proposal for a single family dwelling.
We have no objections to the proposal, however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. All septic systems located on the property shall have appropriate permits from
the Weld County Department of Public Health & Environment. The
Environmental Health Division of the Weld County Department of Public Health &
Environment was unable to locate a septic permit for the residence on the
northeastern part of the property. Any existing septic system(s) which is not
currently permitted through the Weld County Department of Public Health &
Environment will require an I.S.D.S. Evaluation prior to the issuance of the
required septic permit(s). In the event the system(s) is found to be inadequate,
the system(s) must be brought into compliance with current I.S.D.S. regulations.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, blowing debris, and other potential nuisance conditions.
4. Fugitive dust shall be controlled on this site.
5. This facility shall adhere to the maximum permissible noise levels allowed in the
Residential Zone as delineated in 25-12-103 C.R.S., as amended.
6. The facility shall utilize the existing public water supply.
7. Any septic system located on the property must comply with all provisions of the
Weld County Code, pertaining to Individual Sewage Disposal Systems.
