HomeMy WebLinkAbout20031874.tiff RESOLUTION RE: APPROVE AGREEMENT FOR 2003 PAVEMENT TESTING PROGRAM AND AUTHORIZE CHAIR TO SIGN - STANTEC CONSULTING, INC. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with an Agreement for the 2003 Pavement Testing Program between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Public Works, and Stantec Consulting, Inc., with terms and conditions being as stated in said agreement, and WHEREAS, after review, the Board deems it advisable to approve said agreement, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Agreement for the 2003 Pavement Testing Program between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Public Works, and Stantec Consulting, Inc., be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said agreement. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 21st day of July, A.D., 2003. Jerke ey EXCUSED ` fli Glenn Vaad Date of signature: 9:e—P5 2003-1874 EG0047 AGREEMENT THIS AGREEMENT, made this 1 day of July, 2003, by and between THE BOARD OF WELD COUNTY COMMISSIONERS, and Stantec Consulting Inc. doing business as Stantec Consulting Inc. hereinafter called "Contractor". WITNESSETH: That for and in consideration of the payments and agreements hereinafter mentioned: 1. The Contractor will commence and complete the phased construction of 2003 PAVEMENT TESTING PROGRAM As per received proposal dated June 18, 2003 2. The Contractor shall furnish all material, supplies, tools, equipment, labor and other services necessary for the construction and completion of the project as described in the received proposal dated June 18, 2003. Working Hours Unless special arrangements are made with the Engineer, work shall be done only during regular and commonly-accepted or prescribed working hours. No work shall be done at night, holidays, or Sundays unless special permission shall be given by the Engineer. Project Safety The Contractor shall take all reasonable precautions in the performance of the work under this Contract to protect from all hazards to life and property, and shall comply with all health, safety, and fire protection regulations and requirements. Traffic Control and Signing The Contractor shall provide, install, move and maintain the signing required. Signs shall be in compliance with the Manual on Uniform Traffic Control Devices. 3. The Contractor shall complete all phases of the work by October 15, 2003. 4. The Contractor agrees to perform all of the work described in the Contract Documents and comply with the terms of herein for the sum of: Thirty nine thousand. nine hundred and seventy six dollars($39,934.00)for the project 2003 PAVEMENT TESTING PROGRAM 5. Payment Partial payment under the Contract shall be made at the request of the Contractor once each month, based upon partial estimates, to be furnished by the Contractor and approved by the Engineer. 6. This Agreement shall be binding upon all parties hereto and their respective heirs, executors, administrators, successors, and assigns. IN WITNESS WHEREOF, the parties hereto have executed, or caused to be executed by their duly authorized officials, this Agreement, each of which shall be deemed an original on the date first written above. M's TITLE 4447 y By Deputy Clerk to t ,2x3-/fly INSURANCE REQUIREMENTS The Contractor shall secure and maintain such insurance policies as will protect himself, his subcontractors, and COUNTY OF WELD, from claims for bodily injuries, death or property damage, which may arise from operations under this Contract whether such operations be by himself or by any subcontractor or anyone employed by them directly or indirectly. The following insurance policies are required: (a) Statutory Workmen's Compensation (b) Contractor's Public Liability and Property Damage Bodily Injury: Each Person $150,000 Each Accident $600,000 Property Damage: Each Accident $150,000 Aggregate $600,000 (c) Automobile Public Liability and Property Damage Bodily Injury: Each Person $150,000 Each Accident $600,000 Property Damage: Each Accident $600,000 The Certificate of Insurance must show Weld County. Colorado as and Additional Insured. All policies shall be for not less than the amounts set forth above or as stated in the Special Conditions. Other forms of insurance shall also be provided if called for by the Special Conditions. Certificates or copies of policy of such insurance shall be filed with the County and shall be subject to his approval as to adequacy of protection, within the requirements of the specifications. Said Certificates of Insurance shall contain a 30-day written notice of cancellation in favor of the County.
