RE: APPROVE MINOR RESUBDIVISION, RS #1024, FOR VACATION OF A PORTION OF
AN ALLEY LOCATED IN THE UNINCORPORATED TOWN OF CARR - DAVID AND
HEATHER TIPTON
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a request from David and Heather
Tipton, 9368 Stevenson Avenue, Carr, Colorado 80612, for Minor Resubdivision, RS #1024, for
vacation of an alley located between Lots 3 and 4, Block 5, in the unincorporated Town of Carr,
Colorado, being further described as a parcel of land located in Section 27, Township 11 North,
Range 67 West of the 6th P.M., Weld County, Colorado, and
WHEREAS, said applicant was present at said hearing held on January 13, 2003, and
WHEREAS, Section 24-5-20 of the Weld County Code provides standards for review of
said Minor Resubdivision, and the Board of County Commissioners heard all of the testimony
and statements of those present, studied the request of the applicant and the recommendations
of the Weld County Department of Planning Services staff and all of the exhibits and evidence
presented in this matter and, having been fully informed, finds that this request shall be
approved for the following reasons:
1. The submitted materials are in compliance with the application requirements of
Section 24-5-20.E of the Weld County Code.
2. It is the opinion of the Board of County Commissioners that the applicant has
shown compliance with Section 24-5-20 of the Weld County Code including
specifically:
a. Section 24-5-20.A--There is right-of-way shown on an approved plat or
map that has not been used for its intended purpose for the last twenty-
one (21)years or since the recording of the approved plat. The alleyway
has never been utilized at this location.
b. Section 24-5-20.6 -- Seventy percent (70%) of the landowners adjacent
to the proposed right-of-way vacation waive any objection to the vacation
by signing a petition. The applicants own both lots adjacent to the
alleyway.
c. Section 24-5-20.C -- The vacation shall only be permitted when it is
compatible with the surrounding area and uses, is consistent with efficient
and orderly development, is consistent with Chapter 22 of this Code and
does not deprive any parcel of adequate access to a public road or street
right-of-way. The vacation of the alleyway will not adversely affect access
to the surrounding lots and is compatible with the surrounding area.

d. Section 24-5-20.D -- The vacation of any right-of-way may require the
reservation of an easement for public utility or drainage purposes in order
to meet the easement requirements of Section 24-7-60. A Condition of
Approval has been included to ensure adequate easements exist for
utilities.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the application of David and Heather Tipton for a Minor
Resubdivision, RS#1024, for the vacation of an alley located between Lots 3 and 4, Block 5, in
the unincorporated Town of Carr, Colorado, on the hereinabove described parcel of land be,
and hereby is, granted, subject to the following conditions:
1. Prior to Recording Resubdivision Plat:
A. The plat shall be labeled: RS-1024, Resubdivision of the unincorporated
Town of Carr.
B. The plat shall be amended to include:
1) A replacement septic envelope which meets the 100-foot setback
from the existing well. Evidence of Weld County Department of
Public Health and Environment approval shall be submitted to the
Department of Planning Services.
2) A minimum ten (10) foot utility easement on side and rear lot
lines, and a minimum of fifteen (15) feet allocated along front lot
lines. The abutting property lines between Lot 4 and Lot 5 shall
not indicate a utility easement.
C. The applicant shall submit two (2) paper copies of the plat for preliminary
approval to the Weld County Department of Planning Services.
2. Upon completion of Condition of Approval #1, the applicant shall submit a
24-inch by 36-inch Mylar plat, along with all other documentation required as
Conditions of Approval. The Mylar plat shall be recorded in the office of the Weld
County Clerk and Recorder by the Department of Planning Services. The plat
shall be prepared in accordance with the requirements of Sections 24-5-20.E.6
and 24-5-25 of the Weld County Code. The Mylar plat and additional
requirements shall be submitted within thirty (30) days from the date of the Board
of County Commissioners Resolution. The applicant shall be responsible for
paying the recording fee.

THE DEPARTMENT OF PLANNING SERVICES'STAFF RECOMMENDS THAT THIS REQUEST
BE APPROVED FOR THE FOLLOWING REASONS:
1. The submitted materials are in compliance with the application requirements of Section 24-
5-20.E of the Weld County Code.
2. It is the opinion of the Department of Planning Services' Staff that the application has
shown compliance with Section 24-5-20.F of the Weld County Code, as follows:
A. There is right-of-way shown on an approved plat or map that has not been used for
its intended purpose for the last twenty-one (21)years or since the recording of the
approved plat. The alleyway has never been utilized at this location.
B. Seventy percent (70%) of the landowners adjacent to the proposed right-of-way
vacation waive any objection to the vacation by signing a petition. The applicants
own both lots adjacent to the alleyway.
C. The vacation shall only be permitted when it is compatible with the surrounding area
and uses, is consistent with efficient and orderly development, is consistent with

This recommendation is based, in part, upon a review of the application materials submitted by the
applicant, other relevant information regarding the request, and responses from referral agencies.
The Department of Planning Services' Staff recommendation for approval is conditional upon the
following:

A. The plat shall be labeled: RS-1024, Resubdivision of the unincorporated Town of
Carr
B. The plat shall be amended to include:

1. The property proposed for vacation is an unnamed alley, measuring 20.0 feet (EW) by 150.0
feet (NS), in Block 5, Town of Carr. This alley is bordered by:
• Lot 4, Parcel ID#020127015006 (9368 Stevenson Avenue) to the west,
• Lot 3, Parcel ID#020127015005 (9368 Stevenson Avenue) to the east,
• County Road 126 (Stevenson Avenue)to the north, and
• an unnamed alley to the south.
There is one existing utility pole and 3 utility meters located at the north end of the subject
alley within the C.R. 126 right-of-way.
2. This application is submitted as a request that the alley described in(1) above be vacated by
the county and the area be combined with the adjacent lots(Lots 3 and 4, Block 5). We
respectfully request this alley vacation for the purpose of joining said lots so that a detached
two-car garage can be built at the residence of 9368 Stevenson Avenue. After alley vacation,
the aforementioned lots, each currently measuring 50.0 feet (EW)by 150.0 feet (NS), would
each measure 60.0 feet (EW) by 150.00 feet (NS),bringing our total acreage to 18,000 sq.
ft./0.41 acres.
As shown on the attached map, the requested alley vacation would not hinder access to any
lots in the surrounding area due to the locations of existing alleys to the south and east. In
addition, the requested alley vacation would not hinder access to existing utilities in the area
as they are currently located outside the subject alley and within the existing road right-of-
way.

The Weld County Health Department has reviewed this proposal. The applicant requests to
vacate an alley between two lots to build a detached two-car garage. The Department is not
opposed to this request. However, the property is served by an existing septic system, permit
SP-0000631, which lies directly south of the residence. Because this property is served by a
private well and septic system, care should be taken to provide a replacement envelope that
meets the 100-foot setback to the well when any additional structures are placed on the
property.

The Weld County Public Works Department has reviewed this resubdivision request and offers
the following summary of comments.
COMMENTS:
o Public Works has reviewed this request to vacate the alley between Lots 3 and 4, Block 5,
Can, Colorado. The applicant owns both lots on either side of the alley and proposes to
build a detached two-car garage to accommodate the residents at 9368 Stevens Avenue.
Without vacating this alley, the applicant would not meet the setback required from the
Building Department to place this structure.
o By vacating the alley between Lots 3 and 4, Block 5, this would not land lock any parcels at
this location. The remaining portion of the alley between Lots 8 and 10, and the east/west
alley section would provide adequate alley access for the remaining lots within Block 5.
❑ Public Works has no conflict with this minor resubdivision for the vacation of an alley in
Can, Colorado, (RS-1024 Tipton,David&Heather).
