RE: APPROVE AMENDMENT OF DEVELOPMENT STANDARD NO. 15 CONCERNING
CHANGE OF ZONE FOR ALTHEN- BOYER SUBDIVISION
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, a public hearing was held on the 18th day of May,
1983 , for the purpose of hearing the request of Craig Aithen and
Nan Boyer, Althen-Boyer Subdivision, 370 Downing Street, Denver,
Colorado 80218, to amend Development Standard No. 15 concerning
the following described parcel of land, to-wit:
Part of the S1, SW4 of Section 23 , Town-
ship 1 North, Range 68 West of the 6th
P.M. , Weld County, Colorado
WHEREAS, the adopted Development Standard No. 15 reads as
follows:
"15. A final site plan for each lot within the
Commercial Unit Development shall be
reviewed by the Board of County Commis-
sioners for their approval . Any changes
of use on a lot which has been approved
in a final site plan review shall be sub-
ject to review again for the new use.
The final site plan review shall include
the following:
a) Identification in detail of the pro-
posed use;
b) The number, type and frequency of
traffic generated;
c) A drainage study for the lot;
d) The number of employees;
e) Indication of the location of the
proposed access;
f) Indication of landscaping proposed;
g) Information on which provisions shall
be made for fire protection so it will
be in compliance with #13 above;
h) Indication of the water requirements
of the proposed use; and
i) Indication of the sewage requirements
and details on the proposed system
This required information shall be submitted
in a combination of written and map form
utilizing the Weld County Planned Unit
Development guidelines. The final site
plan map shall be recorded in the Weld
County Clerk and Recorder ' s Office. "

WHEREAS, the amended Development Standard No. 15 shall read
as follows:
"A site plan review shall be required in
accordance with Section 33 . 4 . 5 of the Weld
County Zoning Ordinance. "
WHEREAS, the Board deems it advisable to approve the request
to amend Development Standard No. 15 for Althen-Boyer Subdivision.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that Development Standard
No. 15 for Althen-Boyer Subdivision be, and hereby is, amended
to read as hereinabove stated.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 18th day of
May, A.D. , 1983 .

(Before this Hearing began the Chairman Pro-Ten explained that there are only 4
Commissioners present and applicant may request a continuance.)
A public hearing was conducted on May J8 , 1983 at 2:00 P. M. , with
the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated April 11, 1983, and duly
published April 14, 1983, and May 4, 1983, in the La Salle Leader, a public
hearing was held for the purpose of considering the amendment of Standard #15
on the Change of Zone for Althen-Boyer Subdivision. Mr. Anson, Assistant
County Attorney, read the application into the record. Mr. Allison, repre-
senting the Planning Department, read the favorable recommendation, with
conditions, into the record. Larry Dirkson was present to represent the
applicants. Commissioner Johnson asked why this Standard was included_in the
Change_nf Zone. Mr. Allison said when this application was approved this
was a fairly new procedure and the applicants were hesitant about the Site
Plan Review Process, they wanted control in regard to what was going to be
developed. A Change of Zone today would not include this Standard. Mr. Allison
said no building permit would be issued if any applicant would not be willing
to conform with the minimum performance standards. After further discussion,
Commissioner N. Carlson moved to approve the amendment of Development Standard
#15 on the Change of Zone for Althen-Boyer Subdivision with the conditions
as listed. Commissioner Brantner seconded the motion and it carried unanimously.
