A public hearing was conducted on March 5, 2003, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated February 7, 2003, and duly published
February 13, 2003, in the South Weld Sun, a public hearing was conducted to consider the
request of Floyd and Katharine Oliver for Amended Planned Unit Development Final Plan,
S#562, for Meadow Vale Farm, Third Filing. Lee Morrison, Assistant County Attorney, asked
that Docket#2003-14 also be called up, since testimony would relate to both cases. Chair
Long verified the applicant chose to proceed with this hearing, even though one Commissioner
is absent. Sheri Lockman, Department of Planning Services, presented a brief summary of the
proposal and entered the favorable recommendation of the Planning Commission into the
record as written. She stated that, because of the simplicity of the case, staff allowed the
applicant to submitted both applications together. Ms. Lockman stated the purpose of this
amendment is to change the designation of Parcel A of Meadow Vale Subdivision, Third Filing,
which currently carries a note on the plat which requires civic use. Ms. Lockman stated the site
is within the Mixed Use Development Area and the Longmont Intergovernmental Agreement
boundary area, the site is currently vacant, and she reviewed the surrounding land uses. She
stated eight agencies responded to the referral with concerns, which have been addressed by
Conditions of Approval or Development Standards, and no correspondence has been received
from surrounding property owners.
Pam Smith, Department of Public Health and Environment, stated since the site will be served
by public water and sewer, she has no concerns.
Don Carroll, Department of Public Works, stated staff recommends using the existing access
off Weld County Road 5.5, which does have curb, gutter, and sidewalk.

Anne Best-Johnson, Todd Hodges Design, LLC, represented the applicant who wants to
remove designation on plat concerning Parcel A, which states, "This lot will be for potential Civic
Uses." She also stated on Final Plan notification, the parcel was noted as being 1.7 acres;
however, it is 2.4 acres. Ms. Johnson explained the Olivers had intended the use of this parcel
to be a satellite Sheriff's station or a trail head for the Saint Vrain Valley Trail project; however,
as development progressed at the Southwest Weld Administration Building, the planned uses
were no longer necessary and the Olivers have worked with the Colorado State Parks and
Recreation Division in designating another parcel to be used for the trail head, which is more
accessible to the general public. Ms. Johnson stated the current zoning is R-1, which does
allow a single-family dwelling unit as a Use Allowed by Right. The applicant is requesting the
parcel to be renamed Lot 1, Block 4, Meadow Vale Farm, Third Filing. Ms. Johnson reiterated
this is an approved lot in an approved platted and finished subdivision, and the applicant is
requesting a correction to the acreage and removal of the note regarding potential civic use.
Responding to Commission Geile, Ms. Johnson explained the designated parcel for the library
is a separate parcel, and she indicated on the overhead map, the location of the library parcel,
as well as the new trail head location. Ms. Johnson stated that everything east of the river is
owned by State parks.
Mr. Carroll stated there is an existing drainage easement across Tract 1, and Condition of
Approval #2.E should be changed on both resolutions to read, "The storm sewer system will be
maintained by the Department of Public Works." In response to Chair Long, Ms. Johnson
stated that Mr. Oliver has read and agrees with this change.
No public testimony was offered concerning this matter.
Chair Long ascertained Mr. Oliver agrees with the Conditions of Approval for both cases. Mr.
Oliver stated the library site has already been deeded to the library. He explained that this filing
was started in 1998, and at that time, there was a need for civic use; however, with the opening
of the Southwest Weld Service Center, the need is gone, therefore, he would like to change the
designation back to single-family residential. Mr. Oliver stated everything east of the river now
belongs to the Colorado Department of Parks, and everything west of the river is in a
conservation easement, which will be deeded to state parks after he and his wife are deceased.
Commissioner Vaad moved to approve the request of Floyd and Katharine Oliver for Amended
Planned Unit Development Final Plan, S #562, for Meadow Vale Farm, Third Filing, based on
the recommendations of the Planning staff and the Planning Commission, with the Conditions
of Approval as modified. The motion was seconded by Commissioner Masden, and it carried
unanimously. There being no further discussion, the hearing was completed at 10:25 a.m.
