Anderson 10524 Rich Road Bloomington, MN 55437 952-835-5721 January 6, 2003 Weld County Department of Planning Services 1555 North 17th Avenue Greeley, Colorado 80631 Re: Case Number USR-1407 Concerning the Request of Elizabeth Roseman Dear Sir or Madam: This is to place on record my objection to the request by Elizabeth Roseman for Special Use Permit or plan for operation of a commercial business(towing, storage, sales, rental of motorcycles, cars, recreational vehicles, noncommercial junkyard and auto pawn) in an A(Agricultural)Zone District. The lot (land parcel) described in this request is adjacent, on the north, to my property, which lies adjacent to WCR 18 and south to the property line of the legally described parcel named in this Special Use Permit request. Objection is grounded on the following: l. I have been familiar with this property, its use and contents since the mid- 1940's when my father purchased property adjacent to this parcel, now owned by the Rosemans. It was, until their ownership, a coral residence with no commercial activity evident, at least of the type that would deface or discolor an agricultural setting and place a scab upon it. The current use of the property is inconsistent with the look and use of its surrounding land and properties. While this defacement has been going on for a number of years, without legal permission, I see no justification to grant a permit to continue or further expand such use. 2. The property is being used as a junkyard operation now. I have witnessed such firsthand on my trips to Colorado the last several years. While there, I have had conversation with the Rosemans on other matters concerning EXHIBIT I 5A 2003-3094 01/06/2903 01:01 612-881--3684 PM PRINTING .-. As a result, I have reason to believe they will continue to run a commercial junkyard further expanding into boats, motorcycles, recreational vehicles, etc. What other primary explanation is there for wanting to run a towing service? The dismantling or servicing of wrecked or inoperable vehicles provides more than ample opportunity for the spillage and seepage of lubricants and fluids into the ground and, in my view, creates a constant environmental hazard that an agricultural area should not have to be concerned with. From my conversations with the Roseman, I don't believe such a hazard would have their consideration. 3. There are already commercial/industrial areas zoned and regulated for such automotive sale, rental, and junk businesses. I see no good reason to "set-up" another, however small, out in the midst of an agricultural area so it can further contaminate and blight a setting and environment so foreign to what the land has been used for over many years. It is my hope that the Planning Commission will protect the integrity of the area in question, deny the Special Use request NA prohibit the current and further"junkyard" use of the Roseman property. G.Who will provide fire protection to this site? The property is in Ft.Lupton fire district. H.What is the water source on this property? • There is a domestic and a livestock well on the property. Construction will begin upon approval of USR application and should be completed within 1-2 years. 10. Explain where storage and/or stockpile of wastes will occur on this site.
