The Department has reviewed the request to change from Agricultural to Industrial (1-3). The Department has record of a septic system (G19840017)for the residence at 10833 CR 66. No plans for future development were submitted with the application. Any further development of the site will require a Site Plan Review. Any commercial/industrial development must comply with all applicable Weld County Department of Public Health and Environment, Colorado Department of Public Health and Environment, EPA and/or Oil and Gas regulations. The applicant/developer must contact the appropriate agency for more information regarding the site-specific requirements of each development. The Department recommends approval of this application with the following conditions: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 4. Fugitive dust shall be controlled on this site. 5. This facility shall adhere to the maximum permissible noise levels allowed in the Industrial Zone as delineated in 25-12-103 C.R.S., as amended. 6. Any abandoned septic system must comply with the Weld County Code Section 30-4-20 (D). The applicant should contact the Department to update existing septic permit records if the system is abandoned. The property is located partially inside and partially outside the Town's Growth Management Area(GMA). That portion of the subject property that is within the GMA is delineated as Light Industrial on the Town's Land Use Plan map, while that portion of the subject property that is outside the GMA is delineated as Low Density Estate Single Family Residential. Since (a)the subject property straddles the GMA boundary, and (b) the applicant has slated that the subject property will be annexed to Windsor in the future, the Windsor Planning Commission voted to forward a recommendation of approval of the change of zone from A, Agricultural to I3, Industrial to the Weld County Department of Planning Services subject to the following condition: If the subject property is rezoned to the I-3 zoning classification, and the applicant does not utilize the subject property, the Windsor Planning Commission requests that the Town of Windsor staff to be given an opportunity to meet with the Weld County planning staff at a concept review meeting for any alternate proposal and for the"Town of Windsor Planning Commission to be given the opportunity in a timely manner to review and comment on any such alternate proposal that might be submitted for the subject property. The documents creating the right-of-way shall be noted on the change of zone plat, and 40-feet of right-of-way shall be shown. If the right-of-way cannot be verified, a 40-foot right-of-way will be dedicated on the site plan review. CR 23 is paved between SH 392 and CR 64'/4. ❑ CR 66 is classified by the County as a collector road and requires an 80-foot right-of-way. The applicant shall verify the existing right-of-way. CR 64 3/4 is paved adjacent to this site. ❑ CR 66 is shown as having County 60-feet of right-of-way as per the County ROW Book of 1889, running through the entire parcel of land. o CR 23 is shown as not having County 60-feet of right-of-way as per the County ROW Book of 1889, running North of CR 66 (along the section line). ❑ CR 64 '/4 is shown as having County 60-feet of right-of-way as per the County ROW Book of 1889, running through the entire parcel of land(east of CR 23 on the section line). ❑ This proposed zone change to an industrial use might possibly contribute significant traffic to the surrounding area. The applicant will be required to participate and contribute to improvements at the final application. ❑ Normally Public works has an understanding of the proposed development and potential impacts on surrounding infrastructure. If eventual use of this site would be a major impact, such as an asphalt or concrete batch plant, significant roadway and intersection improvements will be required. Transportation routes will be addressed at the final submittal. Since no development is proposed, the applicant will not be required to submit off-site roadway improvements agreements, or a professional traffic impact study with this change of zone. ❑ The change of zone plat that Public Works review normally has an internal roadway system. The applicant has not indicated internal roadways on the plat. Public Works has no comment at this time, since there is no development planned. Since no specific development was proposed, Public Works shall make appropriate reviews at the final plan. ❑ Often, a drainage report by a professional engineer licensed in the State of Colorado would be submitted with the change of zone application. Since no development is proposed, Public Works is not requiring a final drainage report at this time. The applicant must keep in mind that consideration for drainage will be required for future proposed development. Building permits shall be obtained prior to the construction of any new building. A plan review is required for each building. Plans shall bear the wet stamp of a Colorado registered architect or engineer. Two complete sets of plans are required when applying for each permit. 2. Each building will require an engineered foundation based on a site-specific geotechnical report or an open hole inspection performed by a Colorado registered engineer. Engineered foundations shall be designed by a Colorado registered engineer. 3. New buildings shall conform to the requirements of the codes adopted at the time of permit application. We strongly urge that you give favorable consideration of the zoning request and change the existing zone to industrial. Industrial zoning for the above referenced property is a logical extension of the existing industrial zoning at Eastman Kodak in Weld County and Metal Container Corporation and TMSI in Windsor. The property is also served by rail, with municipal water and sewer service available from the City of Windsor. Industrial zoning of the property will allow for the continuation and growth of industrial activity in the area and would benefit the taxpayers of Weld County. As you also know, the property in question is one of two sites in Weld County currently being considered by Owens-Illinois for a glass manufacturing plant.
