RE: North Star Estates Annexation Inquiry
Dear Mayor Stuart:
The Board of County Commissioners has been contacted by a resident of North
Star Estates concerning the possibility of annexing into the City and County of
Broomfield. We are advised of the restrictions and procedures regarding
annexation into the City and County of Broomfield, and we are strongly opposed
to Broomfield annexing any additional territory from Adams County.
The Board of County Commissioners has generally been supportive of annexations
of unincorporated areas of Adams County into its cities. However, proponents of
the formation of the City and County of Broomfield represented that, upon its
formation, the City and County of Broomfield would not attempt to expand its
boundaries through annexation.
Pursuant to Colo. Const. art. XX, § 10, "[o]n or after November 15, 2001, no
annexation or consolidation proceeding shall be initiated pursuant to the general
annexation and consolidation statutes of the state to annex lands to or consolidate
lands with the city and county of Broomfield until such proposed annexation or
consolidation is first approved by a majority vote of a seven-member boundary
control commission." Please be advised that, if and when a boundary control
commission is composed, we will adamantly oppose all efforts by Broomfield to
annex any additional territory from Adams County.
