D.Ltt.,£xT y R .0 TL DATE MY C SSM EYPP6_ l�r NM W RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION #3522 - RONALD AND MARY GRAHAM WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,on October 22,2003,the Board was presented with the request of Ronald and Mary Graham,38280 Weld County Road 19,Fort Collins,Colorado 80524,for Recorded Exemption #3522,at which time the Board deemed it advisable to continue the matter to November24,2003, to allow Ronald and Mary Graham additional time to work with the Department of Planning Services to review the various options for dividing the property, and WHEREAS,on November 24, 2003, the Board of County Commissioners, pursuant to its authority under Section 30-28-101(10)(d), C.R.S., did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption#3522, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land," and WHEREAS,the request for Recorded Exemption#3522 is for property which is located in part on the following described real estate, to-wit: Lot A of Recorded Exemption#1364;being part of the SW1/4 of Section 22, Township 7 North, Range 67 West of the 6th P.M., Weld County, Colorado being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A," said plat to be recorded, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 2.5 acres and 1.5 acres. NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County,Colorado,that the hereinabove described parcel of land be,and hereby is,exempt from the definition of the terms, "subdivision" and "subdivided land." BE IT FURTHER RESOLVED by the Board that Recorded Exemption#3522 by Ronald and Mary Graham is, approved conditional upon the following: 1. AWeld County septic permit is required for any proposed home. The septic system shall be installed according to the Weld County Individual Sewage Disposal System (I.S.D.S.) Regulations. 2. Topographic or physical features of the proposed lots, such as ravines, ditches, streams, etcetera, may limit the area available for a new or replacement septic system. Prior to recording the plat, the Weld County Department of Public Health and Environment recommends the applicant review the Weld County Code pertaining to septic systems to assure that any installed septic system will comply 2003-3212 RE3522 11/4•` C �L /��343 RE #3522 - RONALD AND MARY GRAHAM PAGE 2 with all setback requirements found in the Code. In the event the proposed lot is not of sufficient size to allow the installation of a septic system, the lot may need to be enlarged. 3. Prior to recording the plat: A. The plat shall be titled: Recorded Exemption No. 0705-22-03 RE-3522. B. The applicant shall submit to the Weld County Department of Planning Services evidence that any existing septic system meets all requirements of the Weld County Department of Public Health and Environment. The Weld County Department of Public Health and Environment was unable to locate a septic permit for the smaller house at 38280 Weld County Road 19, Fort Collins, Colorado 80524. Any existing septic system which is not currently permitted through the Weld County Department of Public Health and Environment will require an I.S.D.S. evaluation prior to the issuance of the required septic permits. In the event the system is found to be inadequate, the system must be brought into compliance with current I.S.D.S. Regulations. C. Lots Aand B shall share the existing residential access point as no additional accesses shall be granted. D. The applicant shall submit to the Weld County Department of Planning Services a 30-foot wide joint access and utility easement extending across Lot A from Weld County Road 19, for the benefit of Lot B, which shall be shown clearly on the plat. The joint easement shall be dedicated for the use as shown using the language set forth in the Weld County Code, Appendix 24-FE. The easement shall be graded and drained to provide all-weather access. E. All approved accesses shall be clearly shown on the plat. The applicant shall contact the Weld County Department of Public Works to determine if a culvert is necessary at any approved road access point. If a drainage culvert is required, a 15-inch Corrugated Metal Pipe (CMP) is Weld County's minimum size. If the applicant chooses to place a larger culvert, please contact the Weld County Department of Public Works to adequately size the culvert. F. Weld County Road 19 is designated on the Weld County Transportation Plan Map as a local gravel road,which requires 60 feet of right-of-way at full build out. There is presently 60 feet of right-of-way. A total of 30 feet from the centerline of Weld County Road 19 shall be delineated as right-of-way on the plat. This road is maintained by Weld County. 2003-3212 RE3522 RE #3522 - RONALD AND MARY GRAHAM PAGE 3 G. The West Greeley Soil Conservation District has provided information regarding the soils on the site. The applicant shall submit written documentation that they have reviewed the information and will use it to positively manage on-site soils. H. The applicant shall address the requirements of Weld County School District RE-4, as stated in the referral response received February 27, 2003. Evidence of such shall be submitted in writing to the Weld County Department of Planning Services. The applicant shall attempt to address the requirements of The Windsor- Severance Fire Protection District, as stated in the referral response received March 14, 2003. Evidence of such shall be submitted in writing to the Weld County Department of Planning Services. J. The following notes shall be placed on the plat: 1) All proposed or existing structures will meet the minimum setback and offset requirements for the Zone District in which the property is located. Pursuant to the definition of setback in the Weld County Code,the required setback is measured from the future right-of-way line. No building or structure, as defined and limited to those occupancies listed as Groups A, B, E, H, I, M and R in Table 3-A of the 1997 Uniform Building Code, shall be constructed within a 200-foot radius of any tank battery or within a 150-foot radius of any wellhead. Any construction within a 200-foot radius of any tank battery, or 150-foot radius of any wellhead, shall require a variance from the terms of the Section 23-6-10 of the Weld County Code. 2) Any future structures or uses on site must obtain the appropriate Zoning and Building Permits. 3) Prior to the release of Building Permits, the applicant shall submit a recorded deed describing the lot upon which the Building Permit is requested with the Building Permit applications. The legal description on such deed shall include the lot designation and Recorded Exemption number. 4) Prior to the release of Building Permits for any structure exceeding 3,600 square feet,the applicant must comply with the requirements of Appendix III-A of the Uniform Fire Code. 5) Should noxious weeds exist on the property,or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Chapter 15, Articles I and II, of the Weld County Code. 2003-3212 RE3522 RE #3522 - RONALD AND MARY GRAHAM PAGE 4 6) Subdivision Exemption#969 was approved in conjunction with this Recorded Exemption for the purpose of dividing off a second set of existing improvements from the parcel. 7) Effective January 1,2003, Building Permits issued on the proposed lots will be required to adhere to the fee structure of the County-Wide Road Impact Program. 8) Potential purchasers are hereby notified that there is a confined animal feeding operation within one (1) mile. Off-site impacts that may be encountered include noise from trucks, tractors and equipment; dust from animal pens; and odors from animal confinement, silage, and manure. 9) Weld County's Right To Farm statement, as it appears in the Weld County Code, Appendix 22-E, shall be placed on the Plat. K. The applicant shall submit a change in use Building Permit from an accessory building to residential for the structure located 320 feet east of Weld County Road 19. 4. The applicant shall submit two (2) paper copies of the plat for preliminary approval to the Weld County Department of Planning Services. Upon approval of the paper copies, the applicant shall submit a Mylar plat along with all other documentation required as Conditions of Approval. The Mylar plat shall be recorded in the office of the Weld County Clerk and Recorder by the Department of Planning Services. The plat shall be prepared in accordance with the requirements of Section 24-8-70 of the Weld County Code. The Mylar plat and additional requirements shall be submitted within sixty (60) days from the date of the Board of County Commissioners Resolution. The applicant shall be responsible for paying the recording fee. 5. The Department of Planning Services respectfully requests the surveyor provide a digital copy of this Recorded Exemption. Acceptable CAD formats are .dwg, .dxf, and .dgn (Microstation); acceptable GIS formats are ArcView shapefiles, Arclnfo Coverages and Arclnfo Export files format type is .e00. County Road 19 is designated on the Weld County Transportation Plan Map as a local gravel road,which requires 60 feet of right-of-way at full build out.There is presently 60 feet of right-of- way.A total of 30 feet from the centerline of County Road 19 shall be delineated right-of-way on the plat. This road is maintained by Weld County. G. The West Greeley Soil Conservation District has provided information regarding the soils on the site.The applicant shall submit written documentation that they have reviewed the information and will use it to positively manage on site soils. Off-site impacts that may be encountered include noise from trucks, tractors and equipment; dust from animal pens and odors from animal confinement, silage, and manure. 10) WELD COUNTY'S RIGHT TO FARM Weld County is one of the most productive agricultural counties in the United States, ranking fifth in total market value of agricultural products sold. The rural areas of Weld County may be open and spacious, but they are intensively used for agriculture. Persons moving into a rural area must recognize and accept there are drawbacks, including conflicts with longstanding agricultural practices and a lower level of services than in town. Along with the drawbacks come the incentives which attract urban dwellers to relocate to rural area: open views, spaciousness, wildlife, lack of city noise and congestion, and the rural atmosphere and way of life. Without neighboring farms, those features which attract urban dwellers to rural Weld County would quickly be gone forever. l"3/4, e'1 Agricultural users of the land should not be expected to change their long-established agricultural practices to accommodate the intrusions of urban users into a rural area. Well run agricultural activities will generate off-site impacts, including noise from tractors and equipment; slow-moving farm vehicles on rural roads; dust from animal pens,field work,harvest, and gravel roads;odor from animal confinement, silage,and manure;smoke from ditch burning;flies and mosquitoes;and the use of pesticides and fertilizers in the fields, including the use of aerial spraying. Ditches and reservoirs cannot simply be moved out of the way of residential development without threatening the efficient delivery of irrigation to fields which is essential to farm production. Section 35-3.5-102, C. R. S., provides that an agricultural operation shall not be found to be a public or private nuisance if the agricultural operation alleged to be a nuisance employs methods or practices that are commonly or reasonably associated with agricultural production. Weld County covers a land area of over 4,000 square miles in size (twice the State of Delaware) with more than 3,700 miles of state and county roads outside of municipalities. The sheer magnitude of the area to be served stretches available resources. Law enforcement is based on responses to complaints more than on patrols of the county and the distances which must be traveled may delay all emergency responses, including law enforcement, ambulance, and fire. Fire protection is usually provided by volunteers who must leave their jobs and families to respond to emergencies. County gravel roads, no matter how often they are bladed, will not provide the same kind of surface expected from a paved road. Snow removal priorities mean that roads from subdivisions to arterials may not be cleared for several days after a major snowstorm. Snow removal for roads within subdivisions are of the lowest priority for public works or may be the private responsibility of the homeowners. Services in rural areas, in many cases, will not be equivalent to municipal services. Rural dwellers must, by necessity, be more self-sufficient than urban dwellers. Children are exposed to different hazards in the county than in an urban or suburban setting. Farm equipment and oil field equipment,ponds and irrigation ditches,electrical power for pumps and center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs, and livestock present real threats to children. Controlling children's activities is important, not only for their safety, but also for the protection of the farmer's livelihood. Parents are responsible for their children. 4. We received your August 18, 2003 letter listing the options available to us. We are choosing option B: Validate that the house in question was constructed as a residential dwelling prior to 1972. We are grateful to now have one consistent contact person. All of the planners were informative and supportive, but there was never the same person to work with. Our request is complicated,thus each time I would have to explain our situation and essential information could have been unintentionally left out. I am obviously inexperienced with this and found the process very confusing. As property owners we are just trying to do the right thing. I would like to explain the chain of events that have occurred throughout this process. In January 2003 I came to your department to inquire about our property. Our property is unique because it is approximately 5.5 acres with three homes. I wanted to be sure we could achieve the end results before paying the application fees. When we purchased the property we were told the three homes were protected under a"grandfather"clause, allowing the three houses on one property. We did however want to make everything legal. Subsequently, we decided we could achieve all of this by completely understanding the end results before paying the application fees and investing time, energy, and money into the required process. During this meeting the planner agreed the county would like to have us, "make things right."The suggestion was to subdivide one acre for the house north of our home in order to get it on it's own lot. In addition, we would also need to do a recorded exemption on the 2.5 acres southeast of the main house for future development. This would leave our home on approximately 1.8 acres. We didn't discuss the little house east of ours, and at that time I didn't think it would be an issue. This house is a very small studio and there was an elderly disabled man living there when we moved in. We believed he would fall under the"grandfather" clause. I came back the first part of February, and met with a different planner and again discussed our intensions. During this meeting the planner suggested several ways we might split the property so we would have one house on each lot. I asked if for some reason we are unable to accomplish,this then what would we need to do?He reported that because the houses were so old they would fall under the "Nonconforming Use" guidelines. He explained, in detail those guidelines, and said there might be a problem with the septic systems, and I might need to bring them up to code. He told me, I should go next door to the Environmental Health Department and see if there were existing permits on these tanks. I followed up with Environmental Health and they found a permit n for our septic system but not for the other two houses,therefore requiring them to do a physical inspection. I came back after talking with a surveyor and several companies that installed septic systems. I met on February 21'with a planner(Lance) reviewing our intentions and paying the application fee ($1170.00) because we felt we could meet all the requirements. Between February 21, 2003 and May 1, 2003 I came in numerous times with questions and met with Lance as we progressed with this process. Four months later, on May 1st we received a letter about the subdivision and recorded exemption stating both would be approved with a list of conditions. We understood all conditions except for the recorded exemption Item 7, which talked about the house east of our home. I went back immediately after receiving the letter and asked for Lance because I knew he was most familiar with this situation. I had to meet with someone else because Lance was no longer working there. I went over our intensions again and explained that this Item 7 was in reference to the house east of ours. I explained how it was a small one bedroom home, and an elderly disabled gentleman had been residing there before we purchased the property. She explained(like Lance) that this would fall under the Nonconforming Use guidelines, and first I would have to show a septic permit and bring in copies from the surveyor showing the split. The first part of June I came in and met with another planner who laughed compassionately because even though she hadn't met me was aware of this unique project and the"the old gentleman."Please understand, "Ed Cavaliere,"the elderly gentleman has become dear to us and feels like part of our family and home. With his disability and limited income he has nowhere else to go. The thought of Ed having to leave his little home of many years is absolutely heartbreaking. The planner reviewed the surveyor's plans and made a couple of changes. She told me to have these changes made and bring back the Mylar copies. I asked if I should also bring in paper copies for review and she said that wouldn't be necessary. She asked to see the Nonconforming Use application and I told her I didn't have one. She printed out an application for me and went over how to fill it out. She also reminded me I needed to have the signed septic permit for this house before the Nonconforming Use permit would be granted. I explained how we had to replace the old tank because it was metal and the tank inspection was completed and waiting for Pam's signature. She was very helpful, kind and supportive. All the planners we have worked with have been competent, informative and professional in guiding us through this process. August 8, I returned with the Mylar copies, the approved septic permit for the new tank and the Nonconforming Use application. I met with another planner(first time) and she said we would need to have the Mylar copies notarized. She then excused herself and went to a back office for about twenty minutes. When she returned to the front counter she said we would also need to prove this residence was built and occupied before 1972, due to no available records of it's use. This was late in the day and I feh rushed. I left totally confused about how we had come this far(eight months) and why now I needed to show proof of the age and purpose of the house. n I talked with the construction company who installed the new septic tank because the backhoe operator had mentioned that his grandfather had put in the original tank. August 13th we came back with a letter from this company documenting that the original septic system for the studio was installed prior to 1972. They thought it was installed around 1929 but didn't have records going back that far. We met with the notary and paid the $22 dollar fee. On August 15th we got a call saying you were not going to approve the Nonconforming Use permit and that we could pick up our, Mylar copies and a list of options on Monday, August 18th. By this point in time we were devastated and surprised. One of the options available is to validate that the house was constructed and used as a residential dwelling prior to 1972. Enclosed is a letter from Manuel Pineda stating he knows for a fact the house has been used as a residence at least since 1955. He also shared with us that the little outhouse, which is still on the property, was used for this house before it had plumbing. The fact that the septic system was installed prior to 1972 validates this building was being used as a residence. Also, enclosed are pictures showing the house has a chimney for heat, a one car detached garage,the original outhouse that was used before the septic tank was installed, and his mailbox with a permanent address. The siding and construction is of the same vintage as the original shop and barn. We now know the barn was built in 1911 one year prior to the construction of our home. We hope this demonstrates beyond question that this house has always been a residence, even prior to 1972. We are not trying to be unreasonable in our request to grant the Nonconforming Use permit and we certainly wouldn't have invested$4000 in permits, septic tank replacement and surveys if we would have been`informed from the beginning' we couldn't continue to use this as a residence. MEMORANDUM WIDc TO: Weld County Board of County Commissioners COLORADO DATE: October 21, 2003 FROM: Michelle Katyryniuk SUBJECT: RE-3522 and SE-969 These cases have been brought before the Board of County Commissioners because condition number six (6) of the Department of Planning Services Recorded Exemption administrative Review(RE-3522) states "The Weld County Department of Planning Staff's approval of this Recorded Exemption Application is based on satisfying the Conditions of Approval. Should an applicant be unwilling or unable to meet any one of these conditions within 60 days of approval, then this case will be forwarded to the Weld County Board of County Commissioners with a staff recommendation for denial." Upon the Department of Planning Services field check it became clear that structure number six (6) was being lived in. The Weld County Assessor Records indicate that structure number (6) is an out building. The Department of Planning Services therefore included condition number seven (7)"The existing accessory building located 320 feet East of County Road 19 shall comply with the definition of Accessory Building in Section 23-1-90 of the Weld County Code and maintain compliance with the following conditions: a) Electricity is the only utility which will be connected to the structure. b) The structure shall not be used on any basis as a dwelling or as overnight or temporary housing for any person" as a note to be place on the plat. When the applicant applied for the Recorded Exemption /Subdivision Exemption the lot lines were drawn so that structure number six (6) (on the applicants map)was to be on Lot B of RE-3522. When the applicant submitted the paper copy of the plat structure number six (6)was no longer on Lot B of RE-3522 but on Lot A. The applicant was informed by the Department of Planning Services of the following options: a) Reconfigure the lots so there is one principal dwelling unit per lot b) Validate that the structure in question was constructed as a residential dwelling prior to 1972, currently the County Assessor Records are showing the structure as a Shed / Out Building c) Submit written evidence to the Department of Planning Services that the use of the structure has been abandoned d) apply for a Use by Special Review (USR)for a second residence. The applicant chose option " b"to apply for an nonconforming use (NCU). The Department of Planning Services found the evidence submitted by the applicant to be insufficient in order to determine that the structure was built as a residential house prior to 1972 therefore denining the NCU. The Weld County Assessor Records indicate that on 10/25/77 a site inspection was done on the property in question and found that structure six (6)was a 32'x 14'storage shed. Some time after 1977 the structure in question was converted into a residence without a building permit and with shared utilities.
