HomeMy WebLinkAbout20032018.tiff HEARING CERTIFICATION DOCKET NO. 2003-53b RE: SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT USR#1423 FOR A DOG KENNEL (NOT TO EXCEED 60 GREYHOUND DOGS) IN THE A(AGRICULTURAL) ZONE DISTRICT - HEATHER WEIR A public hearing was conducted on August 6, 2003, at 10:00 a.m., with the following present: Commissioner David E. Long, Chair Commissioner Robert D. Masden, Pro-Tem Commissioner M. J. Geile Commissioner William H. Jerke Commissioner Glenn Vaad Also present: Acting Clerk to the Board, Carol A. Harding Assistant County Attorney, Lee Morrison Planning Department representative, Chris Gathman Health Department representative, Pam Smith Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated July2,2003,and duly published July 10,2003,in the South Weld Sun, a public hearing was conducted on July 23, 2003, to consider the request of Heather Weir for a Site Specific Development Plan and Use by Special Review Permit#1423 for a Dog Kennel(not to exceed 60 Greyhound dogs) in the A(Agricultural)Zone District;however,with only three Commissioners present, the applicant requested a continuance. The case was continued to July 30, 2003, at which time four Commissioners were present and the case was heard;however,because Commissioners Long and Geile did not have time to hear the taped record of the testimony taken on July 23, 2003, a decision could not be made,and the matter was again continued to August 6,2003. Lee Morrison,Assistant County Attorney,made this a matter of record. Chair Long stated that he and Commissioner Geile reviewed the taped record of the testimony taken on July 23, 2003, therefore, the Board is ready to proceed with deliberation and discussion. He stated if there is a split vote,Commissioner Masden would then have to hear the taped record of the July 30, 2003, meeting in order to cast a vote. Commissioner Geile reviewed the Board's discussion to this point,which included the insertion of the words"rescued Greyhound"dogs;the maximum number of dogs allowed would be 60,although that would only happen occasionally,and routinely there would be approximately 20 dogs on the property;and the addition of a Development Standard stating there would be no breeding of animals or disposal of animals on the property. Commissioner Geile also stated the facilities should be located on the 77 acres in such a manner as to have minimal impact on the neighbors, as well as a landscaping plan,which would be presented to the Department of Planning Services for approval. Commissioner Jerke stated he was persuaded by Commissioner Geile's reiteration,as well as the fact that this is property is quite a distance from most settled population. He also stated the facilities will be over 1,000 feet from the county road,therefore,there is already a natural buffer from other residents;the animals will be kept indoors or supervised within the chain length fenced area; and 2003-2018 PL1674 COi ?L, ?cc „Lk_ HEARING CERTIFICATION - HEATHER WEIR (USR#1423) PAGE 2 the applicant is a Veterinarian and is very compassionate towards the animals. Chair Long reiterated that the applicant would not be required to have the same supervision for her private dogs as for the rescued dogs. Commissioner Geile moved to approve the request of Heather Weir for a Site Specific Development Plan and Use by Special Review Permit#1423 fora Dog Kennel(not to exceed 60 Greyhound dogs) in the A(Agricultural)Zone District, based on the recommendations of the Planning staff and the Planning Commission,with the Conditions of Approval and Development Standards as entered into the record and through previous discussion. The motion was seconded by Commissioner Jerke, and it carried unanimously. There being no further discussion,the hearing was completed at 10:30 a.m. This Certification was approved on the 11th day of August, 2003.
