No. 2003-63, PF-543 To: Weld County Commissioners, I am the property owner immediately adjacent to and on the west side of the subject property. At the planning review on July 15, I went on record regarding my concerns over the possible loss of irrigation water, ditch and lateral accessibility, potential liability for damage to and resulting from the irrigation lateral, etc. Since that time, I have spoken to Mr. John Rinko regarding solutions to these concerns. He has verbally proposed to include in his development efforts a plan to hard pipe the irrigation lateral to my property, to create an easement, and to generally ensure the ability of myself and water users downstream to draw water from the headgate and to maintain the lateral. He stated that he is attempting to work with Farmer's Ditch Company to facilitate measures that will also ensure that Community Ditch also remains available and serviceable. I am awaiting a confirming letter of agreement to this effect, which Mr. Rinko has promised is forthcoming. Assuming that Mr. Rinko's commitments in this matter are fulfilled, I have no further objections or concerns with regard to the proposed property development plan.
