RE: ACTION OF BOARD CONCERNING PROBABLE CAUSE HEARING CONCERNING
USE BY SPECIAL REVIEW PERMIT#1262 -JAMES DOCHEFF, JR. / DIAMOND D
DAIRY
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on the 30th day of June, 2003, a Probable Cause Hearing was held before
the Board to consider setting a Show Cause Hearing to determine whether or not James
Docheff, Jr., Diamond D Dairy, 4513 Weld County Road 32, Longmont, Colorado 80504, was in
compliance with certain Conditions of Approval and Development Standards contained in
Special Review Permit #1262 for an Agricultural Service Establishment for a Livestock
Confinement Operation (dairy) and Animal Feeding Operation for 800 head of cattle in the A
(Agricultural) Zone District, and
WHEREAS, at said hearing on June 30, 2003, the Board deemed it advisable to continue
said matter six months to allow James Docheff, Jr./Diamond D Dairy adequate time to complete
the remaining outstanding items as cited in staff's memorandum, dated June 30, 2003, with an
allowance for staff to bring the matter back before the Board at an earlier date if all issues have
been satisfactorily completed.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the abovementioned matter be, and hereby is, continued to
December 29, 2003, at 9:00 a.m., with an allowance for staff to bring the matter back before the
Board at an earlier date if all issues have been satisfactorily completed.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 30th day of June, A.D., 2003.
