HomeMy WebLinkAbout20032692.tiff RESOLUTION RE: APPROVE REQUEST OF HIGH BALL ERECTORS, LLC FOR VACATION OF A PORTION OF SPECIAL REVIEW PERMIT#117 -WASHINGTON TURKEY FARMS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution dated November 10, 1971, the Board did approve Special Review Permit#117 for a turkey farm operation for Washington Turkey Farms on a parcel of land being fully described in said resolution, located in portions of Sections 24 and 25, Township 1 North, Range 68 West of the 6th P.M., Weld County, Colorado, and WHEREAS, the Board has received a request from High Ball Erectors, LLC, to vacate any portion of said Special Review Permit#117 lying within the area of proposed Use by Special Review#1445, to-wit: That part of the SW 1/4 of Section 24, Township 1 North, Range 68 West of the 6th P.M., Weld County, Colorado, being more fully described in Exhibit "A", which is attached hereto, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendations of the Department of Planning Services staff and all of the exhibits and evidence presented in this matter and, having been fully informed, deems it advisable to approve said vacation. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the portion of Special Review Permit#117 described on the attached Exhibit A be, and hereby is, vacated. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 22nd day of September, A.D., 2003. Dear Jacqueline, I have been informed that the property on which I have applied for a"Use By Special Review"permit is within a portion of USR SUP 117, dated 1971. This USR was approved previously to allow the use of a commercial poultry operation or turkey farm. I hereby request that any portion of the previous USR SUP 117 lying within the area of the proposed USR-1445 for High Ball Erectors, LLC be vacated at this time. I have attached a copy of the Legal Description for USR-1445 which defines the area of USR SUP 117 to vacate. The intention of my current USR application is to bring in to conformance with the Weld County Code the use of a steel erection and commercial storage business.
