Docket Number 2003-43 To: Board of County Commissioners Weld County, Colorado We feel we must oppose the proposed zoning variance (Special Review Permit #1419) to our A (Agricultural) Zoned District. Following are some, but not all of our reasons we think the variance should be denied. 1. As stated in Section 23-3-10, Intent, of the Weld County Zoning Regulations, "Agriculture in the COUNTY is considered a valuable resource which must be protected, etc." 2. We do not see any article under Section 23-3-20, Uses allowed by right, that would even remotely allow "parking and maintenance of carnival equipment". 3. Under Section 23-3-30, Accessory uses, it states, "The following BUILDINGS, r^ STRUCTURES AND USES shall be allowed in the A (Agricultural) Zone District so long as they are clearly incidental and ACCESSORY to the USES allowed by right in the A (Agricultural) Zone district. ❖ With reference to the above section we do not see where the "parking and maintenance of carnival equipment" could be allowed because it is not clearly and ACCESSORY to the USES allowed by right in the A Agricultural Zone District. 4. Under Section 23-3-40, Uses by special review, again under this section we do not see any article that would apply to the "parking and maintenance of carnival equipment". We do not feel that the USES "the parking and maintenance of carnival equipment" is compatible with the existing surrounding land USES which is primarily rural residential. Due to the nature of the land located at 15901 Weld County Road 5, the parking of carnival equipment and the semi tractor-trailers associated with the carnival is at best poor. (Years ago the topsoil was removed along the west edge of the property and for some distance to the east of the west property line to provide fill for the build of the house at 15945 Weld County Road 5.) This removal of the topsoil has left the drainage tile just inches below the surface. The drainage tile is now broken and plugged and ditches have been dug to provide some relief, but the area is still wet and marshy, this also affects the surrounding properties. Parking of equipment and trailers in this area would present problems. Qa23- 1e27d EXHIBIT G ustt/9►9 Page 1 PLi66/2 es- When Mr. Shubert was requesting a neighbor's signature for permission to build another home on the property, he stated that he would build a privacy fence between their properties, this hasn't been done yet. When Mr. Shubert moved in his carnival equipment, he had his employees living in truck campers and trailers everywhere on his property. They had propane lines lying on the ground that were supplying the campers and trailers. Weld County had to come in put a stop to that practice. Is there going to be one problem like this after another? Please do everything you can to preserve our agricultural heritage. (Old timers from this area have told us that our combined small acreage's produced the best silage corn in the county.) It pains us to look out over our beautiful countryside and instead of seeing lush green pastures, we see tractor-trailers, carnival rides and cotton candy booths.
