HomeMy WebLinkAbout20030397 RESOLUTION RE: APPROVE RESUBDIVISION (LOT LINE ADJUSTMENT ONLY) OF UNION COLONY SUBDIVISION, RS #1023 -WELD COUNTY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 10th day of February, 2003, at the hour of 9:00 a.m. in the Chambers of the Board for the purpose of hearing the application for a Resubdivision (Lot Line Adjustment Only) of Union Colony Subdivision, RS #1023, on the following described real estate, to-wit: Lots 1 and 2 of the NE1/4 SE1/4, and Lot 1 of the NW1/4 SE1/4, Union Colony Subdivision, being part of Section 27, Township 6 North, Range 67 West of the 6th P.M., Weld County, Colorado WHEREAS, said applicant was represented by Donald D. Warden, Director of Finance and Administration, and WHEREAS, Section 24-5-30 of the Weld County Code provides standards for review of said Resubdivision (Lot Line Adjustment Only), and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendations of the Weld County Department of Planning Services staff and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24-5-30.B of the Weld County Code. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24-4-30.C.3 of the Weld County Subdivision Ordinance including specifically: a. Section 24-5-30.C.3.a -- The lot line revision complies with the approved recorded final plat. Union Colony Subdivision was created in 1872. The original plat was very vague. The proposed lot line changes ensure that lots are not split by the Greeley City limits. Further, the lots will be altered to created distinct areas for mining (SUP #369) and the Weld Food Bank. b. Section 24-5-30.C.3.b --The application complies with the adopted rules, regulations, and ordinances currently in force and affecting the Subdivision. All pertinent regulations have been addressed through the Resubdivision process. On-site mining and the proposed Weld Food Bank shall be addressed through the Use by Special Review application process. 2003-0397 SUBD UNION COLONY al. Prior to Recording the Resubdivision Plat: A. All plats shall be labeled RS #1023, Resubdivision of Union Colony Subdivision B. Lot 2 shall be amended to delineate a minimum width of twenty (20) feet for utility easement along the south and east lot lines. C. The access easement along the north and west side of Lot 2 shall be amended to allow for an access and utilities. D. The applicant shall submit a paper copy of the plat for preliminary approval to the Weld County Department of Planning Services. E. The applicant shall create a digital file of all drawings associated with the Resubdivision application. Acceptable CAD formats are .dwg, .dxf, and .dgn (Microstation); acceptable GIS formats are .shp (Shape Files), Arclnfo Coverages and Arclnfo Export files format type is .e00. The preferred format for Images is .tif (Group 4) ... (Group 6 is not acceptable). A copy shall be submitted to the Weld County Department of Planning Services at the time of Mylar plat submittal. 2. Upon completion of items 1.A through 1.E the applicant shall submit a Mylar plat along with all other documentation required as Conditions of Approval. The Mylar plat shall be recorded in the office of the Weld County Clerk and Recorder by the Department of Planning Services. The plat shall be prepared in accordance with the requirements of Section 24-4-40.D.6 through D.11 of the Weld County Code. The Mylar plat and additional requirements shall be submitted within sixty (60) days from the date of the Board of County Commissioners resolution. The resubdivision is being proposed so that a parcel may be created for a new food bank. (see New Lot 2 on the attached map). The resubdivision will also adjust the property line between parcels 1 and 2 of the NE4 SE4 so that it follows the incorporated boundary of the City of Greeley. Union Colony Subdivision was created in 1872.Therefore,the only regulations currently in force which affect the subdivision are those within the Weld County Code.
