HomeMy WebLinkAbout20030477.tiff HEARING CERTIFICATION DOCKET NO. 2003-10 RE: SITE SPECIFIC DEVELOPMENT PLAN AND AMENDED USE BY SPECIAL REVIEW PERMIT#794 FORACHURCH IN THE A(AGRICULTURAL)ZONE DISTRICT-GALETON COMMUNITY CHURCH A public hearing was conducted on February 19, 2003, at 10:00 a.m., with the following present: Commissioner David E. Long, Chair Commissioner Robert D. Masden, Pro-Tem Commissioner M. J. Geile Commissioner William H. Jerke Commissioner Glenn Vaad Also present: Acting Clerk to the Board, Carol Harding Assistant County Attorney, Lee Morrison Planning Department representative, Sheri Lockman Health Department representative, Char Davis Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated January 31, 2003, and duly published February 6, 2003, in the South Weld Sun, a public hearing was conducted to consider the request of Galeton Community Church for a Site Specific Development Plan and Amended Use by Special Review Permit #794 for a Church in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Sheri Lockman, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. She stated this application is to expand the existing church in Galeton,and seven referral agencies reviewed the case,five of which responded favorably or included conditions that have been addressed through Conditions of Approval or Development Standards. Ms. Lockman stated no letters of opposition have been received,and as recommended by the Planning Commission, Development Standards include a variance from the standard setback for the proposed addition in Development Standard#3. She stated the applicant is also required to enter into an Improvements Agreement and post adequate collateral for the on- site improvements and pavement of the adjacent alley; however,the majority of the improvements are being donated by church members,therefore,the applicant is requesting deletion of Condition of A pproval #1.D, w ith t he a ddition o f t he f ollowing: C ondition o f A pproval #2, "Prior to the Issuance of Building Permits;"Condition of Approval#2.A,"The parking lot will be completed to the satisfaction of the Weld County Department of Public Works. Evidence of the Department of Public Works approval shall be submitted to the Department of Planning Services;" and Condition of Approval #3.C, "Prior to the release of the Certificate of Occupancy, the applicant shall submit evidence that all remaining transportation and non-transportation items have been completed." Responding to Commissioner Vaad, Ms. Lockman stated the street to the west is the paved street. Char Davis, Department of Public Health and Environment, had no comments, and Don Carroll, Department of Public Works, stated Grand View Street is currently paved from Weld County Road 74 south to the school. He said the applicant is proposing to pave the alleyway, the Department of Public Works is not requiring the paving. 2003-0477 PL0395 re. ilk/ ,/L c�7�� �'�tJ HEARING CERTIFICATION - GALETON COMMUNITY CHURCH (AMUSR #794) PAGE 2 Ann Best-Johnson, Todd Hodges Design, LLC, represented the applicant, gave a brief summary of the project, and stated the applicant has been waiting for approval prior to beginning site work. She stated the setback will be two feet or greater from the alley, and not less than the existing structure from Second Street. She reviewed the Site Plan, showing the layout of the property. Ms. Best-Johnson further stated the applicant did include documents from Galeton Sanitation District, North Weld Water District, and Galeton Fire Protection District with the application materials. She said they have also been working with the Department of Public Works on the alley improvements to accomplish drainage. Ms. Best-Johnson stated the applicant has been located at this site for 74 years, and that the applicant wishes to state that reasonable accommodations will be made per purview of the American Disability Act, and Ms. Best-Johnson specified exactly how accommodation will be made. Responding to Commissioner Vaad, Ms. Best-Johnson, reiterated the alley has no requirement for setback; however, the applicant will offset the building by two feet. Dennis Egge, Galeton Community Church, stated because of the width of the alley, they have narrowed it down,and they will pave the center of the alley, giving additional footage away from the edge of the alley. He stated there is currently a 20-foot right-of-way in the alley, and they are only going to do a 14-foot travel surface, therefore, the building will not be crowded. Commissioner Jerke stated Condition of Approval 1.6.1 and 2 could be deleted, due to the ability of the church to accomplish their own landscaping, etc. Mr. Egge stated he appreciates Commissioner Jerke's confidence, and noted he has talked to Ms. Lockman as to what they are planning, and that the trash issue has been resolved. No public testimony was offered concerning this matter. Chair Long verified with Mr. Egge that he has read the Conditions of Approval and Development Standards, along with the proposed amendments, he agrees with them. Commissioner Jerke moved to remove Conditions of Approval#1.B.1 and 2. Commissioner Vaad seconded the motion, which carried unanimously. Commissioner Jerke moved to approve the request of Galeton Community Church for a Site Specific Development Plan and Amended Use by Special Review Permit#794 for a Church in the A(Agricultural)Zone District,based on the recommendations of the Planning staff and the Planning Commission,with the Conditions of Approval and Development Standards as modified by staff and requested by the applicant. The motion was seconded by Commissioner Vaad, and it carried unanimously.
