A copy of the ad from the Fence Post was forwarded. The copy was of poor quality and access to the website of the Fence Post was not producing the same ad. Based upon the information supplied, I called the County Attorney's Office and left a message for Lee Morrison to call me back. I then called the Auctioneers' number(303-564-6029) and spoke to a Mr. Burt Dailey. I informed him that it had been brought to our attention that an auction was scheduled to occur on Mr. Rodriguez's property. He explained that he thought this was the "land of the free and home of the brave...." He didn't understand why a guy couldn't do whatever he wanted to do on his own•property. He went on to say that he had invested a great deal of money into the ads. I explained that Mr. Rodriguez had been notified last year that auctions were not an allowed use. He said "no, /spent a lot of money." I told him that I understood, but Mr. Rodriguez should have told him that he had already been contacted previously regarding the presence of any auctions. He was very frustrated. I told him that I was trying to get in touch with Mr. Rodriguez, but was also giving him a "heads up" on the potential issue. I then attempted to contact Mr. Rodriguez(303-717-0295). I was put directly through to voice mail. I left a message for Mr. Rodriguez to contact me as soon as possible regarding the proposed auction. I then called Lee Morrison again. I explained the situation. He suggested that we fax and send a letter to both Mr. Rodriguez and his counsel explaining the situation and possible ramifications. I composed a letter and e-mailed it to Lee late in the afternoon. Lee made corrections. Subsequently, the letter was faxed to Mr. Rodriguez's counsel the next morning (05/29/03). Also, copies were sent via mail to La Maravilla and Mr. Rodriguez. I then received a clearer copy of the insert of the Fence Post via fax. Mr. Rodriguez later contacted me (05/29/03). He stated that had cancelled the auction. He had previously told the auctioneer to contact us before any advertisements were placed to receive permission. I explained that we did not receive such a call. He said that he didn't want to do anything to jeopardize his liquor or restaurant license. He said that in the future, he would contact us personally to ask permission prior to any events.
