The applicant's have completed their drawing and have submitted evidence as requested by staff for this facility. Due to rights-of-way issues, the applicant will be required to relocate the facility sign, entrance sign and overhead lighting to new locations on site. Given that the facility is located in the Mixed Use Development area, the applicant will be required to apply through the Board of Adjustment for sign(s) that are proportionately larger than what is permitted under the Code. If approved, the applicant will apply for a building permit for the erection of all relocated signs. The Department of Planning Services will require that the site identification sign and the entrance directional sign be removed and electric service terminated to each sign within 30 days of recording date or earlier as conditions warrant. The Department of Building Inspection stated in their referral that these two free standing signs were erected without required building permits. The applicant has met the parking requirement and is in compliance with the Mountain View Fire Protection District access and circulation requirements as delineated on the Site Plan Review, SPR-364, mylar to be signed and recorded. Any modifications to the site circulation, including parking area shall be in compliance with the Fire District at all times. The applicant has met the requirements of the Colorado Department of Transportation specific to access to this facility. The facility has an approved Access Permit. Left Hand Water District will continue to provide the potable water for the facility and St. Vrain Sanitation will continue to handle the effluent flows. Five NCU Case Files will be established for the non-conforming use of structures associated with this facility. NCU-375 applies to the three sided portico sign advertising the Travelodge facility. This illuminated sign is five feet in height and forty-two feet in length per each face of the portico structure. NCU-376 applies to the flush mounted sign identifying Simon's Bar and Grill located within the facility. This illuminated sign is approximately ten feet wide and six feet in height. NCU-376 applies to the Waffle House Restaurant pole sign located on the Travelodge property. The illuminated sign does not meet setbacks or the height requirements fro the Mixed Use Development area. NCU-377 applies to the fifteen foot diameter silo located in the northeast corner of the property. The silo bisects the north property line, thus does not meet the setback requirements. NCU-378 applies to the wood shed located in the northeast corner of the property, east of and adjacent to the silo. The applicant states that St. Vrain Sanitation District has access to this structure for maintenance of above ground piping. Given this situation, staff is not prepared to require the applicant to remove this structure. The property is in compliance with the maintenance requirements for the area and is not in violation of any land use violations upon the recording of this Site Plan Review plat. The Department of Building Inspection notes that the applicant has provided documentation for the apartment located within this facility. A Building Permit has been applied for to perform inspections for the original permit that was expired per the Board of County Commissioners Resolution of November 26, 1997. Suspension or revocation of license. - After a public hearing has been held to determine whether there have been any violations by the licensee or by any of the agents,servants or employees of the licensee of the provisions of the Colorado Liquor Code, of any of the rules or regulations authorized pursuant to the Colorado Liquor Code or of any of the terms, conditions or provisions under which the license was issued, and after a determination by the Board of County Commissioners that such violations did occur,the following factors will be considered to determine the sanction to be imposed: A. Seriousness of the violation in terms of the affront to the public. B. Corrective actions taken by the license holder. C. Prior violations and offenses at the licensed premises and effectiveness of prior corrective action. D. Prior violations and offenses by the licensee. E. Violation as a repeated course of conduct or as a single event. F. Likelihood of recurrence. G. All circumstances surrounding the violation. H. Willfulness of the violation. I. Hardship on the licensee of the penalty imposed. .1. Length of time the license has been held by the licensee being disciplined. K. Previous sanctions imposed against the licensee. L. Other factors making the situation unique to the licensee or premises subjected to discipline. (Weld County Codification Ordinance 2000-1) Sec. 12-2-30. Application for renewal. The Board of County Commissioners may set a public hearing on the renewal application if it finds probable cause to believe that any one(1)of the factors contained in Section 12-2-40 below exists. Fees for 3.2%beer or liquor licenses may be found on Appendix 5-H. (Weld County Codification Ordinance 2000-1; Weld County Code Ordinance 2001-3) Sec. 12-2-40. Refusal to renew; public hearing,Phase I. The Board of County Commissioners may consider the following factors in a public hearing to determine if good cause exists to refuse the renewal of any liquor license. Such consideration is denoted as Phase I of the public hearing: A. Evidence that the licensee or applicant has violated, does not meet or has failed to comply with any of the terms, conditions or provisions of this Article or any rules and regulations promulgated pursuant the Colorado Beer Code or the Colorado Liquor Code. B. Evidence that the licensee or applicant has failed to comply with any special terms or conditions that were placed on its license in prior disciplinary proceedings or arose in the context of potential disciplinary proceeding. C. Evidence that the licensed premises have been operated in a manner that adversely affects the public health, welfare or safety of the immediate neighborhood in which the establishment is located, which evidence must include a continuing pattern of fights,violent activity or disorderly conduct. For purposes of this Paragraph C,disorderly conduct has the meaning as provided for in Section 18-9-106, 12-8 C.R.S. - D. Evidence that the licensee is no longer of good character. Phase II of such public hearing shall be a determination of whether the following items mitigate or aggravate the effects of the factors listed in Section 12-2-40 above,if any one (1)of the Phase I factors are found to exist; such factors to be considered in determining whether denial of renewal is justified: A. Where only three (3)members of the Board of County Commissioners are present for the renewal, suspension or revocation hearing wider the Colorado Liquor Code,the licensee may request a continuance to a hearing date at which additional members of the Board will be present. Where four (4) members of the Board of County Commissioners are present, the hearing shall proceed, at the discretion of the Board, provided that if any vote on the ultimate issues of suspension, revocation or renewal results in a 2-2 tie vote, the hearing shall be adjourned until such time as the fifth Commissioner has had an opportunity to review the record. Systems shall be installed in accordance with their listing and the manufacturer's specifications. • A permit for the installation of this systems may also be required to be obtained from the Weld County Building Department. • Plenum coverage is not adequate the two ADP/1 nozzles will only protect 12 feet in length and the plenum is 17 feet 4 inches long. Additional nozzles will need to be added or the Plenum/2 type nozzles will need to be used. • The existing link line set up may be used but new fuse links, with current dates, must be installed. • The extinguishing system shall be interconnected to the fuel supply or current supply so that the fuel or current is automatically shut off to all equipment under the hood when the system protecting the equipment is activated. This shall include the current supply to any electrical controls on cooking appliances or electrical outlets under the hood. • All deep fat flyers shall be installed with at least a 16 inch space between the fryer and surface flames from adjacent cooking equipment. This may be accomplished by installing a 16 inch vertical steel plate between the fryer and adjacent cooking equipment that produce surface flames. The vertical steel plate must be installed to extend at least the full length of the deeper of the two appliances and may be attached to either appliance. • All pipe and fittings shall be of noncombustible material having physical and chemical characteristics compatible with the wet chemical solution. Galvanized pipe and fittings shall not be used.
