RE: ACTION OF BOARD AT PROBABLE CAUSE HEARING CONCERNING SPECIAL
REVIEW PERMIT#1098 - PRAIRIE MOUNTAIN PIPELINE COMPANY
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on the 10th day of February, 2003, a Probable Cause Hearing was held
before the Board to consider setting a Show Cause Hearing to determine whether or not Prairie
Mountain Pipeline Company, which is no longer in business, was in compliance with certain
Conditions of Approval and Development Standards contained in Use by Special Review Permit
#1098 for a Major Facility of a Public Utility for a 9.5-mile underground natural gas pipeline in
the A (Agricultural) Zone District, and
WHEREAS, records indicate the applicant did not satisfy the Conditions of Approval, the
plat was never submitted for recording, and the pipeline was not constructed, and
WHEREAS, after hearing testimony from the Department of Planning Services, the
Board finds that pursuant to the procedure as set forth in Chapter 2, Administration, of the Weld
County Code, there is sufficient probable cause to schedule a Show Cause Hearing to consider
whether or not said Use by Special Review Permit should be revoked for failure to comply with
certain Conditions of Approval and Development Standards, and
WHEREAS, the Board shall hear evidence and testimony from all interested parties at
said Show Cause Hearing.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that a Show Cause Hearing be scheduled to determine whether or not
Use by Special Review Permit#1098 issued to Prairie Mountain Pipeline Company, should be
revoked on the basis that records indicate the applicant did not satisfy the Conditions of
Approval, the plat was never submitted for recording, and the pipeline was not constructed.
BE IT FURTHER RESOLVED by the board that the date for the Show Cause Hearing
shall be March 17, 2003, at or about 10:00 a.m., in the First Floor Hearing Room of the Weld
County Centennial Center, 915 10th Street, Greeley, Colorado.

SUBJECT: Probable Cause Hearing for USR-1098
On October 10, 1995 Prairie Mountain Pipeline Company submitted an application for a 9.5 mile
underground natural gas pipeline. Records indicate that the Conditions of Approval were never finalized,
the plat was never recorded and the pipeline was never constructed. The Department of Planning
Services has been unable to locate a current address for Prairie Mountain and have been informed that
the Company is no longer in business. Planning Staff has made a diligent effort through countless phone
calls to local gas companies, companies listed in the original application and the Colorado Oil and Gas
Commission to locate anyone who may have an interest in Prairie Mountain Pipeline Company.
USR-1098 is a Site Specific Development Plan and Use by Special Review Permit for a Major Facility of
a Public Utility for a 9.5 mile underground natural gas pipeline in the Agricultural Zone District. The
preferred pipeline route was to begin approximately one mile east of Keenesburg, Colorado (the
southeast quarter of Section 24, T2N, R64W) in Weld County. The pipeline was to follow an overland
route running in a southeast direction through Weld County for approximately 9.5 miles, passing through
the following sections T2N, R63W, Sections 19, 30 and 31 and T1N, R63W, Sections 5,8, 17 16, 21, 22,
27, 26 and 35. The preferred pipeline route exits Weld County at the border between Weld County and
Adams County, approximately 3000 feet east of County Highway 79 (the center of the southern edge of
Section 35, T1 N, R63 W.)

never recorded. If it is determined at the public hearing that there is probable cause that the permit is not
in compliance with the Conditions of Approval and Development Standards, the Board of County

southern edge of Section 35, Ti N, R63 W.)
Records indicate that the Conditions of Approval were never finalized and the Plat for USR-1098 was
never recorded. If it is determined at the public hearing that there is probable cause that the permit is not
in compliance with the Conditions of Approval and Development Standards, the Board of County
Commissioners will schedule a Show Cause public hearing to consider revocation of the Special Review
permit.
