HomeMy WebLinkAbout20030696.tiff RESOLUTION RE: APPROVE RESUBDIVISION (LOT LINE ADJUSTMENT ONLY) OF NORTHMOOR ACRES, SECOND FILING, RS #1033 - HUBERT AND MARY CROWDER/ BARRY AND JUDY TAYLOR WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 17th day of March, 2003, at the hour of 9:00 a.m. in the Chambers of the Board for the purpose of hearing the application for a Resubdivision (Lot Line Adjustment Only) of Northmoor Acres, Second Filing, RS #1033, on the following described real estate, to-wit: Lots 1 and 2, Northmoor Acres, Second Filing; being part of the W1/2 of Section 24, Township 4 North, Range 68 West of the 6th P.M., Weld County, Colorado WHEREAS, said applicant was not present at said hearing, and WHEREAS, Section 24-5-30 of the Weld County Code provides standards for review of said Resubdivision (Lot Line Adjustment Only), and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendations of the Weld County Department of Planning Services staff and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24-5-30.B of the Weld County Code. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24-5-30.C of the Weld County Subdivision Ordinance including specifically: a. Section 24-5-30.C.4 -- The lot line revision complies with the approved recorded Final Plat. The lot line revision is to adjust the boundary between Lots 1 and 2 by moving the lot line 1.34 feet to the west to eliminate the encroachment of an existing barn into the utility easement. b. Section 24-4-30.C.4 -- Compliance with the adopted rules, regulations and ordinances currently in force and affecting the subdivision. There is one existing utility (Qwest) within the 25-foot utility easement. The applicants have received permission from Qwest to adjust the lot line. The existing 25-foot utility easement will remain in place and is in compliance with the minimum utility easement standard of twenty (20) feet as required in Section 24-7-60.A of the Weld County Code. 2003-0696 SUBD NORTHMOOR ACRES QC; Pt Ate, v�ctil, Z-(6°) r' RESUBDIVISION RS #1033 (LOT LINE ADJUSTMENT ONLY) - HUBERT AND MARY CROWDER/ BARRY AND JUDY TAYLOR PAGE 2 NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application of Weld County for a Resubdivision (Lot Line Adjustment Only) RS#1033, on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. Prior to Recording Resubdivision Plat: A. The plat shall be labeled RS #1033 Resubdivision of Northmoor Acres. B. The applicant shall submit two (2) paper copies of the plat for preliminary approval to the Weld County Department of Planning Services. C. The applicant shall submit a digital file of all drawings associated with the Resubdivision application. Acceptable CAD formats are .dwg, .dxf, and .dgn (Microstation); acceptable GIS formats are ArcView shapefiles, Arclnfo Coverages and Arclnfo Export files format type is .e00. The preferred format for Images is .tif(Group 4). (Group 6 is not acceptable). 2. Upon completion of Condition #1, the applicant shall submit a Mylar plat, along with all other documentation required as Conditions of Approval. The Mylar plat shall be recorded in the office of the Weld County Clerk and Recorder by the Department of Planning Services. The plat shall be prepared in accordance with the requirements of Section 24-4-40.D.6 through D.9 of the Weld County Code. The Mylar plat and additional requirements shall be submitted within sixty (60) days from the date of the Board of County Commissioners Resolution. The applicant shall be responsible for paying the recording fee. MINUTES OF THE WELD COUNTY UTILITIES ADVISORY COMMITTEE A regular meeting of the Weld County Utilities Coordinating Advisory Committee was held on Thursday, February 27, 2003, at 10:00 a.m.,in the Conference Room of the Weld County Planning Department at 1555 N. 17th Avenue, Greeley, Colorado. Members Present: Doug Dalton,Xcel Energy; Don Somer, Qwest; Cody Wooldridge, Central Weld Water District; Jerry Adams,Atmos Energy;Al Trujillo, United Power; Don Carroll, Weld County Department of Public Works. Doug Dalton called the meeting of the Weld County Utilities Advisory Committee to order. Kim Ogle, Planner, presented case RS-1O33, explaining that the purpose of adjusting the lot line is due to the fact that there is an existing barn that encroaches on the utility easements. Cody Wooldridge inquired if the owners of both Lots 1 &2 were in agreement to the lot line change? Mr. Ogle replied that the owners of both lots were co-applicants. Mr. Dalton polled the Utility Board members asking if they had any reservations about granting the applicant's request. There were no reservations voiced by any of the attending members of the committee. Mr. Wooldridge moved that the applicant's request be granted. Mr. Adams seconded. Motion carried.
