WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners has determined at a public hearing held on the 27th day of February, 1980 in the Chambers of the Board of County Commissioners of Weld County, Colorado, that a certain tract of land is owned by Mr. J. J. Prosser, which land is more particularly described as follows : Part of the Northwest Quarter, Section 10, Township 3 North, Range 68 West of the 6th P.M. , Weld County, Colorado. WHEREAS the owner of said tract of land desires to obtain a variance from the minimum lot size requirement so that said applicant may make application to the Board of County Commissioners for a recorded exemption, as set forth in Section 9-4 .A. (6) of the Subdivision Regulations, and WHEREAS, the Board of County Commissioners of Weld County, Colorado feels that the applicant has shown good cause for granting a lot size variance under Section 9-4 .A. (6) of the Weld County Subdivision Regulations . NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that a variance from lot size requirements be, and hereby is, granted to Mr. J. J. J. Prosser. The property on which this request has been made is described as Pt. NW4, Section 10, T3N, R68W of the 6th p.m. , Weld County, Colorado. This property is located 4 mile north of the Town of Mead. The property under consideration contains approximately 60 acres of class II and III irrigated soils. The request is to obtain a variance from the minimum lot size requirement, Section 9-4 A. (6) of the Weld County Subdivision Regulations, so that Mr. Prosser may make application for a recorded exemption. Mr. Prosser wishes to divide the improvements from the remaining property for the express purpose of marketing the property to achieve a divorce settlement. Based upon the information submitted and the adopted policies in the County, the Department of Planning Services staff recommends the request be approved for the following reasons : 1. The request is in compliance with the policies of the Weld County Comprehensive Plan in that to minimize conflicting land uses, residential development will be encouraged to locate adjacent to existing towns in accordance with the comprehensive plans and stated wishes of each community. The parcel of land is located within 4 mile of the Town of Mead. The Town of Mead Planning Commission has no objections to this request. • Board of County Commissioners LSV-107 :80:4 Page 2 February 27, 1980 2. The request conforms with the intent clause of the recorded exemption procedure and the intent clause of the Agricultural Zone District in that the uses will be compatible with surrounding agricultural uses. 3. This request complies with the provisions of Section 9-4 A. (6) of the Weld County Subdivision Regualtions because in the opinion of the Department of Planning Services staff the applicant has shown good cause for the variance. J. Prosser and Loretta Prosser. This land is identified as being the Sz of the South 100 acres of the NW4 of Section 10; Township 3 North, Range 68 West of the 6th P.M. , Weld County, Colorado. Shields Realty, Inc. has the property exclusively listed for sale. Robert W. Shields has been named as legal attorney-in-fact for the express purpose of making formal request to divide said sixty acres into two parcels. One parcel with all of the buildings and corrals being ten acres. The remaining fifty acres is presently in irrigated pasture. There will be a division of irrigation water appropriate for both parcels. I am told the above named owners have recently divorced and are therefore no longer husband and wife. The request of dividing subject land is for the express purpose of marketing - due to the necessity of settlement between the aforementioned owners. Mr. Prosser and Mr. Shields have met previously with the town council and zoning department of the Town of Mead; whereas, there was talk of subdividing subject land into ten - five acre parcels. We are told it will be required that Mr. Prosser and his representative meet with the Town of Mead to discuss the division of land prior to being heard by Weld County zoning and Weld County commissioners. We will therefore make every effort to meet with the Town of Mead for discussion. Please notify Mr. Shields as quickly as a meeting date, place and time are determined.
