Long, Chair Commissioner Robert D. Masden, Pro-Tern Commissioner M. J. Geile Commissioner William H. Jerke Commissioner Glenn Vaad Also present: Acting Clerk to the Board, Carol A. Harding Assistant County Attorney, Lee Morrison Planning Department representative, Jacqueline Hatch Health Department representative, Pam Smith Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated August 8,2003,and duly published August 14,2003, in the South Weld Sun,a public hearing was conducted to consider the request of Daryll and Carol Propp for a Site Specific Development Plan and Planned Unit Development Final Plan,PF#543,for seven (7)lots, Long's Peak Estates. Lee Morrison,Assistant County Attorney,made this a matter of record. Jacqueline Hatch, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Ms. Hatch stated this seven-lot Planned Unit Development(PUD)contains lots which range in size from 2.82 acres to 4.10 acres, with two outlots totaling 5.27 acres. She stated the surrounding properties are primarily subdivisions, including Scotts Acres directly east of the site, Parkland Estates, Peaks at Mountain View,and Carmacar Ranchettes within one mile of the site. Fifteen agencies reviewed the file proposal,and all responded favorably or included conditions that have been addressed through the Conditions of Approval, and no correspondence has been received from surrounding property owners. Ms. Hatch stated Left Hand Water District has indicated its ability and willingness to service the application,and sewage disposal will be provided by Individual Sewage Disposal Systems. Ms. Hatch showed pictures of the site. Responding to Commissioner Geile regarding any hazards since this is on top of an old mined area, Ms. Hatch stated it is a Geological Hazard area;however,the Colorado Geological Service has reviewed the proposal and requested two septic envelopes because of sink holes, and the Service will be contacted for review of Building Permits for Lots 3 through 7. Responding to Commissioner Masden, Ms. Hatch stated the site is 32 acres. Pam Smith, Department of Public Health and Environment,stated most lots will require an engineered septic system because of percolation rates and bedrock, and wetlands which are in one portion. She stated the two northern lots will be conventional systems; however, Lots 3 through 7 have shallow groundwater, bedrock, and low percolation rates. Because of the Geologic Hazard area, Ms. Smith stated most septic systems are fairly shallow,with a minimum of 4 feet of suitable soil,and there is no history of septic systems 2003-1929 PL1560 HEARING CERTIFICATION - DARYLL AND CAROL PROPP (PF #543) PAGE 2 collapsing because of old mining areas. Responding to Commissioner Geile, Ms. Smith stated each septic system is site specific, and an enhanced system might be required; however, that would be determined on a site by site basis due to issues with soil conditions that will affect the performance of septic systems,although an enhanced system would not be warranted for the entire site. Don Carroll, Department of Public Works, stated there are two accesses, one of which is from Weld County Road 12,which is a typical County designed gravel road with a 65 foot cul-de-sac on the end. He stated there is also an access connecting Scott's Acres,utilizing existing right-of-way, with adequate cul-de-sac turnaround and which will be a gravel cross section,26 feet wide,with four inches of gravel. The section over the Frico Ditch,will have some curb,gutter and asphalt installed to stop any drainage from running into the ditch from the road cross sections. Responding to Commissioner Geile, Mr. Carroll stated Peak View Road is the road which is the access from Scott's Acres,and it is a County maintained public road,as will be the roads in this subdivision. All the roads will be gravel. John Rinko, Rinko, LLC, represented the applicant and stated the applicant has decided that all roads in Long's Peaks Estates will be paved to County paving standards,including the internal road which is the access from Weld County Road12 south. He also stated the applicant will improve a section of the road coming down through Scott's Acres, which is the east/west portion which will cross the ditch. He said the road will transition to gravel at the ditch. Mr. Rinko stated the Farmers Reservoir and Irrigation Company approved the design of the ditch crossing and the internal road which will be built,as well as the utilities going underneath the road. He stated as a Condition of the Change of Zone,the applicant was required to do extensive studies of the mines and subsidence issues on the site, and many experts were hired to review the individual mines. Because of the studies,the roads, utilities, and all building lost were placed in areas where no subsidence impact is expected. Mr.Rinko stated the reports were submitted to the Colorado Geological Survey,which has approved the proposed envelopes and road layouts. Mr. Rinko stated there is a wetland in the corner which is dedicated as part of the open space. He said they submitted a report to the Army Corps of Engineers,who indicated it is not a regulated wetland; however,the applicant intends to maintain it as a wetland. Mr. Rinko stated to meet another Condition of the Change of Zone, the applicant is proposing to hard pipe the ditch laterals which are on their property, to minimize the maintenance for downstream users, and as a safety issue for the on-site crossings, and he is working on the agreement for that. Responding to Commissioner Masden, Mr. Rinko stated the subsidence issues do not restrict loans or insurance,although part of the Building Permit process requires a Geological Subsidence Permit, which should address any concerns. Commissioner Vaad reiterated the improvements needed at the point where the road crosses the ditch,to alleviate stormwater from running into the ditch,and stated that,as a Condition of Approval,the applicant is also required to provide the signed consultants drainage report. Mr. Rinko stated the preliminary report was submitted for review, and the final report will be submitted. Responding to Commissioner Vaad,Mr. Rinko stated retention of stormwater will be in two different places. One, as it runs naturally through the wetland currently, and the other area is south of the most easterly point of the PUD. Mr. Rinko stated the ditch is elevated, so it keeps stormwater and drainage out of the main ditch, which provides a shield around the eastern boundary of any on-flow of water. 2003-1929 PL1560 HEARING CERTIFICATION - DARYLL AND CAROL PROPP (PF #543) PAGE 3 No public testimony was offered concerning this matter, and responding to Chair Long, Mr. Rinko stated he agrees with the Conditions of Approval. Commissioner Geile moved to approve the request of Daryll and Carol Propp for a Site Specific Development Plan and Planned Unit Development Final Plan, PF#543,for seven (7)lots, Long's Peak Estates,based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval as entered into the record. The motion was seconded by Commissioner Jerke, and it carried unanimously. There being no further discussion,the hearing was completed at 10:45 a.m. This Certification was approved on the 8th day of September 2003.
