1. The lot shall have its own access; each access shall be designed to carry a
designed wheel load of 18000pounds (80000 pound gvw) (H2O loading).

The Weld County Public Works Department has reviewed this proposal; this project falls
primarily under the Use by Special Review Standards. Weld County Code, Chapter 23, Article
II, Division 4, Section 23. Our comments and requirements are as follows:
COMMENTS:
Access: WCR 17 at this location has been annexed by the City of Greeley.
REQUIREMENTS:
Access: The applicant should verify with the City of Greeley that the 60-foot access easement
is subject to additional requirements that may be necessary to obtain or upgrade the access at
this location.
Easement: The plat drawing is identifying the 60-foot access easement as per Book 648,
Recording 1570019. The applicant shall obtain signatures from the adjacent property owners
utilizing the existing 60-foot access easement notifying them that the use will be changing to
accommodate heavy duty truck hauling of landscaping materials and additional traffic. The
signatures of the adjacent property owners shall be provided to Planning Services and the
Public Works Department for verification.
Off-Street Parking: The off-street parking including the access drive shall be surfaced with
gravel or the equivalent and shall be graded to prevent drainage problems. Each parking
space adjacent to the building shall be equipped with wheel guards or curb stops where
necessary to prevent vehicles from extending beyond the boundaries of the space and from
coming into contact with other vehicles, walls, fences, or plantings.
Storm Water Drainage: The historical flow patterns and run-off amounts will be maintained on
site in such a manner that will reasonably preserve the natural character of the area and prevent
property damage of the type generally attributed to run-off rate and velocity increases,
diversions, concentration and/or unplanned ponding of storm run-off.

Thank you for the opportunity to comment on this USR for a landscaping yard in the Agricultural Zone
District. The City of Greeley Planning staff has reviewed the application and wish to forward the
following comments:
1. Outdoor storage should not be permitted within any applicable setback, public right-of-way, or in
landscaped areas.
2. Items not customarily used or stored outside or made of a material that is resistant to damage or
deterioration from exposure to the outside environment should not be placed, stored, or
maintained outside for a period in excess of 24 consecutive hours.
3. The access drives and parking areas should be paved with asphalt or concrete to reduce the
development's impact on air quality.
4. A landscaping buffer yard should be provided to ensure that the proposed use provides sufficient
buffering and screening to effectively shield neighboring properties. In addition a buffer yard
should be provided between the future residence on-site and the proposed use.

Environmental Health Services has reviewed this proposal for a Landscaping Materials
Yard. We have no objections to the proposal, however, in reviewing the application we
observed that the applicant is proposing portable toilets to be used. The proposed
sewage disposal facilities does not comply with the Weld County Code (30-2-10). The
Weld County Code states that the owner shall supply an adequate, convenient, sanitary
toilet and sewage disposal system where people live or work or congregate.
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. If applicable, the applicant shall submit an Air Pollution Emission Notice
(A.P.E.N.) and Emissions Permit application to the Air Pollution Control Division,
Colorado Department of Health and Environment for emissions of criteria,
hazardous or odorous air pollutants.
2. Submit a dust abatement plan to the Environmental Health Services, Weld
County Department of Public Health & Environment, for approval prior to
operation.
We recommend that the following requirements be incorporated into the permit as
conditions that must be met prior to the issuance of the Certificate of Occupancy:
1. An individual sewage disposal system is required for the proposed use and shall
be installed according to the Weld County Individual Sewage Disposal
Regulations.
2. The septic system is required to be designed by a Colorado Registered
Professional Engineer according to the Weld County Individual Sewage Disposal
Regulations.

We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved dust abatement
plan at all times.
5. This facility shall adhere to the maximum permissible noise levels allowed in the
Commercial Zone as delineated in 25-12-103 C.R.S., as amended.
6. The facility shall utilize the existing public water supply.
7. Adequate handwashing and toilet facilities shall be provided for employees and
patrons of the facility.
8. Any septic system located on the property must comply with all provisions of the
Weld County Code, pertaining to Individual Sewage Disposal Systems.

A Site Specific Development Plan and a Special Review Permit for a business permitted as a
Use By Right or Accessory Use in the Commercial Zone District (Landscaping Materials Yard)
in the A (Agricultural) Zone District.
USR-1430
1. A building permit shall be obtained prior to the construction of any building.
2. A plan review is required for each building for which a building permit is required. Except for
simple pole type structures, plans shall bear the wet stamp of a Colorado registered architect or
engineer. Two complete sets of plans are required when applying for each permit.
3. Buildings shall conform to the requirements of the various codes adopted at the time of
permit application. Currently the following has been adopted by Weld County: 1997 Uniform
Building Code; 1998 International Mechanical Code; 1997 International Plumbing Code; 2002
National Electrical Code and Chapter 29 of the Weld County Code.
4. Except for pole type structures, each building will require an engineered foundation based
on a site-specific geotechnical report or an open hole inspection performed by a Colorado
registered engineer. Engineered foundations shall be designed by a Colorado registered
engineer.
5. Building height shall be measured in accordance with the 1997 Uniform Building Code for the
purpose of determining the maximum building size and height for various uses and types of
construction and to determine compliance with the Bulk Requirements from Chapter 27 of the
Weld County Code. Building height shall be measured in accordance with Chapter 23 of the
Weld County Code in order to determine compliance with offset and setback requirements.
Offset and setback requirements are measured to the farthest projection from the building.
6. A Flood Hazard Development Permit shall be submitted for buildings constructed within the
100-year flood plain.

Dear Ms. Lockman:
The Town of Windsor Planning Commission reviewed this referral at its regular meeting of
June 5, 2003. The subject property is located within the Town's Growth Management Area.
The subject property is depicted as High Density Estate Residential (E-2) on the Town's
Land Use Plan map. High Density Estate Residential, which corresponds to the E-2 Estate
zoning district, is intended "to provide for highly concentrated single-family residential
subdivision development which utilizes public water and sewer services and provides for
such development to be served by community facilities which are compatible with the
district." (Windsor Comprehensive Plan, April 2002)
However, residential development of the subject property in the near future is unlikely, due
to its location.
Based upon the aforementioned information, the Town of Windsor Planning Commission
recommends approval of the Use by Special Review to the Weld County Department of
Planning Services.

The sheriffs office has no concerns with this Special Use Permit. The sheriff's office
would however be willing to provide a program entitled Crime Prevention Through
Environmental Design to the developer. This program reduces the likelihood of criminal
activity at a specific location by"hardening" it to crime.
The Sheriffs Office lacks the ability to absorb any additional service demand without the
resources recommended in the multi-year plan provided to the Board of County
Commissioners or as indicated by growth not considered at the time the plan was
developed. I have no other comments on this proposal.
