RE: HEARING TO SHOW WHETHER GOOD CAUSE EXISTS FOR REVOCATION OF USE BY
SPECIAL REVIEW PERMIT #654 FOR A FERTILIZER STORAGE, MIXING, LOADING,
AND SALES OPERATION - PERMAGREEN PRODUCTS COMPANY, C/O ROXY
VENDENA
A public hearing was conducted on April 7, 2003, at 10:00 a.m., with the following present:
Commissioner David E. Long, Chair
Commissioner Robert D. Masden, Pro-Tem
Commissioner M. J. Geile
Commissioner William H. Jerke - EXCUSED
Commissioner Glenn Vaad
Also present:

The following business was transacted:
I hereby certify that pursuant to a notice dated November 1, 2002, and duly published November 6,
2002, in the Tri-Town Farmer and Miner, a Show Cause hearing was conducted on November 18,
2002, to consider vacation of Use by Special Review Permit #654 for Permagreen Products
Company for a Fertilizer Storage, Mixing, Loading, and Sales Operation. The Board deemed it
advisable to continue the matter to February 3,2003,to allow Permagreen Products Company, do
Roxy Vendena, adequate time to submit a Design and Operations Plan, as well as complete any
additional requirements of the Departments of Planning Services and Public Health and
Environment. At said hearing on February 3, 2003, the Board deemed it advisable to continue the
matter to April 7, 2003, to allow the operator additional time to complete the requirements of the
Departments of Planning Services and Public Health and Environment,as well as the requirements
of the Colorado Department of Public Health and Environment. At said hearing on April 7, 2003,
Lee Morrison, Assistant County Attorney, made this a matter of record. Cindi Etcheverry,
Department of Public Health and Environment, gave a brief description of the location of the site,
and stated this case was initiated as a result of several complaints regarding a fire. Upon
inspection of the site, several violations were noted and she gave a brief summary of events to
date. Ms. Etcheverry referenced a memorandum to the Board, dated April 3, 2003, marked
Exhibit D. She stated staff recommends the matter be continued for sixty days to address the
remaining outstanding issues. In response to Commissioner Vaad, Mr. Morrison suggested the
matter be continued to a date certain, with that hearing to be dismissed if the applicant completes
the remaining issues.

Thomas Haren,AgProfessionals,stated he started working on this project one month ago,and after
reviewing the work that had been done to this point, he determined it would be better to start over.
He stated 60 days will be sufficient for him to complete the work. Responding to Commissioner
Masden, Mr. Haren stated he agrees to complete the Drainage Plan within 30 days and the Design
and Operations Plan in 60 days. He further stated he has drafted the Design and Operations Plan
and there are new regulations which should resolve some of the other outstanding issues. No
public testimony was offered concerning this matter.
Commissioner Geile moved to continue the Show Cause Hearing to consider the revocation of a
Site Specific Development Plan and Use by Special Review Permit#654 for a Fertilizer Storage,
Mixing, Loading, and Sales Operation for Permagreen Products Company, to June 9, 2003, at
10:00 a.m. The motion was seconded by Commissioner Vaad. There being no further discussion,
the hearing was completed at 10:40 a.m.
This Certification was approved on the 9th day of April, 2003.
