However we expect this not to happen we planned ahead and we will fence off an area large enough to accommodate people if we were to surpass the number of people expected. 7. Tubs of bottled water will be placed on property to benefit our guest. Bottled water will be sold as well as other drinking beverages like soda and juice. Please see attached drawing for tub locations. 8 cubic-yard dumpsters will be placed in locations that are beneficial to the event for dumping. Waste Management will provide the service for disposing the waste. (Waste Management 500 E. Vine Dr. Ft. Collins, CO 80524 970- 416-3552) The measures of the dumpsters are 6'A ft. tall x 6ft. wide. Also sinks will be provided by Super Bowl Portable Restrooms Incorporated (3263 Oakland St. Aurora, CO 80010 303-341-6828) Attached is a letter stating that Super Bowl Restrooms Incorporated will provide this service. 8. Waste Management will provide 8 cubic dumpsters to accommodate the disposing of garbage. They will also service and dispose of any waste collected at the event. (Waste Management 500 E. Vine Dr. Ft. Collins, CO 80524 970-416-3552) 9. Super Bowl Portable Restrooms Incorporated (3263 Oakland St. Aurora, CO 80010 303-341-6828) will provide toilet facilities for males and females. They clean and service all portable restrooms and also provide sinks and portable restrooms to accommodate any handicap people attending the event. Attached is a letter stating that Super Bowl Restrooms Incorporated will provide the portable restrooms and service for the event. 10. An application has been submitted to the Mountain View Fire Protection District so that they can provide any paramedic service or emergency service for the event. 11. The property will not need to be illuminated because the event will be taking place outside and during daylight hours. Sat. September 13, 2003 from 11 AM till 8 PM. 12. The parking lot will be 300 ft. x 500 ft. in size and a second parking lot for performers or vendors that is 200 ft. x 100ft in size. There are 5 roads leading to the event from County Line Rd. 1 and County Rd. 36. There 3 emergency roads that are 20 ft wide for emergency vehicles only. 4 roads lead to County Line Rd. 1. Two of them are for the general public the other two roads are for emergency use. 1 road leading to County Rd. 36 is for emergency Rd. use only. See sketch attached for any more information. 13. Cell phones will available for emergency use to communicate any accident or any emergency service needed. Orozco Security Agency will also have cell phone communication available for any emergency that needs to be reported. The Mountain View fire Protection District will also be present upon review of application. 14. N/A 15. Plans for fire protection include having certified fire extinguishers on the property, no smoking on property, the Mountain View Fire Protection District to be present upon review of application. Also the tent being put up by Rental City is fire proof (Certificate of Flame Resistance is attached). 16. Attached is a letter of verification by Orozco Security Firm, insurance certificate, license, and a bond. 17. Attached is a sketch and set up plans for stage and sound to be used. I want to express my strong opposition to this proposal. It is unimaginable how a development of this magnitude could even be proposed or considered on Ag zoned land. My family has lived in Weld County since before 1885 when my Grandfather was born here. My husband and I purchased and built at this location, 16882 WCR 1, knowing that the surrounding land was zoned Ag and thinking that the zoning would not allow commercial developments such as banquet halls or other establishments that served food ana alcohol. I never received any notice, which I am now told was mailed to me. Finally after finding out Mead had been notified I was able to pick up a copy from them. I wish to express my views concerning the answers on the USR questionnaire. USR Questionnaire L Commercial development, such as the one proposed, does not belong on Ag zoned land and should require a zone change, which I would oppose. 2. The majority of the surrounding properties are not equestrian influenced properties. The land north is pasture,the land east is farm land for miles. My land to the south is pasture land for cattle. Only some of the land west in Boulder County could be considered equestrian influenced. It would be impossible to blend in a 30,000 square foot event center, plus rodeo grounds for 500, plus 1180 parking spaces into the surrounding community. Period. Let alone do it without infringing on the "country living"atmosphere. 3. It's great the buildings would be constructed to the building code, but they also need the proper zoning. 4. The property to the south, my 75 acres, is not an equestrian type lot. Even the property to the south of me "Summit View Estates"has only one or two horse properties that are used to keep two or three horses. The rest are upscale county homes. 5. (a) County Line Road is already inadequate to handle the large volume of traffic it now has. It is fast becoming congested with the commuter traffic between Longmont, Berthoud, Loveland and other points north and south, barley trucks to Coors Elevator, the farm trucks and other slow moving farm machinery, and the large number of gravel trucks that use it every day. Can any one imagine 1,500 more auto and horse trailers plus delivery trucks and vans converging on the property at the same time? (b)Also food service would have to be brought in, according to the application, and the help to serve,all additional traffic. (c) The use of the rodeo grounds during the summer, causing dust pollution, light pollution, and noise pollution, could not help but interfere with the rural country atmosphere. (d) Portable toilets for this number? (e) I would think it would be impossible to have a rodeo with only 20 animals. It takes 2 animals each time a calf is roped, 3 animals each time a steer is bulldogged say nothing of the bucking events and whatever else is planned Unless they are going to use the same poor animal over and over again. I thought this was against all rodeo rules, as it is considered animal cruelty. The animal right activists are against all rodeos. With all the expense for construction of the rodeo facilities and the paved parking for 1,000 spectators and participants it is hard to believe there will be only 20 animals. The 5 acres of pasture(showing on the site plan)would be trampled to blow dust in no time with a lot less than 20 animals. (f) Proof of the traffic. (g) Who will furnish the on site ambulance required by most rodeos in case of injury? (h) How large of water tap will be required? (i) What health department would possibly approve a septic system to handle 1,000 people? (j) Means more traffic. 6. It is impossible for a few trees and shrubs to control the erosion caused by anything of this magnitude. I suppose the disturbed land will be re-vegetated like it was after the July event. This was 0. The dust is still blowing. 7. T -is question was applicable for the Special Review Activity held on this same property in Jul). No reclamation was ever done for the -use by special review" permit that was granted for the July event hell across the fence from my property. The trash cans, black plastic sacks, blowing dust and thousands of feet of bright orange fencing are still there. I thought they were to be removed when the event was over. 8. Have you ever smelled the stench from an animal holding pond? 9. Construction work! What dust mitigation will be required for this stage of development? Who will enforce it? 10. Who will see to it that the people using the facility put their trash in the dumpsters in the first place? Or will it be like the July event when the neighbors were expected to pick it up late? I'm a widow and past 70. Once to pickup their trash was enough for me. I could let it blow on to the next neighbor, I guess, except for the beer bottles and cans. It is our opinion these activities are not conducive nor compatible with the current agricultural land use. We feel the requested uses appear more "commercial" and do not belong in an area that is totally"agricultural." Mr. Rodriguez has established a poor track record with his recent "Festival." My husband contacted Kim Ogle of the county Planning office regarding questions about the - —festival. Mr. Ogle left a message on my answering machine and stated...they had a permit for the festival, and the area was to be left "clean as a whistle." As of this date, the land is still littered with trash. If Mr. Rodriguez cannot comply with a one time permit, how can anyone expect him to honor the terms and conditions of a Special Use Permit? �p Also, there was alcohol served at the "Festival." My neighbor said he was behind d� someone who had pulled out of the festival, and followed them for 3 miles while they were weaving on the road. Is the Weld County Sheriff's Dept. staffed to handle the added burden this will place on them? Are all other agencies prepared for a facility of this type? Weld County Rd. 1 is a 2 lane road that is already heavily traveled. Is the county prepared to widen and improve the road to handle the additional traffic this facility will generate? We are very much opposed to this facility. This area is mainly used for farming with a lot of slow moving tractors and trucks. The traffic impact on county line road 1 would be horrendous. Where county road 34 and I meet is at the top of a little hill which is hard enough to see traffic coming. Where county road 36 and 1 meet is at the bottom of a little hill and again hard to see coming traffic. The event that was held on this property in July was very loud. I could hear everything that was going on standing outside my house. I have driven by there since the event and was surprised to see all the trash, trash cans, and fencing that was still up. I was told that the property was to be reclaimed. Does that mean that they have to take out the entire rock base hauled in for the parking lot? I was also informed that they plan on having no more than 20 animals at a time at the rodeo. If this is true why build 960 stalls? There is already a fair grounds and rodeo arena in Longmont. The first is an application for a varience from agricultural status to have a banquet hall and equestrian center east of CR 1 and north of CR 34. There was a party held there the weekend of July 19-20 and although I was not home at the time to assess the situation (noise), my neighbors called me because of their concern about the traffic. Cars were backed up almost to Rte 66 and many cars were parked on the side of the road, especially on the hill which makes for a dangerous situation. The aftermath of the party that I see every time I drive by is a field littered with cans, bottles, paper and plastic. The second concern is the remote control airport east of CR 1 and north of CR 36. People move out to the country for the peace, quiet and lack of traffic. With these planes flying around, there is a constant annoying droning whenever I am out of doors. I hope my concerns will be considered at the hearings for these two issues. Thank you. The Town's specific objections are as follows: 1. This is an inappropriate land use for this location. This is a commercial operation, and the scale of it is out of character with the surroundings. This is the equivalent of re- zoning the property without in fact re-zoning it. There is no current justification for a commercial use at this intersection. 2. The traffic impact of this proposed use on the existing road network is significant, particularly peak flows associated with special events types of uses, and the road network cannot handle such. 3. This type of use would generate significant noise and it is our understanding that the County has little, if any, noise regulations. The hours of operation until midnight would substantially impair the quality of life of its residential neighbors. 4. There would be a substantial negative effect on fire protection and general public health and safety. 5. There is no local benefit to this proposed use. It appears to be designed to bring in people from as far away as Denver for mainly the benefit of a radio station and its audience. Such types of facilities should be located on major arterials with easy access to an urban or suburban area, and not placed in a rural location. ,' 6. The site had a special equestrian event the weekend of July 19-20 under some form of special permit issued by the County, which detrimentally affected adjacent neighbors, from noise to traffic, without any consideration for their well-being. The site was degraded as well, and over a week later there remains trash, temporary fencing pieces, and othe- remnants of activity on the site which shows no regard for the neighbors and no effort to properly clean up. The County either did not impose proper co.idi,ions on the use or did not follow-up with clean-up and policing oversight, or some combination thereof. The Town is therefore opposed to the issuance of any more special events permits for this site without adequate regulation. If you have any questions, please feel free to contact me. My father William and I own 98 acres of property less than a mile from the proposed"events center" and we would like to express our opposition to the proposed special use permit. Our family has lived on this property for 27 years and we have made a variety of sacrifices to establish and maintain a quality of life that is important to us personally, as well as from a property value perspective. The proposed facility is located in an area with over 20 current home owners who have made significant investments in their property based on the solitude and natural beauty of the surrounding area. This facility will erode _. _ that investment due its appearance, the traffic hazards and the noise that it will generate. Consider the following factors before rejecting this proposal; 1) Traffic. A facility of this size will generate a huge quantity of new traffic in the area with the associated noise, driving hazards and air pollution. The facility is planned for a stretch of road with blind hills at both ends, no turn-out lanes and no traffic signal. This will create a hazardous and inconvenient situation for those who depend on this road for access on a daily basis. It should also be noted that at a"special event"hosted at this location on July 19a' and 20a'there was a large beer vending operation and one can only assume that of the over 1000 attendees there were intoxicated drivers leaving the facility. This is a real risk associated with the proposed"Events Center"(even if there is no alcohol served at events it is reasonable to assume that attendees will bring their own alcohol and that once inebriated will pose a risk to home owners and drivers in the area). 2) Noise pollution. This facility is planned for an area of Weld County that has very little protection for existing residents in the way of noise ordinances. It is my understanding that"outdoor equestrian facility" is for the purpose of hosting rodeos and other events that are typically accompanied by large scale crowd noise and outdoor public address systems. In an area such as this, sound carries very well and this noise will negatively impact neighbors for miles around the facility. 3) Appearance. This proposal calls for a variety of efforts that will `blend the events center and its acreage with the surrounding community, without infringing on the `country living' atmosphere enjm°ed by the local residents...' We believe that the intent of this owner can be bait judged by his actions than the unrealistic statements made in this proposal. If you have not taken the opnor tunity to view the site recently then please make the drive. You will see the remnants of the previous"special event"held at this location on the 19th and 20th of July. As of this writing(24 days following the party)the site is still littered with beer cans, bags of garbage, hanging banners and orange plastic"snow fence"that was used for crowd control at the event(see enclosed prints). We can only assume that this new facility will be maintained with the same lack of rigor that the property owner has demonstrated in the past. We believe that this special use permit application is simply an attempt by Jessie Rodriguez to"fly under the radar"and create an entirely commercial facility in an agriculturally zoned area. The activities planned for this facility would be more appropriate if hosted at a county fairgrounds facility with adequate infrastructure to protect the public safety and quality of life. At a meeting of the Mead City Council earlier this month it was made clear that Mead has no desire to adopt the responsibility for emergency services and police protection for this facility and their opposition to this permit was to be submitted to Weld County in writing following the meeting. We are not opposed to reasonable growth and development as long as it is aligned with the values of the existing community. This proposed facility is completely incompatible with the area and granting this permit will significantly damage the existing property owners. Diggins, and I own 85 acres approximately one mile from the proposed venue. I would like to express my extreme disapproval of the plan under review for the upcoming September 16`x'meeting. For your benefit- I am outlinning some of the more significant concerns that I have that will hopefully be factored into the county's consideration to unilaterally reject this proposal. ■ Intent: The proposed special events center is not an aligned with the interest of the surrounding homesteads, and agricultural community. Establishment of this Rodeo Events Center is an extreme infringement upon the country living and atmosphere that claims it is attempting to protect. As you know,that section of county line road 1 is one of the most idyllic and picturesque sections of Weld and Boulder County. Many of the residents have lived and farmed this section of the county for decades. Mentioning that this initiative is similar to the surrounding equestrian and home sites is beyond laughable! • Traffic: The proposal calls for 1,500 people seating. (Indoors/outdoors) This will turn the county line road into an events center on a par with the pre-existing county fairgrounds in Longmont. An incredible volume of cars and trailers will choke the throughput of that section of county line road. Weddings, birthday parties, and bar mitzvahs are window dressing to something that could easily take on a Frontier Days look and feel similar to the events sponsored in Cheyenne, Wyoming. • Surrounding Properties: The proposal offers 30-74 acres of buffer to protect the natural habitat and communities in the area. The kind of buffer this center needs would require much further isolation and impact studies than the fragile county line road could provide. Noise and dust would problematic day one. The road system would have to be radically redesigned to enable safe entry/exit. Most likely, a traffic light would have to be installed. Lack of irrigation would complicate the planning requirement. Massive landscaping would be mandatory to buffer unsightly mass parking and large outbuildings required. In summary, I sincerely believe this initiative will significantly devalue the homes and properties in this area. The quality of life in Weld and Boulder County along County Line Road 1 will seriously depreciate. The illusion in the proposal of soft impact and harmony to the local property owners is an insult to the intelligence of those that have worked very hard to protect and build value to their properties. This is an Agricultural Zone, not Commercial. It would destroy the value of all the property in this area which has, up to this time, been developed for agriculture and upscale homes. If an Events Center, including indoor and outdoor facilities, is allowed, there will be public address systems, lots of noise, traffic and trash, as evidenced by what happened when a one time event was approved a couple of weeks ago on this property. In addition __to,excessive noise and traffic, the trash has still not been totally cleaned up. We feel this would no doubt ruin the quality of life of all who have bought their property in this area in good faith, trusting the zoning restrictions would be upheld due to the credibility of Weld County. We all built homes in the country in order to get away from the noise and traffic and trash. And, at the same time, the approval of this type of use of the property would also make all the homes around this Events Center impossible to sell with any value. Please consider these points before you approve destroying a nice, beautiful area.
