HomeMy WebLinkAbout840061.tiff RESOLUTION RE: APPROVE CONTINUANCE OF HEARING FOR CHANGE OF ZONE, A (AGRI- CULTURAL) TO I-3 (INDUSTRIAL THREE) - PATTERSON' S PUMPING SERVICE, INC. WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , a hearing for a Change of Zone, from A (Agricul- tural) to I-3 (Industrial Three) , requested by Patterson' s Pump- ing Service, Inc. was scheduled for May 30 , 1984 , at 2 : 00 p.m. , and WHEREAS , only four Commissioners were present at the hearing of May 30 , 1984 , and WHEREAS , the applicant requested that this matter be con- tinued to a date when all five Commissioners will be present, and WHEREAS, after consideration, the Board deems it advisable to approve the request for a continuance of this matter to June 6, 1984 , at 2: 00 p.m. , and WHEREAS , at the hearing of May 30 , 1984 , testimony was heard from those interested persons who wished to testify. NOW, THEREFORE , BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the Change of Zone hearing requested by Patterson' s Pumping Service, Inc. be, and hereby is, continued to June 6 , 1984 , at 2: 00 p.m. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 30th day of May, A.D. , 1984 . 0....4 BOARD OF COUNTY COMMISSIONERS ATTEST: Qua. A public hearing was conducted on May 30 , 1984, at 2:00 P.M. , with the following present: Commissioner Norman Carlson, Chairman Commissioner Jacqueline Johnson, Pro-Tem Commissioner Gene Brantner - Excused Commissioner Chuck Carlson Commissioner John Martin Also present: Acting Clerk to the Pcird, Mary Reiff Assistant County Attorney, Lee D. Morrison Planning Department Representative, Rod Allison The following business was transacted: I hereby certify that pursuant to a notice dated March 28, 1984, and duly pub- lished in the La Salle Leader on April 12, 1984, and May 3, 1984, a public hear- ing was conducted to consider the application of Patterson's Pumping Service, Inc. for a Change of Zone, A to I-3. Chairman N. Carlson commented that only four Commissioners were present and the procedure to be followed in the event of a tie vote. He also stated that the applicant could request a continuance to a date when all five Commissioners will be present. Lee Morrison, Assistant County Attorney, read the application into the record, stating that is was previously continued fran May 16, 1984, because only three Commissioners were present at that hearing. Rod Allison, Planning Department representative, read the recan- mendation of the Planning Commission into the record. Mr. and Mrs. Patterson were present and Mrs. Patterson requested a continuance until all five Commissioners will be present. Commissioner Johnson noticed people in the audience who had also been present when it was postponed earlier and wondered if they would wish to testify today. John A. Knnzman, secretary of the Platteville Irrigating and Milling Company, came forward to make comments. He stated that the ditch company objects to additional bridges crossing the ditch due to the extra costs involved. Tape Discussion was held about the possibility of a Use by Special Review rather than Change a Change of Zone for this area. Mrs. Patterson stated that they would really 84-47 prefer to have the zoning on this land changed and commented on nearby parcels of ground which have been rezoned. She stated that there are no water rights with this property, so it is of no value agriculturally. Following further discussion, Commissioner C.
