Navarro-Action Pursuit Paintball LLC
The Weld County Public Works Department has reviewed this proposal; this project falls primarily under the purview of the
Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Our comments and
requirements are as follows:
COMMENTS:
Access: The Colorado Department of Transportation (CDOT) has jurisdiction over all accesses to the state highways.
Please contact Gloria Hess-Idler or Tess Jones at the Greeley office to verify access permit or for additional requirements
that may be necessary to obtain or upgrade the permit.
Diane Houghtaling, traffic engineer for the applicant, has contacted CDOT and provided vehicle documentation to address
left turn, deceleration, and acceleration lanes that may be necessary at this location. CDOT has granted a waiver on the
full deceleration/acceleration lengths.
REQUIREMENTS:
Access: Verification shall be required from CDOT on any laborers associated with the USR use.
Parking: Utilizing the sketch plan provided by the applicant, the parking area measures 150 feet x 350 feet, which
calculates to approximately 1.2 acres. If vehicles are parked properly, one acre will accommodate approximately 100
vehicles. The applicant shall identify some overflow parking to accommodate the maximum number of parking spaces
required.
Off-Street Parking: The off-street parking spaces and the access drive shall be surfaced with gravel, asphalt, concrete
or the equivalent and shall be graded and drained to prevent drainage problems and accommodate all-weather access.
The parking lot shall conform to all standards with the American Disability Act (ADA). The amount of parking spaces for
ADA shall be determined by Planning Services.
Each parking space shall be equipped with wheel guards or curb stops where needed to prevent vehicles from extending
beyond the boundaries of the parking spaces and coming into contact with other vehicles, walls, fences, or plantings.
The applicant shall place on the drawing the parking detail identifying parking and circulation throughout the proposed
parking and overflow parking area.

There shall be staging or parking on U.S. Highway 85. Utilize the internal parking areas identified on the plat.
Storm Water Drainage: The applicant shall use the historical flow patterns and run-off amounts will be maintained in
such a manner that will responsibly preserve the natural characteristics of the area and prevent property damage of the
type generally attributed to run-off rates and volumes increase, diversions, concentration, and/or unplanned retention of
storm water run-off.
Retain and release at the historical rate as not to damage adjacent properties. EXHIBIT

Environmental Health Services has reviewed this proposal for a commercial recreational
facility- paintball park. We have no objections to the proposal, however, we do
recommend that the following conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall provide evidence that water is supplied by Central Weld
Water District for drinking and sanitary purposes.
2. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as
conditions that must be met prior to the issuance of the Certificate of Occupancy:
1. An individual sewage disposal system is required for the proposed facility and
shall be installed according to the Weld County Individual Sewage Disposal
Regulations.
2. The septic system is required to be designed by a Colorado Registered
Professional Engineer according to the Weld County Individual Sewage Disposal
Regulations.
3. The installation of the septic system shall comply with the Weld County I.S.D.S.
flood plain policy.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, blowing debris, and other potential nuisance conditions.
4. Fugitive dust shall be controlled on this site.
5. This facility shall adhere to the maximum permissible noise levels allowed in the
Commercial Zone as delineated in 25-12-103 C.R.S., as amended.
6. The applicant shall operate in accordance with the approved "waste handling
plan".
7. The facility shall utilize the existing public water supply.
8. Adequate handwashing and toilet facilities shall be provided for employees and
patrons of the facility.
9. Any septic system located on the property must comply with all provisions of the
Weld County Code, pertaining to Individual Sewage Disposal Systems.
10.Adequate portable toilet facilities (port-a-potty) and portable handwash facilities
shall be provided during the construction of the facility, not to exceed 6 months.
11.Additional portable toilet facilities shall be required during special events. The
number of portable toilets will be dependent on the number of participants and
spectators at the facility.

12.In the event the applicant intends to serve potentially hazardous foods (ice is
included in this definition), the applicant shall comply with Colorado Retail Food
Establishment Rules and Regulations governing the regulation of food service
establishments.

1. A separate building permit for each building shall be obtained prior to any construction.
2. A plan review is required for each building. Plans shall bear the wet stamp of a Colorado
registered architect or engineer. Two complete sets of plans are required when applying for
each permit. The proposed buildings would probably be considered assembly occupancies
according to the building code. In order to properly apply various provisions of the building
code, provide complete information as to the scope and intensity of the use for each building
when applying for building permits.
3. Buildings shall conform to the requirements of the various codes adopted at the time of
permit application. Currently the following has been adopted by Weld County: 1997 Uniform
Building Code; 1998 International Mechanical Code; 1997 International Plumbing Code; 2002
National Electrical Code and Chapter 29 of the Weld County Code.
4. Each building will require an engineered foundation based on a site-specific geotechnical
report or an open hole inspection performed by a Colorado registered engineer. Engineered
foundations shall be designed by a Colorado registered engineer.
5. Building height shall be limited to the maximum height allowed per UBC Table 5-B. Wall and
opening protection and limitations shall be in accordance with UBC Table 5-A. Separation of
buildings of mixed occupancy classifications shall be in accordance with UBC Table 3-B and
Chapter 3. Setback and offset distances shall be determined by the Zoning Ordinance.
6. Building height shall be measured in accordance with the 1997 Uniform Building Code for the
purpose of determining the maximum building size and height for various uses and types of
construction and to determine compliance with the Bulk Requirements from Chapter 27 of the
Weld County Code. Building height shall be measured in accordance with Chapter 23 of the
Weld County Code in order to determine compliance with offset and setback requirements.
Offset and setback requirements are measured to the farthest projection from the building.

7. A Flood Hazard Development Permit shall be submitted for buildings constructed within the
100-year flood plain.

Mr. Navarro:
This letter is in response to your request for variances to required oil well setbacks and fire flow for your proposed
building '/2 mile west of WCR 47 on Highway 34. After much thought and consideration by both myself and the
Fire Marshal, we submit to you the following interpretations:
1. Fire flow required for your building is 3,750 gallons per minute for a duration of 3 hours according to the
Fire Code. We are willing to allow a decrease from the required amount in accordance with Section 3.1
of Appendix III-A of the Fire Code. We will permit the installation of a single fire hydrant at the entrance
to the facility; however, some sort of documentation shall be attached to the Title that indicates that any
changes in the use or fire loading of the building may require additional fire flow than that which is being
allowed for your proposed use.
2. Currently,the Fire Code requires a minimum separation of 350 feet between newly constructed buildings
and any well heads,production tanks,and/or associated on-site production equipment. The only decrease
in this setback that we will allow must be from the State of Colorado Oil and Gas Commission. Although
we appreciate the letter from the attorney representing Merit Energy Corporation to allow you to building
within the setback,they cannot grant exception to adopted Fire Code requirements nor State regulations,
Should the State Oil and Gas Commission allow a reduced setback, a letter from them shall be forwarded
to our office on official letterhead stating such exception_

Mr. Gathman,
The City of Greeley Planning Staff has reviewed the following Use by Special Review revision for a
Paintball Park and wish to forward the following comments and concerns:
1. Items stored outside should be screened from the view of the public right-of-way through the
use of landscaping, or a solid fence, or through a combination of both.
2. Parking shall be located out of the setbacks and should be required to be on a paved surface.
3. A landscaping buffer should be provided adjacent to Highway 34. A landscape buffer should
also be provided for the adjacent residential properties.
4. The appropriate setbacks under the applicable zone should also be maintained.
The City of Greeley does not agree that this proposal is an appropriate use in the Agricultural Zoning
District. However, if this proposal is approved, the City would like the items listed above required in
the approval.

The sheriff's office has no concerns with this Special Use Permit. The sheriff's office
would however be willing to provide a program entitled Crime Prevention Through
Environmental Design to the developer. This program reduces the likelihood of criminal
activity at a specific location by"hardening" it to crime.
The Sheriff's Office lacks the ability to absorb any additional service demand without the
resources recommended in the multi-year plan provided to the Board of County
Commissioners or as indicated by growth not considered at the time the plan was
developed. I have no other comments on this proposal.

Dear Mr. Gathman:
Reference is made to the above-mentioned project located in Section 14, Township 5 North,
Range 65 West, Weld County, Colorado.
If any work associated with this project requires the placement of dredged or fill material, and
any excavation associated with a dredged or fill project, either temporary or permanent, in waters of the
United States at this site, this office should be notified by a proponent of the project for proper
Department of the Army permits or changes in permit requirements pursuant to Section 404 of the Clean
Water Act. Waters of the U.S. includes ephemeral, intermittent and perennial streams, their surface
connected wetlands and adjacent wetlands and certain lakes,ponds, drainage ditches and irrigation
ditches that have a nexus to interstate commerce.
Work in waters of the U.S. should be shown on a map identifying the Quarter Section, Township,
Range and County of the work and the dimensions of work in each area of waters of the U.S.
