RE: ACTION OF BOARD AT PROBABLE CAUSE HEARING CONCERNING USE BY
SPECIAL REVIEW PERMIT#878 - DANIEL OCHSNER AND BARRY PAYANT
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on the 10th day of November, 2003, a Probable Cause Hearing was held
before the Board to consider setting a Show Cause Hearing to determine whether or not Daniel
Ochsner, 18905 Weld County Road 394, LaSalle, Colorado 80645, was in compliance with
certain Conditions of Approval and Development Standards contained in Use by Special Review
Permit#878 for a Recreational Facility in the A (Agricultural)Zone District, and
WHEREAS, the alleged violations were said to be occurring on property described as
part of the NE1/4 of Section 31, part of the SE1/4 of Section 30, and part of the SW1/4 of Section
29, all in Township 5 North, Range 65 West of the 6th P.M., Weld County, Colorado, and
WHEREAS, at said hearing on November 10, 2003, the Board deemed it advisable to
continue the matter to November 24, 2003, at the request of the property owners, Daniel
Ochsner and Barry Payant, and
WHEREAS, at said hearing on the 24th day of November, 2003, with only three
Commissioners present and at the request of the applicant, the Board again continued this
matter to January 12, 2004, and
WHEREAS, at said hearing on the 12th day of January, 2004, after hearing the testimony
of those present, the Board deemed it advisable to continue this matter to July 12, 2004, at
9:00 a.m., to allow the applicant sufficient time amend Use by Special Review Permit #878.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Probable Cause Hearing to determine whether or not Special
Review Permit#878 issued to Daniel Ochsner should be revoked be, and hereby is, continued
to July 12, 2004, at 9:00 a.m.

The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 24th day of November, A.D., 2003.
