RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST LESLIE WINDYKA FOR VIOLATION OF THE WELD
COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Leslie Windyka, VI #0200172, is allegedly in violation of the Weld County
Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 11th day of March, 2003, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Leslie Windyka, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until June 11, 2003, to allow adequate time for the property owner to
acquire sufficient funds to apply for the Use by Special Review Permit.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that VI #0200172 be, and hereby is, referred to the Weld County
Attorney's Office for legal action against Leslie Windyka to remedy the violation of the Weld
County Code, and any other persons occupying the properties, any persons claiming an
interest in the properties, and any persons acting in active concert with the identified parties,
with an instruction for delay of action upon such referral until June 11, 2003, to allow adequate
time for the property owner to acquire sufficient funds to apply for the Use by Special Review
Permit.

The property referenced above remains in violation of the Weld County Code. I have scheduled a meeting
with the Board of County Commissioners on March 11, 2003, at 10:00 a.m., to consider the violations
occurring on the property. The property remains in violation of the following Section(s) of the Weld
County Code:

Section 23-3-20 "Uses allowed by right."

Section 23-3-40.R "Any use permitted as a Use by Right,an Accessory Use or a Use
by Special Review,in the Commercial or Industrial Zone Districts, provided that the
property is not a Lot in an approved or recorded subdivision plat or lots parts of a
• map or plan filed prior to adoption of any regulations controlling subdivisions. PUD
development proposals shall not be permitted to use the special review permit
process to develop."
Section 23-3-40.0 "Uses similar to the USES listed above as Uses by Special
Review as long as the USE complies with the general intent of the A (Agricultural)
Zone District. (Weld County Codification Ordinance 2000-1; Weld County Code
Ordinance 2001-1)."
To bring the property into compliance:
As we have previously discussed,the KENNEL and auto repair shop shall cease to
exist or a Use by Special Review application shall be completed and submitted for
review. While it is my belief that you are in the process of compiling a Use by Special
Review application,we have not received a complete application. The Department
of Planning Services originally agreed to extend this case until November 1, 2002,
pending the receipt of a complete application. Additionally, the "Noncommercial
Junkyard" consisting of derelict vehicles shall be removed or screened from all
adjacent property owners and public rights-of-way. The screening would be
addressed through the Use by Special Review permit process.

This meeting will take place in the County Commissioners' Hearing Room, First Floor, Weld County
Centennial Center,915 10th Street,Greeley,Colorado. It is recommended that you or a representative be
in attendance to answer any questions the Board of County Commissioners might have about the violations.
Please also be advised that I will be taking video and/or pictures from the road or adjacent properties the
business day before or as soon as possible to the above mentioned Violation Hearing date.
The Department of Planning Services'staff will be recommending that the Board of County Commissioners
authorize the County Attorney to proceed with legal action to remedy the violation. Our records indicate that

Date: July 15, 2002
I spoke to Leslie Windyka July 12, 2002 concerning her need for a USR permit. Ms.Windyka was quite
upset and concerned regarding information she had previously received from the Weld County
Department of Planning Services.
Apparently, two years ago she called the Weld County Department of Planning asking how many dogs
she could have in her residence. She stated she was told she could have five dogs, and that any other
individual residing on her property was also entitled to own five dogs. I explained the rule concerning
the number of dogs was based on the one parcel rather than the number of people residing on the
property.
Ms.Windyka was again informed about the need for a USR. I explained to her that the Board of County
Commissioners did consider her request for a hardship in relation to the USR, but that her request was
denied. Ms. Windyka asked if additional information submitted to the Board might change their decision.
I told her that I would be happy to take additional information to the Board should she deem it necessary.
There was no response to this offer.
After additional discussion, Ms.Windyka expressed concern regarding Bethany's impending removal of
her dogs and cars by July 20, 2002. I explained to her that this would not happen. I reiterated that in
order for her to continue with her use on that site, she does need to get the application materials filled
out, as well as pay the fee get the USR approved. I also offered to provide her any assistance she
needed in this matter. She expressed a concern regarding access to the Code and I told her that the
Weld County Department of Planning would provide her with a hard copy of the Code for her review.
She stated that she does not have the funds to pay for the application. I asked her how much time she
would need to acquire the funds to pay for the application. She was not able to give me a definite
answer to this question.
Ms.Windyka said she has attempted to fill out the application. When I asked how much she had filled
out, she then replied that she had done none of it. I again asked how much time she needed to
complete the application. She said there were many extraneous circumstances requiring resolution that
were preventing her from completing the application.
After a 45 minute conversation, I told her the Department of Planning Services would take no action on
her case at this time, that we would give her a week to decide how long she needed to obtain the fees
and complete the application, and asked her what assistance she required from Weld County and Weld
County agencies.
As a final note, Ms. Windyka said she had not been able to get in touch with the Weld County
Department of Public Works for assistance on the access. I forwarded her concerns to Peter Schei and
he said he would be more than happy to get this information for her and will share it with her this week.

First, let me forward the Board of County Commissioners determination regarding the "Waiver of Fees". Your
request and letter was first presented to the Department of Planning Services Staff. At this level,staff determined

SUBJECT: Request to waive permit fees for a Use by Special Review application.
Legal Information:
Lot A of RE-2174;also known as part of the N2SE4 of Section 20,T5N, R64W of the 61h P.M.,Weld County,
Colorado
Background:
The above mentioned property is currently in violation (VI-0200172) of the Weld County Code. The violation
is based upon a kennel and an auto repair shop without a Use by Special Review permit. To bring the property
into compliance with the Weld County Code a Use by Special Review application shall be completed and
submitted for review or the auto repair shop shall cease to exist and the number of household pets shall be
reduced to 4 (four) of 1 (one) species or a total of 7 (seven) of 2 (two) or more species.
The Weld County Department of Planning Services has received the attached written request from Ms. Leslie
Windyka to waive the relevant application fees associated with a Use by Special Review permit.
Recommendation:
Staff has reviewed the attached letter and has determined this does not meet the intent of extenuating
circumstances substantiating the waiver of application fees. Therefore, staff recommends against waiving
application fees in this case.
Please indicate your decision regarding staff's above recommendation against waving application fees.
