This is a follow-up to our conversation held at the Kerbs Dairy Probable Cause Hearing on March 10,
2003. As you recall,you requested a formal request to do maintenance work on the borrow ditch adjacent
to the Vance property and County Road 55, north of Highway 392.
The Department of Public Health and Environment respectfully requests the following maintenance
activities be completed to the borrow ditch adjacent to the Vance property and County Road 55, north of
Highway 392, from the intersection of Highway 392 and County Road 55 to the Kerbs Dairy:
• Reconstruct the ditch to make it deeper,
• Remove remaining debris from the ditch,and
• Place riprap at both inlet and outlet of all approach culverts.
As requested by the Weld County Board of County Commissioners, I have researched solutions to
eliminate or greatly reduce the probability of the Vance property getting flooded again. Their request
was a result of several hearings before the Board of County Commissioner to resolve discharge violations
of a dairy adjacent to CR 55 and to resolve chronic and severe flooding events that the Vance residence
has experienced in the past.
In consultation with the Colorado Department of Transportation, Weld County Public Works, Weld
County Road and Bridge, and other County personnel, it appears that the above maintenance activities
should greatly reduce the probability of the Vance property being flooded in the future.
However, the lower approach culvert into the Vance residence is an 18" culvert and the three upper
approach culverts are 28" culverts. The lower approach culvert (18" culvert) should be replaced to a
larger size to match the three upper approach culverts (28" culverts). This has not been resolved due to
conflicting views of who should be responsible for the costs associated with this project.
I recommend removal and closure of the 28"approach culvert access just north of the lower 18"culvert to
be used to replace the 18" culvert (driveway). I would suggest that the dairy assist the Vance residence
by providing equipment to dig out the culverts and the Vance residence provide assistance by purchasing
a 28" culvert, assisting in 'man power' while digging out the two culverts and placement of the lower
culvert and/or paying for half of the cost for use of heavy equipment. If you can provide more assistance
with this situation,please let me know. I will also be glad to help in any way possible.

We have been contracted by Roxy Vendena to process a Design and Operations
Plan for his composting facility located between Weld County Road 6 and 8 on
Weld County Road 13.
We have commissioned the survey and will have the drainage calculations
completed and submitted to you within thirty (30) days of the date of this letter. We
are prepared to submit the Design and Operations plan to both Weld County and
the State of Colorado within sixty (60) days of the date of this letter.
