RESOLUTION RE: DECLARE LOCAL PUBLIC HEALTH DISASTER EMERGENCY PURSUANT TO SECTION 24-32-2109, C. R. S., AND AUTHORIZE CHAIR TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners is the governing board and functions as the Weld County Board of Public Health, and WHEREAS, Weld County currently is experiencing a West Nile epidemic, with more than a month left in the mosquito season, based upon multiple confirmed human cases including two confirmed fatalities, presence of the virus in mosquito pools and bird populations, high numbers of vector Culex mosquitos, and multiple equine cases, and WHEREAS, the above conditions place Weld County in Level VII status (most severe) of the Colorado Department of Public Health and Environment Arbovirus Response Plan, and WHEREAS, Weld County is currently conducting the first five activities called for in a Level VII response including, emphasizing personal protection and focusing on human case prevention and adult mosquito control based upon surveillance mapping in high risk areas, but has not formally notified the Colorado Office of Emergency Management or activated the Colorado Department of Health and Environment Emergency Mutual Aid and Assistance Agreement, which will allow, if necessary, obtaining assistance from other jurisdictions, and WHEREAS, Section 24-32-2109, C. R. S., provides that a local disaster and emergency may be declared by the principal executive officer of a political subdivision and may be extended by the governing body of the political subdivision beyond a period of seven days, and WHEREAS, the effect of a declaration of a local disaster emergency is to activate the response and recovery aspects of any and all applicable local and interjurisdictional disaster emergency plans and to authorize the furnishing of aid and assistance under such plans. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, sitting as the Weld County Board of Health and as Governing Board of Weld County that a local public health emergency exists in the County of Weld, as described above. BE IT FURTHER RESOLVED by the Board that this declaration be given prompt and general publicity, and that a copy be filed promptly with the Colorado Division of Local Government and the Office of Emergency Management.
