HomeMy WebLinkAbout20030886.tiff RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO APRIL 2, 2003 TAPE #2003-11 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Centennial Center, Greeley, Colorado, April 2, 2003, at the hour of 9:00 a.m. ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner David E. Long, Chair Commissioner Robert D. Masden, Pro-Tem Commissioner M. J. Geile Commissioner William H. Jerke Commissioner Glenn Vaad Also present: County Attorney, Bruce T. Barker Acting Clerk to the Board, Esther E. Gesick Director of Finance and Administration, Donald D. Warden MINUTES: Commissioner Vaad moved to approve the minutes of the Board of County Commissioners meeting of March 31, 2003, as printed. Commissioner Geile seconded the motion, and it carried unanimously. AMENDMENTS TO AGENDA: The following was deleted from New Business: 2) Consider Application for License to Conduct Public Dance or Dances - aMAIZEing Farm Events, LLC [2003-0880]. CONSENT AGENDA: Commissioner Vaad moved to approve the consent agenda as printed. Commissioner Geile seconded the motion, and it carried unanimously. PROCLAMATIONS: NATIONAL CRIME VICTIMS' RIGHTS WEEK -APRIL 6 - 12, 2003: Chair Long read the certificate proclaiming April 6-12, 2003, as National Crime Victims' Rights Week. Gary Rathke, 19th Judicial District Attorney's Office, thanked the Board for making this proclamation and for planning to attend the upcoming luncheon on April 11, 2003. WELD COUNTY CHILD ABUSE PREVENTION MONTH - APRIL, 2003: Chair Long read the certificate proclaiming April 2003, as Weld County Child Abuse Prevention Month. Christie Dodd, A Kid's Place, stated they are hosting a "Light of Hope" event on the courthouse steps tomorrow evening to show support for the abused children in Weld County. COMMISSIONER COORDINATOR REPORTS: There were no Commissioner Coordinator Reports. 2003-0886 BC0016 PUBLIC INPUT: There was no public input. WARRANTS: Donald Warden, Director of Finance and Administration, presented the following warrants for approval by the Board: All Funds $228,323.65 Commissioner Geile moved to approve the warrants as presented by Mr. Warden. Commissioner Masden seconded the motion, which carried unanimously. BIDS: PRESENT 2003 TRASH REMOVAL BID -ALL DEPARTMENTS: Mr. Warden presented the sole bid received. Said bid will be considered for approval on Wednesday, April 16, 2003. OLD BUSINESS: CONSIDER DUST BLOWING COMPLAINT -TIMOTHY AND ELANE SWANEY (CON'T FROM 03/26/03): Bruce Barker, County Attorney, stated the initial complaint was received by the Weld County Department of Public Health and Environment, and he gave a brief description of the location of the site. He stated additional complaints were received from surrounding property owners to the north. Mr. Barker stated the site was inspected by Phil Brewer of the Health Department, and Nick Hoban of the West Greeley Soil Conservation District. He stated the Swaneys have responded by removing all the animals from the property to see if the grass will recover, and if there are complaints of further dust blowing, the West Greeley Soil Conservation District has recommended measures for treating the site. Mr. Brewer stated the first complaint was anonymous with concerns regarding nuisance conditions for the children on the playground at the nearby public school, and a second complaint was received from property owners to the south regarding the deposition of silt. Mr. Brewer stated there were 30 horses on the site at the time of his inspection, and soil and silt had blown into the public right-of-way along Weld County Road 90; however, there was some sign of vegetation growth as a result of moisture from the snow storm two weeks ago. Responding to Chair Long, Mr. Barker recommended this hearing be dismissed, and that the West Greeley Conservation District do the necessary follow up. He stated if the problem persists, the matter can be brought back before the Board. He explained the Board must make a finding of an emergency condition, therefore, he recommends against continuing the matter. However, the issue can be brought back before the Board at any time, following proper notification to the property owner. Commissioner Geile moved to dismiss the dust blowing complaint against Timothy and Elane Swaney based on his finding that they are working to improve the situation. Commissioner Vaad seconded the motion, which carried unanimously. CONSIDER AGREEMENT CONCERNING CLINICAL EXPERIENCE AND AUTHORIZE CHAIR TO SIGN - ST. ANTHONY HOSPITAL, C/O ST. ANTHONY PARAMEDIC ACADEMY (CON'T FROM 3/31/03): Dave Bressler, Director of Weld County Paramedic Services, stated this is a standard agreement form which provides a $25 fee for each student ride-a-long while receiving tuition credit, with no cost to the County. Commissioner Geile moved to approve said agreement and authorize the Chair to sign. Seconded by Commissioner Vaad, the motion carried unanimously. NEW BUSINESS: CONSIDER ESTABLISHING THE NEIGHBORHOOD TO BE SERVED, DESIGNATING A COMMISSIONER TO MAKE ON-SITE INSPECTION, AND SETTING THE HEARING DATE CONCERNING THE APPLICATION OF AMAIZEING FARM EVENTS, LLC, FOR A TAVERN LIQUOR LICENSE: Mr. Barker described the neighborhood to be established and recommended the Board set a hearing for April 21, 2003, at 9:00 a.m. to consider the Tavern Liquor License application. Commissioner Vaad indicated he would inspect the site. Peggy Shupe, co-owner of aMAIZEing Farm Events, LLC, stated the overall property is 200 acres; however, the licensed area will be restricted to Minutes, April 2, 2003 2003-0886 Page 2 BC0016 the main barn events center. Commissioner Masden moved to establish the neighborhood as recommended by staff, designate Commissioner Vaad to make an on-site inspection, and set the hearing date for April 21, 2003. Commissioner Jerke seconded the motion, which carried unanimously. CONSIDER TASK ORDER CHANGE ORDER LETTER#1 FOR NURSE HOME VISITOR PROGRAM AND AUTHORIZE CHAIR TO SIGN: Dr. Mark Wallace, Director of Department of Public Health and Environment, stated the Nurse Home Visitor Program is funded with Master Tobacco Settlement funds; however, due to State budget cuts, the program funding for the remainder of the program year through June 30, 2003, will be reduced by $16,411. He stated staff has identified how that reduction will be addressed. Commissioner Vaad moved to approve said Task Order Change Order Letter#1 and authorize the Chair to sign. Seconded by Commissioner Masden, the motion carried unanimously. CONSIDER VICTIMS OF CRIME ACT (VOCA) GRANT APPLICATION AND AUTHORIZE CHAIR TO SIGN: Gary Rathke, District Attorney's Office, stated this is the application for the next year of VOCA funding, beginning January 1, 2004, though December 31, 2004. He stated they are requesting a five percent increase. Commissioner Geile moved to approve said application and authorize the Chair to sign. The motion, which was seconded by Commissioner Vaad, carried unanimously. CONSIDER TEMPORARY CLOSURE OF WCR 41 BETWEEN "O" STREET AND WCR 66: Frank Hempen, Jr., Director of Department of Public Works, stated this closure is necessary to replace a cross-road irrigation pipe, and the road will be closed on April 7, 2003, for five days. He stated this is part of the program to get all the irrigation systems in place before the irrigation season begins. Commissioner Jerke moved to approve said temporary closure. Commissioner Masden seconded the motion, which carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the consent agenda. No Ordinances were approved. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Acting Clerk to the Board.
