RE: ACCEPTANCE OF CERTAIN ROADS IN SONNY VIEW ESTATES, FIRST
FILING, FOR MAINTENANCE AND RELEASE OF $43, 557 . 50 DEMAND
NOTE
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Department of Engineering Services has recom-
mended that the following street segments in Sonny View Estates ,
First Filing, as recorded on March 3, 1972 under Reception Number
1584876, be accepted for maintenance:
Diane Street between 35th Avenue and Grand
View Drive
Diane Place from Grand View Drive southerly
approximately 400 feet to Lot 36
Grand View Drive from Cindy place northwesterly
approximately 1, 100 feet to the West line of
Lot 4
WHEREAS, on March 12, 1979, the Board of County Commissioners
adopted a resolution directing the Weld County Clerk and Recorder
to release a demand note in the amount of $43, 557 . 50 filed by
David Fagerberg, Jr. conditional upon the receipt of a $10, 000. 00
surety bond for the remaining street improvements, and
WHEREAS, said David Fagerberg, Jr. has never filed said $10, 000. 00
surety bond but the remaining street improvements that Mr. Fagerberg, Jr.
was responsible for have been completed as listed above and,
WHEREAS, the Ogilvy Ditch Company has filed a $10, 000. 00 letter
of credit and entered into an agreement with Weld County, dated
January 12, 1981, for all other remaining street improvements, and
WHEREAS, the Department of Engineering Services has recommended
that said $43, 557. 50 demand note be released, and
WHEREAS, the Board of County Commissioners deems it advisable
to accept the above stated street segements in Sonny View Estates,
First Filing, for maintenance and to release the $43, 557. 50 demand
note from David Fagerberg, Jr.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the street segments in
Sonny View Estates, First Filing, as stated herein, be, and hereby
are, accepted for maintenance.
BE IT FURTHER RESOLVED by the Board of County Commissioners
that the $43, 557 . 50 demand note from Sonny View Estates be, and
hereby is, released.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 23rd day of
February, A.D. , 1981.
