The Weld County Public Works Department has reviewed this proposal; this project falls primarily under
the purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division
4, Section 23. Our comments and requirements are as follows:
COMMENTS:
The Colorado Department of Transportation (CDOT) has jurisdiction over all accesses to the State
Highways. Please contact Gloria Hice-Idler or Tess Jones at the Greeley office to verify the access
permit or for any additional requirements that may be needed to obtain or upgrade the permit.
Our most recent average daily traffic (ADT) count reflects 11,800 vehicles for U.S. Highway 85, taken in
1995.
WCR 18 has an ADT count reflects between 200 and 400 vehicles.
REQUIREMENTS:
This is a very unique application with many different types of uses proposed on site.
Access/Off-Street Parking:
The key thing here is accommodate access and to provide adequate parking space for turnaround of all
types of vehicles utilizing the site. The applicant needs to specify on the plat drawing adequate parking to
accommodate all types of vehicles utilizing the site and a good circulation pattern for turning a larger
vehicle.
The access drive including the parking area shall consist of gravel, asphalt, concrete or equivalent. It
shall be graded to prevent drainage problems.
The display area shall be separate from the proposed gravel parking area and turnaround with good
circulation throughout.
Storm Water Drainage: With the installation of your storage units, the applicant will be displacing storm
water run-off. The applicant needs to identify on the plat how and where the storm water will be retained
and released at the historical rate from the site as to not impact the adjacent property owners.
The applicant identified on the plat drawing an existing easement to be vacated on the northern most
property line. The applicant shall identify all rights-of-way/easements on the property whether they are
private or public. If the state requires an additional setback for future widening of U.S. Highway 85, this
should be shown on the plat also.

Environmental Health Services has reviewed this proposal for a towing, storage, sales, rental of
motorcycles, cars, recreational vehicles,noncommercial junkyard and auto pawn business. We
have no objections to the proposal, however, we do recommend that the following conditions be
part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be recorded:
1. If applicable, the applicant shall apply for an Underground Injection Control (UIC) Class
V Injection Well permit for the maintenance building through the Environmental
Protection Agency(EPA) or provide evidence that the applicant is not subject to the EPA
Class V requirements.
2. Submit an Air Pollution Emission Notice (A.P.E.N.) and Emissions Permit application to
the Air Pollution Control Division, Colorado Department of Health and Environment for
emissions of criteria,hazardous or odorous air pollutants.
3. Submit a dust abatement plan to the Environmental Health Services, Weld County
Department of Public Health& Environment, for approval prior to operation.
4. In the event the applicant intends to utilize the existing septic system the septic system
shall be reviewed by a Colorado Registered Professional Engineer. The review shall
consist of observation of the system and a technical review describing the systems ability
to handle the proposed hydraulic load. The review shall be submitted to the
Environmental Health Services Division of the Weld County Department of Public
Health and Environment. In the event the system is found to be inadequately sized or
constructed the system shall be brought into compliance with current Regulations.
5. In accordance with the Above Ground Storage Tank Regulations(7 CCR 1101-14) a
spillage retention berm shall be constructed around the tank battery. The volume retained
by the spillage berm should be greater than the volume of the largest tank inside the
berm. Alternative protective measures may be allowed provided they comply with the
Above Ground Storage Tank Regulations.
6. In the event washing of vehicle will occur on site the applicant shall ensure that any
vehicle washing area(s) shall capture all effluent and prevent discharges from the
washing of vehicles in accordance with the Weld County Code,the Rules and
Regulations of the Water Quality Control Commission, and the Environmental Protection
Agency.
7. The applicant shall submit a waste handling plan, for approval, to the Environmental
Health Services Division of the Weld County Department of Public Health&
Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site(this should include
expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including the
facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as conditions
that must be met prior to the issuance of the Certificate of Occupancy:
1. An individual sewage disposal system is required for the proposed office and
maintenance building and shall be installed according to the Weld County Individual
Sewage Disposal Regulations.
2. The septic system is required to be designed by a Colorado Registered Professional
Engineer according to the Weld County Individual Sewage Disposal Regulations.
We recommend that the following requirements be incorporated into the permit as development
standards:
1. All liquid and solid wastes(as defined in the Solid Wastes Disposal Sites and Facilities
Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a
manner that protects against surface and groundwater contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not meant to
include those wastes specifically excluded from the definition of a solid waste in the
Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive
dust, blowing debris, and other potential nuisance conditions.
4. Fugitive dust shall be controlled on this site. The facility shall be operated in accordance

with the approved dust abatement plan at all times.
5. This facility shall adhere to the maximum permissible noise levels allowed in the
Commercial Zone as delineated in 25-12-103 C.R.S., as amended.
6. All potentially hazardous chemicals must be stored and handled in a safe manner in
accordance with product labeling.
7. The applicant shall operate in accordance with the approved"waste handling plan".
8. Adequate toilet facilities shall be provided for employees and patrons of the facility.
9. Any septic system located on the property must comply with all provisions of the Weld
County Code, pertaining to Individual Sewage Disposal Systems.
10. If applicable,the applicant shall obtain a stormwater discharge permit from the Colorado
Department of Public Health& Environment, Water Quality Control Division.
11. A permanent, adequate water supply shall be provided for drinking and sanitary purposes.

The Department of Planning Services reviewed the above referenced Use by Special Review
Landscape Plat and offers the following comments:
Section 23-3-250.A.4 and Section 23-3-250.A.5 of the Weld County Code addresses the
required yards and required landscape areas. Section 23-3-250.A.5.a states "No more than
eighty-five percent (85%) of the total area of a Lot shall be covered. Land shall not be deemed
covered if it is used for growing grass, shrubs, trees, plants or flowers or if covered by
decorative gravel or wood chips, or if it is otherwise suitably landscaped."
Section 23-3-250.A.5.a states "That portion of a Lot which abuts a public or private street right-
of-way shall be landscaped for a distance of ten (10) feet, measured at a right angle from the
Lot line towards the interior of the Lot. Driveways may pass through the required landscaped
areas."
The applicant states that the on-site landscape treatment exists. However, Planner Gathman
should make an educated determination as to whether additional plant materials are required to
meet or exceed the landscape requirements and to effectively mitigate the required screening
and buffering of the proposed use to the adjacent roads and property owners. That being
stated, there is not a plant material list, nor is the location delineated on the drawing. Future
plans shall address the type of plant material presently on-site and whether this material will be
supplemented with additional materials.
Landscaping materials as indicated in the Approved Landscape Plan shall be maintained at all
times. Dead or diseased plant materials shall be replaced with materials of similar quantity and
quality at the earliest possible time.
The applicant shall demonstrate how the proposed plant material will be watered, thus ensuring
adequate growth and established of the feeder root system. Further, the applicant shall provide
evidence that a commercial well permit has been obtained prior to recording the USR plat.
The parking area is delineated as a "dirt parking and display area", with no parking spaces
delineated. Given the nature of this facility the following parking requirements outlined in
Appendix 23-B of the Weld County Code shall be met. The warehouse parking requirement,
identified as "mini-storage" in the application materials shall provide twenty-six spaces, or one
space for each 1000 square feet of space. The sales yard shall provide thirty-six parking
spaces, or one space for each 400 square feet of display area. The other uses associated with
this proposed facility shall utilize the parking available on-site for the previously discussed uses.
Total on-site parking for this facility shall be sixty-two spaces, of which one shall be a van
accessible handicapped parking stall meeting all of the requirements as set forth in the
Americans with Disabilities Act. Further, the applicant shall delineate curb stops for the parking
spaces shown on the USR plat. One curb stops for each space is the standard, although one
curb stop per two parking spaces is permissable.
Per Section 23-3-350.B, the applicant shall delineated sufficient screened off street paved
parking areas. Further, one off-street loading space is required for a facility of this size. All
parking and loading areas shall be screened from adjacent properties and road rights-of-way.
The applicant shall delineate an opaque visual screen on all sides of the property to mitigate the
potential negative impact and aesthetic concerns on surrounding properties.
Section 23-3-350.D provides for adequate street access. The applicant shall demonstrate a
safe and approved access. Appropriate language shall be included on the plat delineating the
access to this parcel.
The internal circulation within the service yard is unclear. Future drawings shall delineate the
proposed circulation pattern and outdoor storage areas. Further, the circulation and parking
areas for the warehouse facility is unclear and shall require further definition. Additionally, the
Fort Lupton Fire District shall review the plan for compliance with their requirements.
Section 23-3-350.H addresses the issue of trash collection areas. Areas used for storage or
trash collection shall be screened from adjacent public rights-of-way and adjacent properties.
These areas shall be designed and used in a manner that will prevent wind or animal
scattered trash.
Section 23-3-260 addresses operation standards for Commercial uses. The applicant shall
address the issue of on-site lighting, including security lighting in applicable. Subsection B.6
states "any lighting ... shall be designed, located and operated in such a manner as to meet the
following standards: sources of light shall be shielded so that beams or rays of light will not
shine directly onto adjacent properties...."
The applicant has not delineated any on-site sign. If an on-site sign is desired, the signs shall
adhere to Section 23-4-90.A and .B of the Weld County Code. One identification sign per
principal use shall be allowed, provided that the sign does not exceed sixteen (16) square feet
in area per face. Further, the location of the sign, if applicable shall be delineated on the
Landscape / Site Plat. All structures, including signs, on site must obtain the appropriate
building permits.
The applicant shall enter into an Improvements Agreement according to policy regarding
collateral for improvements and post adequate collateral for all transportation (access drive,
parking areas, etcetera) and non-transportation (plant materials, fencing, screening, etcetera).
The agreement and form of collateral shall be reviewed by County Staff and accepted by the
Board of County Commissioners prior to recording the USR plat.
The applicant shall provide further information regarding the mobile home located on the
property. There was not information in the document package addressing how this structure is
permitted, how it is utilized and whether it is a legal structure.
Internal circulation, including pavement requirements shall be determined by the Department of
Public Works. Access from State Highway 85 shall be addressed by the Colorado Department
of Transportation.

There are no active or historical permits on record for this parcel or address.
1. A building permit shall be obtained prior to the construction of any new building.
2. A building permit shall be obtained for all existing structures unless evidence can be
submitted that a permit and all required inspections were performed. Existing building
applications shall include all uses to which the buildings are, or will be, used. A plot plan shall
be submitted showing all structures with accurate distances between structures, and from
structures to all property lines.
3. A plan review is required for each building for which a building permit is required. Plans for
the maintenance shop shall include a floor plan and a complete description of the extent of the
work that will be done to maintain vehicles. Plans shall bear the wet stamp of a Colorado
registered architect or engineer. Two complete sets of plans are required when applying for
each permit.
4. Buildings shall conform to the requirements of the various codes adopted at the time of
permit application. Currently the following has been adopted by Weld County: 1997 Uniform
Building Code; 1998 International Mechanical Code; 1997 International Plumbing Code; 2002
National Electrical Code and Chapter 29 of the Weld County Code.
5. Each new building will require an engineered foundation based on a site-specific
geotechnical report or an open hole inspection performed by a Colorado registered engineer.
Engineered foundations shall be designed by a Colorado registered engineer.
6. The maintenance shop building will probably be classified as type S-3 repair garage. Fire
resistance of walls and openings, construction requirements, height and allowable areas will be
reviewed at the plan review. Setback and offset distances shall be determined by the Zoning
Ordinance.

7. Building height shall be measured in accordance with the 1997 Uniform Building Code for the
purpose of determining the maximum building size and height for various uses and types of
construction and to determine compliance with the Bulk Requirements from Chapter 27 of the
Weld County Code. Building height shall be measured in accordance with Chapter 23 of the
Weld County Code in order to determine compliance with offset and setback requirements.
Offset and setback requirements are measured to the farthest projection from the building.
8. A Flood Hazard Development Permit shall be submitted for buildings constructed within the
100-year flood plain whether the buildings are existing or new.

The sheriffs office has no concerns with this Special Use Permit. The sheriffs office
would however be willing to provide a program entitled Crime Prevention Through
Environmental Design to the developer. This program reduces the likelihood of criminal
activity at a specific location by"hardening" it to crime.
The Sheriffs Office lacks the ability to absorb any additional service demand without the
resources recommended in the multi-year plan provided to the Board of County
Commissioners or as indicated by growth not considered at the time the plan was
developed. I have no other comments on this proposal.

In consultation with the Natural Resources Conservation Service(NRCS), we have reviewed the above
referenced case and have the following comments.
SOILS/LIMITATIONS: The Ascalon loam on this site has slight limitations for septic tank absorption
fields and shallow excavations. It has moderate limitations for small commercial buildings and dwellings
with or without basements. Windbreaks and landscape plantings are generally well suited to this soil.
PRIME FARMLANDS:No Prime Farmlands will be taken out of production.
SOIL EROSION POTENTIAL: Surface runoff is slow and the erosion hazard is low.
OTHER: If future land use will include grass establishment and grazing,we would recommend that the
new landowner contact the local NRCS office for guidelines on establishing and maintaining the grass and
grazing management. Additionally,the future landscape plan should address the reduction of water use
with the use of Xeriscape. We also recommend that Ron Broda, Weld County Vegetation Management
Specialist be contacted to assist the landowner in developing a weed management plan. Ron can be
contacted at 970-356-4000 x3770.

Dear Mr. Gathman:
Thank you for the opportunity to review the Use by Special Review Permit application
for property located at 7853 Highway 85. The Fort Lupton Planning Commission
reviewed the application at the regular meeting of November 26, 2002. In general, the
Planning Commission does not support the project as designed and urges Weld County to
deny the permit. Minutes from the meeting are attached for your convenience.
In addition to the Planning Commission's concerns, City staff has the following
comments:
1. The property is located immediately outside the Urban Growth Boundary. Staff
questions whether approval of this project will comply with Section 3.2 of the
IGA which reads as follows: "To the extend legally possible the County will
disapprove proposals for Urban Development in areas of the Municipal Referral
Area outside the Urban Growth Area." It is the opinion of staff that this intensity
of development is urban in nature and should be directed to land within the City
limits where adequate police and fire protection can be provided.
2. The site plan shows the primary access point being to Highway 85. It is the
position of City staff that no increase in traffic should be allowed via this access
point. The development should be required to gain access from Weld County
Road 18. Staff supports closure of the Highway 85 access. The 700-foot spacing
between the driveway and Weld County Road 18 does not meet the City's spacing
requirements for access to arterials.
3. It does not appear that any landscaping is proposed. Irrigated landscaping would
be appropriate for this type of use to help screen unsightly uses and to add to the
visual quality of the Highway 85 Corridor.
4. This type of development, if located in the City limits, would require water
service with a capacity sufficient to provide fire protection.
5. In a recent joint meeting between the City Council and the County
Commissioners, mosquito control was discussed in detail. One of the issues that
came up was the fact that junkyards help increase mosquito populations. Old tires
and other junk create places for stagnant water that becomes prime mosquito-
breeding habitat.
Subsequent to the Planning Commission meeting in November, the applicant requested
the opportunity to further discuss the issues associated with the proposed use. Mr.
Roseman will be placed on the agenda of the January 14, 2003 meeting. Follow-up
comments from the Planning Commission may follow the meeting.

3. APPROVAL OF THE AGENDA: Donald Young motioned to approve the agenda as presented, seconded
by Sandy Neb. Passed on a voice vote.
4. APPROVAL OF THE MINUTES: There was a correction on the top of page 2 of 3. This should state
that the applicant is going before the Council on November 27. The motion to table the decision on the
Woods Subdivision was made by Tracey Reynolds and seconded by Shawn McCutchan.
Tracey Reynolds motioned to approve the November 12, 2002 minutes as corrected, seconded by
Donald Young. Passed on a voice vote.
5. WELD COUNTY REFERRALS
A. A Special Use Permit to allow an automobile towing business, automobile sales and rental, a
noncommercial junkyard and auto pawn in the Agricultural Zone District. The property is legally
described as Lot A of RE-2012 and is located West of and adjacent to Highway 85 and approximately
1/8 mile South of Weld County Road 18.
There can be Industrial uses on Agricultural zoned property by a Special Use Permit. This is outside
the City's urban growth boundary so the city standards do not apply. Mr. Grubb expressed a concern
for adequate screening and landscaping from both Hwy 85 and County Road 18. Mr. Grubb has
concerns with what the applicant is proposing and recommends sending a letter to them (County)
expressing the concerns of the City.
MOTION: Gene Reynolds motioned to check box 3 — (Write a letter to Weld County suggesting that
they not allow this use), seconded by Tracey Reynolds.
There was discussion of the disregard from Weld County regarding the meeting (last year) between the
County Commissioners, City of Fort Lupton and the City of Brighton discussing the Hwy 85 corridor.

The Commission is concerned about the appearance and reflection upon the rest of the community.
On all other applications that have been presented to the Planning Commission appropriate screening
and the appearance on the approach to Fort Lupton has always been an issue.
Passed on a voice vote.
6. PUBLIC HEARINGS
A. Continued From November 12, 2002 - A Preliminary Plat and a Final Plat for an 8-lot single family
residential subdivision known as Woods Subdivision. The applicant is requesting a Change of Zone
from A (Agriculture) to R-1A (Residential Low-Density) on a 3.001-acre parcel. The property is located
south of Kahil Street and west of McKinley Avenue. The applicant is Geoff Woods and the property
owners are James Lambert and Barbara Brookman.
The 151 Public Hearing was officially opened, posting publications were complete, the applicant
presented the item in detail, questions were asked, there were opponents giving their reasons for not
wanting this, there were no proponents and there was an allowing of rebuttal of comment to any
opponents. City staff also presented correspondence in favor or denial of the project. Questions,
comments from City Council, Planning Commission and staff were invited and heard. There was a
motion made to table this item until tonight.
The Public Hearing was reopened meeting that was tabled from the November 12, 2002 meeting in
consideration of a preliminary plat and a final plat for a 8-lot single family residential subdivision to be
known as the Woods Subdivision.
Since Mr. Steve Mitchell was not at the previous hearing he will run the discussion but will not vote.
Brian Grubb discussed the amended plat. It shows a 3 ft. by 110 ft. access easement, which is not
enough by itself but combined with what he currently has will be efficient.
MOTION: Tracey Reynolds motioned to approve the Preliminarily and Final Plat as amended and
present this for approval to the City Council, seconded by Shawn McCutchan. Passed on a voice vote.
This will now be sent to the City Council meeting to be heard on December 11, 2002 with the
recommendation from the Planning and Zoning Commission to approve this subdivision of both the
Preliminary and Final Plat.

8. DISCUSSION ITEMS - Brian Grubb stated that at this time there are no items scheduled for December. If
necessary there will be a meeting on the 10`" and the 17`"

Upon review of my computer and files, the following violation was noted (VI-9900348). The violation is in
regards to the operation of a salvage yard/vehicle repair/used car lot without an approved and recorded Use by
Special Review permit; therefore, if approved and once recorded this violation would be closed.
Please be advised that this case has already appeared before the Board of County Commissioners on the 8'h day
of February, 2000.
The Board referred the violation to the County Attorney's office to proceed with immediate legal action. Since
a"USR" application was submitted,this case was put on hold, pending the outcome. If denied this case will be
forwarded back to the County Attorney's office, to proceed with legal action.
