eld County Public Works Department has reviewed this final plat request and offers the following
comments.
Comments
❑ The applicant shall submit to Public Works stamped, signed and dated final plat drawings and roadway/
construction plan drawings for review and approval. This is consistent with County Code: Sec. 24-3-
50, "The minor subdivision final plat submitted shall contain the original signatures and seals of all
parties required."
o Final drainage construction and erosion control plans, conforming to the drainage report, shall be
submitted with the final plat application(stamped, signed and dated).
o The Section AA Road Detail (road cross-section) shall be corrected to show a 15-inch minimum culvert
at driveways as per County CODE.
o The applicant shall provide a pavement design prepared by a professional engineer.
o The applicant shall address maintenance of the interior roadway. Submitted notes state that the
individual landowners are responsible for issues affecting the interior subdivision road. The County
may accept paved development roadways for maintenance following a warranty period. The
roadway must meet current County standards / specifications, including inspection/ documentation
of construction.
o The CR 29 existing 30-foot right-of-way shall be dedicated on the final plat. The 30-foot right-of-way
shall be shown on the final plat,"30.0' R.O.W.DEDICATED". CR 29 is a graveled local roadway.
o The fmal plat drawing C-1 shall include notes that explain the terms: a) minimum foundation elevation,
and b) minimum opening elevation. The public needs to know if this is the top of foundation
elevation,bottom of foundation elevation,etc.
❑ The applicant must revise the final plat drawing C-1 note: "Drawing C-2 contains the required Change of
Zone Plat Notes." This final plat note should aptly read: "Drawing C-2 contains the required Final
Plat Notes."
o Standard 15-foot front lot easements are missing from the final plat. Additionally, 20-foot back lot
easements should be shown adjacent to CR 29 City of Greeley right-of-way(the easement should be
situated outside the r.o.w.).
o The applicant shall prepare a construction detail for typical lot grading with respect to drainage. Front,
rear and side slopes around building envelopes must be addressed. In addition, drainage for rear and
side lot line swales shall be considered. Building envelopes must be planned to avoid storm water

❑ The applicant should consider over-lot grading to improve the flooding safety factor for the residential
houses.
o The applicant has submitted an on-site Improvements Agreement for Private Road Maintenance,which is
being reviewed by Public Work's staff. This agreement shall be approved by the BOCC prior to
recording the final plat. Upon compliance with procedures by the Applicant, streets within a
Subdivision or Planned Unit Development may be accepted by the County as a part of the County
road system and will be maintained and repaired by the County.
❑ The applicant shall submit an off-site Improvements Agreement in accordance with Ag Pro's
Memorandum dated April 17, 2002, to be reviewed by Public Work's staff. "Discussions with the
Department of Public Works have resulted in the decision that the owner's are responsible for 35%
of the costs to pave WCR 29." This agreement shall be approved by the BOCC prior to recording the
final plat.
Recommendation
o The above comments are prerequisites and shall be fulfilled prior to recording the final plat.

The Weld County Public Works Department has reviewed this change of zone request.
Comments made during this phase of the subdivision process may not be all-inclusive, as other
concerns or issues may arise during the remaining application process.
COMMENTS:
o The Public Works Department suggests that drawing L-1 (Landscape Plan) be relabeled
Change of Zone Plat, drawing number C-2.. This drawing has the required specific
change of zone notes and may be overlooked being labeled a landscape plan.
o Drawing C-1 shall include a note stating that C-2 contains the required Change of Zone
Plat notes. Both drawings C-1 and C-2 shall be recorded, when approved by the Board.
Drainage:
o The Public Works Department had asked the applicant to address drainage items in their
Memorandum dated 19-August-2002. There remain certain items that must be
completed, before Public Works can approve this change of zone plat.
o The limits of 100-year storm inundation shall be shown on the Change of Zone Plat. The
applicant has shown these limits on the Drainage Layout, but not on the Change of Zone
Plat (to be recorded). This will provide the public with essential information regarding
the 100-year storm inundation area, which overlays the Buildings Envelope of the eastern
Lots 2, 3, 4, and 5.
o The minimum foundation elevations and minimum opening elevations shall be noted for
each building lot shown on the Change of Zone Plat. The applicant has shown these
limits on the Drainage Layout, but not on the Change of Zone Plat (to be recorded). This
will provide the public with essential information regarding the 100-year storm
inundation area, which overlays the Buildings Envelope of the eastern lots. In addition,
notes on the Change of Zone Plat shall be required explaining the terms: minimum
foundation elevation, and minimum opening elevation.
o Lots 1, 6, 7, and 8 have Minimum Foundation Elevations that are lower than the proposed
lot grades. The applicant must address this design criterion, since it is common practice
to place minimum foundation elevations higher than the surrounding grades with respect
to drainage.

❑ The applicant shall place a note on the Change of Zone Plat stating that all minimum
foundation elevations shall be one-foot above the 100-year storm flow elevation, as
documented in the Drainage Report.
o The applicant must submit a drawing depicting the location and shape of the cross-
sections for the drainage swale, thereby verifying the 100-year storm flow elevation(s).
The applicant has shown calculations in Appendix C for the channel flow (drainage
., swale). Public Works cannot fmd any drawing reference to the "Natural Channel Points"
stations and elevations. Many of the elevations (we are assuming water surface
elevations) are much higher than the 100-year storm inundation shown on the Drainage
Layout. -
❑ The applicant shall address, in the Drainage Report, the extent of the Greeley No.2 Canal
intercept for the 100-year storm flow to the north of the development. The applicant shall
describe in the body of the text any assumptions and calculations.
RECOMMENDATION:
The Public Works Department cannot recommend approval of this change of zone, until the
above Comments are addressed.
Public Works retains an expert in drainage engineering to assist with significant drainage
issues, wizen necessary for application review.
The applicant shall address the comments listed above at the specific step of the review
process stated. The review process will continue only when all appropriate elements have
been submitted. Any issues of concern must be resolved with the Public Works
Department prior to recording the change of zone and final plats.

This letter is written as a"letter of understanding that Harold C.and Doris F.
Buxman,Don and Lisa Buxman,owners of the property described below are filing
fora Change of Zone with Weld County Planning Services to develop an eight(8)
lot residential Minor Subdivision and intend to participate in the paving of WCR 29.
Enclosed is a drawing of the proposed development. As can be seen on the drawing,
it is intended that WCR 29 be paved from the southern part of Lot A of the Recorded
Exemption#2339, north to State Highway 392.
Discussions with the Department of Public Works have resulted in the decision that
the owners are responsible for 35%of the costs to pave WCR 29. The owners
intend to enter into an agreement to escrow, upon the sales of each lot,that portion
of the 35%of the estimated costs of construction of the pavement. This money will
be paid to Weld County Department of Public Works at the time of paving of the
Road unless that time period should exceed 10 years. At the end of 10 years,the
escrowed money will be returned to the Buxrnan's and the County will become
responsible for pavement costs without participation from the Buxman's.
It is estimated that WCR 29 would be paved with 3 to 3 VC asphalt on 6"base.
There would be 24'wide pavement with 4' shoulders on each side of the roadway.
The total pavement construction costs to Highway 392 from Lot A north,is
estimated to cost approximately$100,000 and would be charged against the nine(9)
lots that it serves.

recommended conditions have been placed as notes on the plat. The application was
approved with the following Department recommended condition being placed in the

1. A separate building permit shall be obtained prior to any construction. Buildings that meet
the definition of an Ag Exempt Building per the requirements of Section 29-1-20 and Section
29-3-20 B.13 of the Weld County Code do not need building permits, however a Certificate of
Compliance must be filed with the Planning Department and an electrical permit is required for
any electrical service to the building.
2. A plan review is required for each building except for Ag Exempt buildings. Plans shall bear
the wet stamp of a Colorado registered architect or engineer. Two complete sets of plans are
required when applying for each permit.
3. Buildings shall conform to the requirements of the various codes adopted at the time of
permit application. Currently the following has been adopted by Weld County: 1997 Uniform
Building Code, 1998 International Mechanical Code, 1997 International Plumbing Code, 2002
National Electrical Code and Chapter 29 of the Weld County Code.
4. Each building will require an engineered foundation based on a site-specific geotechnical
report or an open hole inspection performed by a Colorado registered engineer. Engineered
foundations shall be designed by a Colorado registered engineer.
5. Building height shall be limited to the maximum height allowed per UBC Table 5-B. Wall and
opening protection and limitations shall be in accordance with UBC Table 5-A. Separation of
buildings of mixed occupancy classifications shall be in accordance with UBC Table 3-B and
Chapter 3. Setback and offset distances shall be determined by the Zoning Ordinance.
6. Building height shall be measured in accordance with the 1997 Uniform Building Code for the
purpose of determining the maximum building size and height for various uses and types of
construction and to determine compliance with the Bulk Requirements from Chapter 27 of the
Weld County Code. Building height shall be measured in accordance with Chapter 23 of the
Weld County Code in order to determine compliance with offset and setback requirements.
When measuring buildings to determine offset and setback requirements, buildings are
measured to the farthest projection from the building.

7. A Flood Hazard Development Permit shall be submitted for buildings constructed within the
100-year flood plain.

The Department of Planning Services has reviewed the submitted Site Plan for Buxman Estates
Minor Subdivision and offers the following comments. This application was previously reviewed
as CZ-603 at the Change of Zone. An Improvements Agreement for Private Road Maintenance
was not received in the referral packet.
Per the application materials, the applicant is proposing an eight parcel Minor Subdivision with
the proposed lots averaging 2.5 acres. There is no vegetation on site. The property is Lot B of
RE 2339, and will be amended to include additional lands. The proposal is in very close
proximity of an existing dairy, owned and operated by the Buxman family.
The Department of Planning Services has regarding the proximity of the existing dairy to the
proposed development The applicant did indicated that Weld County's Right-to-Farm
statement will be placed on the plat.
The School District requested a bus pull-off be located near the eastern entrance flare and
point of ingress/egress of the Minor Subdivision. This is graphically delineated on the drawings
and drawn to a scale to demonstrate the detail required for evaluation by the school district and
this department.
It appears that the on-site retention/detention area for stormwater is not located within the
proposed development. Further, no topography was provided to indicate the direction of
overland flow.
The primary and secondary leach fields shall be identified on the drawings. The width of the
building envelope shall be delineated and the setbacks from the property line shall also be
delineated on the Change of Zone and Final Plats.
The Final Plat shall adhere to the requirements of the Minor Subdivision procedural guide,
specific to identification of the Development, correct legal description, easements certificates,
and labeling of all notes shall be accurate and correct.
Summary
The applicant shall provide additional information pertaining to the entry sign and plant
materials, including common, botanical and species names, size at installation and any
additional information deemed necessary.
The applicant shall provide evidence of the non-potable water source and delivery for irrigation
for proposed plant materials, if any.
The applicant shall submit an Improvements Agreement for Private Road Maintenance for
review and approval with the Final Plat application.
The applicant shall adhere to the plat requirements in preparation of the Final Plat.

We have reviewed the above applicant's request. The Eaton School District has
a process in place addressing growth within the District.
The School District has adopted a methodology to determine a cash-in-lieu
payment for residential development within the District in order to provide
adequate educational opportunities as a result of that development.
The cash-in-lieu payment per dwelling lot is $1,043 for a total of$8,344 for this 8-
Lot Minor Subdivision. Payment should be hand delivered or mailed to Eaton
School District, 200 Park Avenue, Eaton, Colorado 80615. A receipt will be
mailed to the applicant and a copy to the Weld County Planning Department.
As per the Change of Zone PIat,WCR 29 has a transportation collector point/pull
out. The dimensions given will be adequate for the district's needs. Students
riding our bus will be picked up at the entrance to this development.

Subject: MF-1042 - Eight-Lot Minor Subdivision (Buxman Estates)
East of and Adjacent to WCR 29, Approx.1/4 Mile North of WCR 66
Chris,
Thank you for the referral for the above-mentioned project. The 23.2-acre site lies within the
Greeley Municipal Area of Influence, indicating that annexation to the City of Greeley may occur
at some time in the future. Review of this request is therefore within the purview of the City of
Greeley. The City has several concerns related to the proposal:
1. Section 18.40.040.A.1-4 of the City of Greeley Development Code states: "To provide
for the public health, safety, and welfare, it is essential that development occur only when
adequate municipal or public facilities and services (public water, sanitary and storm
sewer; streets;public safety facilities and services;parks and recreation facilities and
services) are available or will be available concurrent with development. " This
development will have access to basic services; however, since the lots would be served
by septic system, it is clear that the proposed subdivision lacks adequate public
infrastructure. Services provided would not be equivalent to those available in urban
areas and would,therefore, not meet this policy.
2. The proposal would allow eight dwelling units on 23.2 acres, or one unit per 2.9 acres.
City of Greeley Planning Commission Resolution 7, 1985, gave administrative review
authority to the Greeley Planning staff to review recorded exemptions. This resolution
indicates that we cannot recommend approval on any application where the overall gross
density exceeds one dwelling unit per 10 acres when the subject property is located inside
Greeley's Municipal Area of Influence. While this request is not a recorded exemption,
this standard would not allow eight dwelling units on 23.2 acres, or one unit per 2.9 acres
when within our Municipal Area of Influence.

3. The site is adjacent to a dairy and a feedlot. The City does not believe that an eight-lot
subdivision is compatible with the neighboring agricultural uses.
4. Section 18.04.1230.E of the City of Greeley Subdivision Regulations requires that cul-de-
sacs be permitted only if they are not more than 500 feet in length. Sunshine Lane, the
sole access point to the subdivision, does not meet this standard.
Therefore, the City of Greeley cannot recommend approval of this residential subdivision. If,
however, Weld County should approve this request, the City of Greeley would recommend the
following:
1. Because Weld County Road 29 (71"Avenue) is one of our future arterial roadways,the
City recommends that a Buffer Yard "B"placed along this right-of-way as required per
Section 18.44.080.A which states: "Single-family dwelling units shall be buffered from
major collector or arterial streets using Buffer Yard Type B. "
2. The Greeley Public Works Department requests that a minimum of 60 feet of right-of-
way from the centerline of Weld County Road 29 (71"Avenue)be reserved to facilitate
future development of this area and that Weld County Road 29 be paved.
3. Sidewalks for pedestrian access should be provided along both Weld County Road 29 and
Sunshine lane,per Section 18.40.060.A.I of our Development Code.
4. All appropriate setbacks under the "E" zone district shall be maintained.
5. Setbacks around the oil and gas well shall be 350 feet rather than the 150 feet shown on
the plan.
